The Philippines: Lawyer turns the tables on accusers

A lawyer accused of threats and extortion by victims of human rights violations during the Martial Law, who received reparations from the government, turned the tables on his accusers.

In a statement emailed to the Daily Guardian on June 12, 2018, Atty. Rey Gorgonio said, “a lawyer is entitled to protection from malicious attack on his person, his honor, his profession and dignity as a human being.”

He cited that on June 10, 2018, at about 2 p.m. more or less, at the Office of the Negros Press Club, my good reputation, honor and dignity as a lawyer was maliciously besmirched by persons whom I have served to the best of my ability as I was able to have their cases filed before the Human Rights Victims Claims Board approved. Thus they were awarded millions of pesos.”

He further claimed that “from March 2014 until the filing of their claims before the Human Rights Victims Claims Board, on July 3 and 4, and in the last week of September 2014, at the Bacolod People’s House, and before the Commission on Human Rights Office, Edmundo Diaz, Danilo Malimbag, Ma. Fe Tanallon, Violeta Oyos, along with many other victims of Martial Law came to my office and engaged my legal services.”

He narrated that at that time, “these persons have no money to pay for acceptance fees and other legal services, and it was them who proposed to pay me half of their award.”

Out of deep sympathy to their plight, Gorgonio said “I only settled for a measly twenty percent (20%) of their total award should they recover any from the claims board to which they voluntarily and willingly agreed. I relied on their representation and was made to believe that they will comply in good faith like my other clients have done.”

Gorgonio further said that since April to July 2014, Diaz, Malimbag, Tanallon, Oyos, along with numerous Human Rights Violations Victims during Martial Law, “were lining up in my office.”

IDHAE: Cent avocats ont été assassinés en 2017 dans le monde

Entretien avec Christophe Pettiti, avocat au barreau de Paris

Chaque année, l’observatoire de l’Institut des droits de l’Homme des avocats européens (IDHAE) publie un rapport qui recense les avocats assassinés, emprisonnés ou menacés dans le monde en raison de l’exercice de leur profession. Le rapport 2018 qui vient de sortir (et qui peut être commandé auprès de contact@idhpb.org) évoque la situation de 379 avocats en danger. Un bilan qui alerte sur l’état des droits et libertés dans le monde.

Depuis quand publiez-vous ce rapport ?

Christophe Pettiti :

L’observatoire mondial des droits de la défense et des violations des droits des avocats a été initié par l’Institut des droits de l’Homme du barreau de Bordeaux créé par Bernard Favreau en 1984. Désormais, il est piloté par l’IDHAE, une association luxembourgeoise qui a vocation à regrouper les associations d’avocats et instituts des barreaux en Europe qui travaillent sur les droits de l’Homme. Nous publions un rapport depuis une quinzaine d’années. Au départ, ce n’était que quelques feuillets distribués à nos membres, il a pris la forme d’un vrai rapport imprimé à partir de 2006. Mais notre mission ne se limite pas à recenser les avocats en danger une fois par an. Nous sommes en veille permanente. À chaque fois qu’un cas nous est signalé, nous le publions sur notre site internet et nous entrons en contact avec les autorités du pays concerné pour porter secours au confrère.

Gaz. Pal. :

Vous remettez également chaque année le prix Ludovic Trarieux. À qui est-il destiné ?

C. Pettiti :

Ce prix a été créé par Bernard Favreau en 1984. Avocat, ancien garde des Sceaux, Ludovic Trarieux a fondé la Ligue des droits de l’Homme ; il a été également à l’origine de la révision du procès de Dreyfus. Il existe de nombreux prix des droits de l’Homme, la caractéristique de celui-ci réside dans le fait qu’il est le seul attribué par des avocats à un avocat et ce, sans distinction de pays ou de barreau. Il est remis à un confrère qui s’est illustré par son œuvre, son activité ou ses souffrances, dans la défense du respect des droits de l’Homme, des droits de la défense, de la suprématie du droit, ou de la lutte contre les racismes et l’intolérance. Le premier lauréat a été Nelson Mandela en 1985 alors qu’il était un avocat, pas très connu, emprisonné depuis 23 ans. Le dernier prix a été remis l’an dernier à Mohammed al-Roken, avocat aux Émirats Arabes Unis, détenu depuis plus de 5 ans parce qu’il défend des opposants au régime. Il arrive parfois que la remise d’un prix vienne en aide au lauréat. Ainsi, en 2016, l’avocate chinoise Wang Lu a obtenu des autorités chinoises sa libération, après avoir accepté de renoncer publiquement à son prix. Pour nous, c’est un succès. En 2014, une autre avocate, égyptienne, Mahiennour el-Massry, a été libérée 1 mois avant de recevoir son prix.

Gaz. Pal. :

Le rapport 2018 montre l’étendue des menaces qui pèsent sur l’avocat dans le monde : plus de 100 assassinats, des centaines de condamnations, emprisonnements, pressions, menaces de mort…

C. Pettiti :

Parmi les avocats recensés dans le rapport, on dénombre évidemment beaucoup de militants des droits de l’Homme ou d’opposants politiques, ou encore des défenseurs de militants ou d’opposants. Mais nous observons aussi les avocats menacés dans l’exercice traditionnel de leur métier, ce qui concerne essentiellement les pénalistes.

Chad: Tchad : Les hommes en toge en grève

Les avocats tchadiens

Avocats, huissiers et notaires ont annoncé mercredi à N’Djamena une grève illimité. Derrière leur mouvement, ils veulent faire tomber certaines personnalités de la République.

Trois professions judiciaires libérales (Avocats, Huissiers et Notaire) appellent à une grève incessante. Dans le viseur de ces juristes, le gouverneur de la région du Logone Oriental, doum Nocky Charfadine et le commandant de la gendarmerie de Doba. Ces derniers doivent répondre de leurs actes devant la justice.  Après l’incident de Doba le 7 juin, une grève d’avocats, huissiers et notaire avait suivi jusqu’au 13 juin.

Hier, l’ordre des avocats s’est réuni en Assemblée générale pour décider de la suite des événements. Selon le secrétaire général de cette association, Me Emmanuel Koumtog, il est inacceptable que le gouverneur bien que relevé de ses fonctions ne soient pas encore convoqué à la barre. Tout comme ils ont dénoncé la situation confuse du commandant de gendarmerie de Doba, dont ils ne savent pas s’il est encore en poste ou s’il a été relevé.

Les professions judiciaires libérales exigent que ces deux personnes soient traduites devant les tribunaux sans d’autres formes de procès. A défaut de cela, ils vont paralyser le système judiciaire par une grève illimitée.

India: Bhima-Koregaon arrests: remand of activists extended

The Pune District and Sessions court on Thursday extended to June 21 the police remand of four of the five activists arrested for alleged Maoist links and for their role in organizing the ‘Elgaar Parishad’.

Judge J.D. Wadne, who passed the order, remanded the fifth accused, human rights lawyer Surendra Gadling, to judicial custody till June 21 on health grounds.

Four of those arrested — noted Dalit activist-publisher Sudhir Dhawale, tribal activist Mahesh Raut, Nagpur University English Professor Shoma Sen and activist Rona Wilson — were produced before the court late afternoon amid tight security.

Arguing for the extension of police custody, Special Prosecutor Ujjwala Pawar said that the investigation had definitively proved that the arrested “were involved in anti-national activities”.

“The accused have been charged with committing acts inimical to national security…the police need more time to examine the electronic material retrieved during searches at their residences,” said Ms. Pawar.

In his counter-arguments, advocate Tosif Shaikh, one of the defence lawyers, said that there was no justification for extending the remand as the police have “made no further progress since the arrest of the accused.”

Iran: The Cases That Made Iran Target Human Rights Lawyer Nasrin Sotoudeh

By arresting Iran’s top human rights lawyer, Nasrin Sotoudeh, powerful Iranian hard-liners are aiming to silence the most prominent voice for the voiceless in the Islamic republic.

Sotoudeh’s husband, Reza Khandan, has saidthat she was rearrested at her home on June 13 to serve a five-year prison sentence on unknown charges. He said she didn’t know anything about the sentence.

The London-based human rights group Amnesty International condemned her latest detention, calling it an “outrageous attack on a brave and prolific human rights defender.”

The United States said it was “deeply concerned” by reports of Sotoudeh’s rearrest.

“First arrested in 2010, Ms. Sotoudeh has spent the past several years harassed by the Iranian regime and has been routinely placed behind bars for daring to defend the rights of those in Iran,” spokeswoman Heather Nauert said in a statement. “We applaud Ms. Sotoudeh’s bravery and her fight for the long-suffering victims of the regime. We call on Iranian authorities to release her immediately, along with the hundreds of others who are currently imprisoned simply for expressing their views and desires for a better life.”

 

Sotoudeh, 55, has been among a handful of rights advocates and activists who have stood up against state repression and highlighted human rights abuses in the country.

In 2010, Sotoudeh was sentenced to six years in prison — reduced from an initial 11-year sentence — and a 10-year ban on practicing law for several charges, including acting against Iran’s national security.
