Turkey: Released academic says detention has become common practice in Turkey

Cenk Yiğiter, an academic who had been fired from his job by the Turkish government, was released on Monday following his detention on Friday at his home in Ankara on suspicion of terrorism.

The Turkish Internet media reported that the purged academic said his detention was completely arbitrary; however, Yiğiter said such detentions have become normal in Turkey. Stating that at this point in time only critics are subject to this unfair treatment, Yiğiter said everyone should be afraid under the existing rule in the country.

Yiğiter said he did not know what he was accused of during his detention and that even his lawyer was not informed since the prosecutor imposed restrictions on access to his case, a prosecutorial authority introduced after a coup attempt in July 2016.

He urged people to keep alive their hope of defeating the darkness in the country.

Yiğiter was among 1,128 signatories of the Academics for Peace petition published in several media outlets on Jan. 11, 2016, calling on the Turkish government to halt military operations in the predominantly Kurdish southeastern part of the country, which caused dozens of civilian deaths and the destruction of vast residential areas.

He was previously convicted of insulting President Recep Tayyip Erdoğan and given a suspended sentence.

Turkey: Hanifi Barış facing criminal investigation for insulting the Turkish President

On 6 November 2018, academic and lawyer Hanifi Barış was notified by the Prosecutor’s Office in Bakırköy that an investigation was opened on whether he insulted the Turkish president through his social media posts. He has been summoned to the Prosecutor’s Office to give his statement between 26-28 November 2018 and may be detained following his statement. There is an ongoing investigation against the human rights defender regarding charges of creating “terrorist propaganda” for the same social media posts.

Hanifi Barış is a lawyer and academic, who has also worked on human rights, and has defended the right of his clients to represent themselves in the Kurdish language. He is a member of Academics for Peace, a group which has condemned state violence in southeastern Turkey and signed the 2016 peace petition “We will not be a party to this crime!”.

On 4 July, Hanifi Barış was arrested by the 10th Criminal Peace Judge. During his interrogation at the Prosecutor’s Office, he was accused of creating “terrorist propaganda” and questioned about his social media posts, which consisted of shared news articles and commentaries from international and local media sources. The human rights defender had not commented on the contents of the links. On 23 July 2018, Istanbul’s 29th High Criminal Court accepted the indictment against Hanifi Barış on the same charges and confirmed his detention. He was released on 18 September 2018 after being held in pre-trial detention for over two months.

Turkey: Academic Cenk Yiğiter Released

Academic Cenk Yiğiter, who was taken into custody on November 9 and was brought to the Prosecutor’s Office earlier today, has been released after giving his deposition.

Academic for Peace Dr. Cenk Yiğiter, who was discharged from the Faculty of Law at Ankara University as per a Statutory Decree and was taken into custody at his house in Ankara on November 9, was referred to the Prosecutor’s Office today (November 12).

Speaking to bianet about the detention of his client, Yiğiter’s attorney Erkan Çiftçi has stated that Cenk Yiğiter has been charged with “engaging in actions and activities in the name of a terrorist organization” due to his Facebook posts and the statements for the press that he made at the Cebeci Campus of Ankara University after being discharged.

Çiftçi has also added Yiğiter is a good medical condition and referred to the Ankara Courthouse today to depose at the Prosecutor’s Office.

It has been announced that Yiğiter has been released after giving his deposition at the Prosecutor’s Office.

He was interrogated on the third day of his detention

As reported by Kemal Göktaş from Diken news website, the interrogation of Dr. Cenk Yiğiter was completed on Sunday (November 11).

During the interrogation, Yiğiter faced the charge of “engaging in activities in the name of PKK (Kurdistan Workers Party)” and was asked whether he knew the students, who were also taken into custody along with him.

Being questioned about his social media posts and his statements for the press held at the campus of Ankara University, Yiğiter stated that he had no sympathies for the PKK and added the he openly condemned some of their activities on his social media accounts.

As for the detained students, Yiğiter said that while he previously had a conversation with one of them, he did not know the other students.

Discharge, studentship, cancellation of law internship

Dr. Cenk Yiğiter was discharged from his post at Ankara University as per the Statutory Decree no. 679 on January 6, 2017.

In 2017, he entered the university entrance exam and qualified to study at the Department of Radio, Television and Cinema of the same university.

However, due to a change in the regulations, he could not enroll at the university on the ground that “he was discharged from public service.”

In 2018, his law internship was cancelled eight days before it ended.

On October 30, 2018, he was sentenced to 1 year, 5 months and 15 days in prison for having “insulted the President” with a tweet that he posted. The Ankara 20th Penal Court of First Instance did not suspend the announcement of the verdict.

Turkey: Turkish police detain peace petition academic Cenk Yiğiter in Ankara

Turkish police detained academic Dr. Cenk Yiğiter on Friday and are reportedly holding him at the counterterrorism branch of the Ankara Police Department.

Yiğiter was one of more than 2,000 academics across Turkey who signed a petition titled “We will not be a party to this crime” in January 2016, calling for a peaceful solution to the military conflict between the Turkish security forces and outlawed Kurdistan Workers’ Party (PKK). In the petition the signatories said they condemned the violence against the Kurds and the Turkish government’s ongoing violation of its own laws and international treaties.

The academics then faced pressure and legal action upon an instruction by Turkish President Recep Tayyip Erdoğan, who called them “traitors” and “so-called intellectuals.” Dozens of those who undersigned the declaration were dismissed from their jobs or detained by counterterrorism police, while their offices were also raided by the police for “evidence of links to terrorism.”

Yiğiter was sentenced on Oct. 5, 2018, by a Turkish court to one year, five months in prison for allegedly insulting President Erdoğan in a social media post that did not mention him by name.

Although Turkish courts usually suspend sentences for the scores of people convicted of insulting Erdoğan in a first-time offense, the judges, in this case, imposed a custodial sentence.

“When someone said ‘Reis’ in the past, I used to think of Chief Temel,” Yiğiter said on Twitter, referring to the cartoon character Popeye, who is known as Chief Temel in Turkey. “Reis,” meaning chief, is a term that has come to refer to Erdoğan, who has run Turkey for the last 15 years. “Now, I think of an idiot,” Yiğiter said.

Yiğiter, who was dismissed from the Ankara University law faculty under a state of emergency decree-law, has also not been allowed to study at the communications faculty of the same university despite passing the entrance examination.

Turkey/UK/Scotland: Hanifi Barış released and banned from travel

Detained academic and lawyer Hanifi Barış was released following his first hearing on 18 September 2018. The human rights defender faces charges of creating “terrorist propaganda” for posts he published on social media. The criminal proceedings remain ongoing and a travel ban was issued against him, which his lawyer will appeal. His next hearing is scheduled for 13 December 2018.

Hanifi Barış is a member of Academics for Peace, a group which has condemned state violence in Southeastern Turkey and signed the 2016 peace petition “We will not be a party to this crime!”.

Hanifi Baris was arrested for posting items of “criminal intent” (reposting articles from Turkish newspapers and other newspapers and magazines) on the internet and to which he did not add any of his own commentary. He has been held in pre-trial detention for this since July 4, 2018. On September 18, 2018 he is scheduled to have his court hearing at the Caglayan Courthouse. International Observers are invited to attend and observe the proceedings. It is hoped he will be released immediately and charges dropped.

They have circulated a petition demanding his immediate release, which has received almost 5,000 signatures.

His case has drawn international scrutiny. Human rights defenders such as Scholars at Risk, Frontline Defenders, Index on Censorship have reported on his arrest and pending trial.

One of his colleagues was quoted by the Index on Censorship describing Hanifi Barış as “the kind of scholar who could find common ground with academics from almost any perspective: always good-natured, cheerful and unfailingly kind to everyone he interacted with.”

Hanifi Barış’s first hearing is scheduled for September 18th at the Çağlayan Courthouse. International observers are invited to monitor this hearing, with the hope that he will be immediately released and cleared of these unfounded accusations.
