Justice est rendue à l'avocat des opposants à Cigéo

Lundi 25 juin, la juge de la détention et des libertés de Bar-le-Duc a ordonné que son matériel informatique soit restitué à Étienne Ambroselli, l’avocat de la lutte contre Cigéo. Une petite victoire après la vaste vague de perquisitions et d’arrestations du 20 juin.

C’est une très belle décision qui protège le secret professionnel, le libre fonctionnement du cabinet d’avocat et la présomption d’innocence ! » C’est avec un grand sourire et sous les applaudissements de ses avocats et amis qu’Étienne Ambroselli est sorti du tribunal de grande instance de Bar-le-Duc (Meuse), lundi 25 juin vers 17 h 35, un carton rempli de son matériel informatique dans les bras. Mercredi 20 juin vers 10 h, ce matériel avait été saisi lors de la perquisition du cabinet et du domicile parisiens de l’avocat d’opposants au projet d’enfouissement des déchets radioactifs Cigéo. Ce dernier avait ensuite passé 36 heures en garde à vue à Toul (Meurthe-et-Moselle) avant d’être entendu par un juge d’instruction et placé sous le statut de témoin assisté. Mais son ordinateur, son téléphone portable et ses disques durs, eux, ont été conservés sous scellés pendant tout le week-end. Lundi, la juge de la détention et des libertés Amélie Chevrier a ordonné la restitution de ces objets. Une petite victoire après une des vagues de répression les plus dures qu’ait connu la lutte contre Cigéo, avec dix autres lieux de vie perquisitionnés et au moins sept autres garde à vue le 20 juin.

Lorsqu’un avocat est perquisitionné, il ne peut contester cette opération et son avocat non plus. C’est au bâtonnier ou à son délégué, présent au moment de la perquisition pour s’assurer qu’elle se déroule dans les règles, de le faire. Me Vincent Nioré, délégué au bâtonnier de Paris spécialiste des perquisitions et saisies, a porté la contestation : « Je fais ça depuis des années. On a créé la jurisprudence. On s’est battu dossier par dossier, on a obtenu des décisions, même dans les dossiers totalement improbables. Mais jamais je n’aurais pensé que je devrais plaider un jour sur la décision sur laquelle on a plaidé tout à l’heure », a-t-il confié pendant le délibéré.

Bhima Koregaon violence: Amnesty, Human Rights Watch call activists’ arrests ‘politically motivated’

India should stop arresting Dalit rights activists, Amnesty International and Human Rights Watch said in a joint statement on Monday. The rights organisations called the recent arrests of five activists by the Pune Police “politically motivated”, and said the Unlawful Activities (Prevention) Act should be repealed.

Five activists – Rona Wilson, Sudhir Dhawale, Mahesh Raut, Shoma Sen and Surendra Gadling – were arrested on June 6 for alleged links to the banned Communist Party of India (Maoist).

The police arrested them after raids at their homes and offices while investigating an event held on December 31 to mark the 200th anniversary of the Battle of Bhima Koregaon. The police claimed that speeches the accused made at the event led to violent clashes between Dalits and Marathas a day later, and that the programme was funded by Maoists.

“This is not the first time that activists working on Dalit and Adivasi rights have been arrested with little evidence,” Amnesty International India chief Aakar Patel said.

India: Lawyer shot dead in broad daylight in Allahabad

Enraged over the murder, lawyers of district court staged a road blockade outside the SSP’s office demanding immediate arrest of assailants and compensation to the family

Bachan Lal Soni, a lawyer at Soraon tehsil in Allahabad, was shot dead on Monday morning while he was on his way to the court.

A lawyer practising at Soraon tehsil was shot dead in Nawabganj area of Allahabad on Monday morning days after he was allegedly threatened not to take up a case of land dispute, police said.

Superintendent of police, trans-Ganga, Sunil Kumar Singh said efforts were on to arrest the assailants.

He said lawyer Bachan Lal Soni, a resident of Kaudihar in Nawabganj, left his home for tehsil on Monday morning. As he reached near Lehra village in Nawabganj, the assailants shot him from a close range, Singh added.

Police rushed Soni to SRN Hospital where he was pronounced dead on arrival.

Singh said an FIR had been lodged against Sadashiv alias Chhote Bachha and other unidentified assailants at Nawabganj police station on Monday evening on the complaint of Soni’s son Pankaj Kumar.

Pankaj alleged that Sadashiv had threatened his father twice asking him not to take up the land dispute case of Rajeshwari vs Shiv Pratap Singh and others.

The widow of murdered Belfast solicitor Pat Finucane is taking her bid for a public inquiry into his death to the UK’s highest court.

Geraldine Finucane’s 39-year-old husband Pat was shot dead by loyalist paramilitaries in 1989 in an attack found to have involved collusion with the British state.

Mr Finucane, who represented a number of high-profile republicans, was murdered in front of his wife and children at their north Belfast home.

Former prime minister David Cameron decided not to hold a public inquiry into the killing — one of the most notorious of The Troubles — but ordered an investigation by a senior lawyer.

The review by Sir Desmond de Silva QC, a former UN war crimes prosecutor, concluded there was “no overarching state conspiracy” in the lawyer’s death but found “shocking” levels of state collusion involving the army, police and MI5.

Mrs Finucane has described Sir Desmond’s 2012 report as a “whitewash” and has waged a lengthy legal battle for a public inquiry.

In February last year, she lost the latest round of the fight at the Court of Appeal in Belfast.

Malaysia: Malaysian Bar on Siti Kasim case: Stop abuse of police powers, establish IPCMC now

The Malaysian Bar is troubled that the police continue to grossly misconstrue their investigative powers and exercise them in a high-handed and oppressive manner.

In a statement on Monday (June 25) night, Bar president George Varughese said that powers to arrest are not meant to be used to begin gathering evidence against an individual.
“Further, investigative powers cannot be used to arrest or detain individuals or to seek remand orders only for the purposes of gathering evidence,” he added.

Varughese was referring to the arrest and detainment of activist lawyer Siti Kasim for purportedly kidnapping her client and for allegedly obstructing a public servant in the discharge of his/her public functions pursuant to sections 363 and 186 of the Penal Code respectively.
The above had “appalled and outraged” the Malaysian Bar.

“At the outset, the police should have conducted thorough investigations in respect of any police report lodged against Siti Kasim rather than simply proceeding to effect an arrest. The powers of investigation and arrest must not be used to intimidate suspects and the application for remand orders must be used sparingly and only when necessary,” he cautioned.

Varughese said that this failure to act in an impartial manner undermines the credibility of the police force and further erodes their neutrality, integrity and professionalism.

“The conduct of thepolicein this case will invariably give rise to an irresistible inference in the public’s mind that the police are once again abusing their power,” he warned.

Saudi Arabia/AI: Women now allowed to drive, but more reforms must follow

Saudi Arabia’s decision to allow women to drive is welcome but must now be followed by more reforms to women’s rights, Amnesty International said today.

This weekend (Sunday 24 June) women will be allowed to drive in the country as the controversial driving ban is lifted.

However, leading women’s rights activists and campaigners against the driving ban – including Loujain al-Hathloul, Iman al-Nafjan and Aziza al-Yousef – are among eight activists still being detained in Saudi Arabia for their peaceful human rights work. Some have been detained without charge for more than one month, and may face trial before the counter-terror court and up to 20 years in prison for their activism.

The women’s rights activists detained have campaigned for the right to drive and the end of the repressive male guardianship system in Saudi Arabia for many years.

Under Saudi Arabia’s repressive guardianship system, women and girls face systematic discrimination, both in law and in practice. Women are unable to travel, engage in paid work or higher education, or marry without the permission of a male guardian. In addition, Saudi Arabian women married to foreign nationals cannot pass on their nationality to their children, unlike Saudi Arabian men in a similar situation.

Chilling effect of recent smear campaign

The latest crackdown on women’s rights activists comes despite Crown Prince Mohammad bin Salman presenting himself as a ‘reformer’. His international public relations campaign contrasts sharply with an intensifying crackdown on dissenting voices, including those campaigning for equal rights for women.

On 19 May, the Saudi Arabian authorities and government-aligned media launched a public smear campaign to try to discredit five prominent detained women’s rights defenders as “traitors” following their arrest. Official statements in state media accused the activists and other individuals of forming a “cell” and posing a threat to state security for their “contact with foreign entities with the aim of undermining the country’s stability and social fabric”.

Iran: Detained Human Rights Lawyer Nasrin Sotoudeh Protests “Fabricated” Charges by Refusing to Post Bail

Detained Iranian human rights lawyer Nasrin Sotoudeh has refused to post bail in protest against the charges that have been laid against her.

“Nasrin believes the bail amount is not only heavy but also does not fit the baseless and fabricated charges against her, and she has refused to accept it,” Sotoudeh’s husband Reza Khandan told the Center for Human Rights in Iran (CHRI) on June 23.

Bail had been set at 650 million tomans (approximately $152,500 USD) for the well-known human rights lawyer to be released until being tried for the charges of “propaganda against the state” and “assembly and collusion against national security.”

Iranian security agents arrested Sotoudeh, 55, at her home on June 13, 2018, based on a complaint filed by a judicial official in Kashan, 152 miles south of Tehran, in connection with Sotoudeh legally representing Shaparak Shajarizadeh, who has been charged for peacefully protesting against Iran’s compulsory hijab law.

Sotoudeh also recently publicly criticized the judiciary’s decision to restrict the right to counsel of detainees facing politically motivated charges to just 20 state-approved lawyers.

Sotoudeh has refused to retain a lawyer to reiterate her opposition to the list and has threatened to remove her hijab in prison if she is not released.

روز چهارشنبه ساعت ۲۰.۳۰ به وقت ایران در شبکه‌های اجتماعی و در دفاع از وکیل‌مان نسرین ستوده، در طوفان توییتری شرکت می‌کنیم. زیرا:

– نسرین ستوده شجاعانه از حقوق ما دفاع کرده است.

– نسرین ستوده شجاعانه از دختران خیابان انقلاب که به حجاب اجباری معترض‌اند در دادگاه‌ها دفاع کرده است و اینک هزینه این دفاع را در زندان می‌پردازد.

– نسرین ستوده به وکلای انتصابی قوه قضاپیه در دفاع از متهمان سیاسی و امینیتی اعتراض کرده است. او انتخاب ​​آزادانه ​وکیل را حق شهروندان و انتخاب موکل را حق وکلا می‌داند و دخالت قوه قضا​ییه​ در این امر را شکستن حریم​ آزادی شهروندان می‌داند.

– از نسرین ستوده حمایت می کنیم زیرا نمی‌خواهیم به بدعهدی متهم شویم. تاریخ کشورمان به یاد خواهد داشت که مردم، مدافعان واقعی حقوقشان را تنها نگذاشته‌اند.
