Turkey/Academics for Peace: Barış akademisyenine avukatlık da yasak


İhraç edilen barış akademisyeninin avukatlık yapabilmesi için Türkiye Barolar Birliği’nin aldığı kararın yürütmesi, Adalet Bakanlığı’nın başvurusu üzerine durduruldu.

Ankara 2. İdare Mahkemesi, “barış” bildirisine imza attığı için Dicle Üniversitesi’nden ihraç edilen akedemisyen Yasin Bedir’in avukatlık yapabilmesi için Türkiye Barolar Birliği (TBB) tarafından verilen kararının yürütmesini durdurdu. Mahkeme, Bedir’in avukatlık yapmasının “terörle mücadeleyi sekteye uğratacağını savundu. Dicle Üniversitesi’nde araştırma görevlisi olarak çalışan Bedir, barış bildirisine imza attığı gerekçesiyle ihraç edildi. Hakkında “terör örgütü propagandası” yapmak iddiasıyla soruşturma başlatılan Bedir, ihraç kararının ardından İstanbul Barosu’na kaydını gerçekleştirerek avukatlık yapmaya başladı. Ancak Adalet Bakanlığı , TBB’nin Bedir’in avukatlık yapabilmesine izin veren kararının yürütmesinin durdurulması istemiyle dava açtı. Ankara 2. İdare Mahkemesi, 3 Mayıs’ta verdiği kararla işlemin yürütmesini durdurdu. Baroların, kamu görevlilerinin bir daha kamu hizmeti yapamayacağına ilişkin KHK’yi “dar yorumlanması”na karşı çıkan mahkeme, “kamu hizmeti” içerisine avukatları da koydu. Mahkeme, kararında barış imzacısı olduğu için ihraç edilenlerin avukatlık yapmasının “terörle mücadeleyi sekteye uğratacağı gibi KHK’nin amacıyla da bağdaşmadığını” öne sürdü.

Açık düşmanlık

Karar sonrası toplanan İstanbul Barosu , Yasin Bedir’in adının baro levhasından silinmesine karar verdi. Mahkemenin kararına tepki gösteren Bedir, burada asıl eleştirilmesi gerekenin siyasi iktidar ve onun emrindeki yargı düzeni olduğunu belirterek, “Bu yapılan açık bir düşmanlıktır. Bizlere, Barış imzacılarına karşı düşman hukuku uygulanıyor. Bizlere adeta nefes aldırmamaya yeminli bir siyasi irade var karşımızda. Bize ağaç kabuğu yesinler diyorlar. Fakat onlara inat ne ağaç kabuğu yiyeceğiz ne de bu adaletsizliğe boyun eğeceğiz” diye konuştu.


N.B. A member of Academics for Peace, lawyer Yasin Bedir has had his lawyer’s practising certificate cancelled because of an investigation launched against him due to signing the Academics for Peace declaration.  Previously he was working at the Dicle law school (Diyarbakir) as a research assistant, but he was dismissed from his position because he signed the declaration. He then applied to the İstanbul Bar to become a practising lawyer. The Bar accepted his application and he received his praticising certificate. He worked as a lawyer about two months, and then the Department of Justice applied to court to cancel his certificate which was granted so he is now unable to work as a lawyer.

India: Threatened rights lawyer Bilal Kagzi files petition before Chief Justice

To, Chief justice of India, Supreme Court of india. New Delhi.

Subject – write petition under Article of 32 of constitution of india. To protection of life and liberty art 21, right to practice any profession art 19.

I am Bilal kagzi form kosamba, District – surat Gujarat. I am human rights lawyer. I am representing indigent people in various court and commission in case of human rights violations, police atrocities cases. I am currently working for implementation of Prevention of Atrocities Act (ST, SC). I am associated with adivasi rights organisations as Legal advisor in surat District. All my these works make me enemy of establishment and ruling parties. Now i am representing some of my clients in criminal cases as advocate. It is my duty as my profession. Today i got news form my well wishers that Sajid Don and his gang heach conspiracy to kill me. They are keeping Watch my all movements. They are following me. Some unknown criminal are moving in my village. Last month they send massage me to leave the cases otherwise ready to face dare consequences. Last year i represented one of victim of atrocities act against sajid don. He was a accused of that case. We were strongly opposed his bail application due to my representation he had to remain in jail for 14 days.

Sajid Don is history sheeter in kosamba police station. Number of criminal cases registered against him including PASA, TADIPAR, Atrocities act, and 307 of I. P. C, Rioting. He is natorius criminal.

He has strong support for politicians. Surat district police cannot take any action against him due to political pressure. They threatened me to implicating me in fabricated criminal cases.

In this situation very difficult to fight for justice in Gujarat. It is very difficult to practice as lawyer, recently two lawyers kill to representing their clients against strong political supported criminals. My family life also under threat.

Now, my life is in danger. Due to life threat i cannot go out my home even i could not go to court. I cannot file any complaint in Gujarat because there is huge political pressure on police department. List of sajid don’s gang members are very long.

Kindly consider my this petition to urgency.

1.To take actions against sajid Don and his gang members as per the law. 2. To book sajid don and his gang member under Prevention of anti social act (PASA ACT) 3. To provide police protection to Bilal kagzi and his family. 4. To ensure protection of fundamental and human of Bilal kagzi to practice as Advocate. 5. To ensure not to register any fake and fabricated criminal cases against Bilal kagzi.

The Philippines: Bring Sereno back! IBP urges SC to reverse decision on quo warranto case

The Integrated Bar of the Philippines (IBP) has urged the Supreme Court (SC) to overturn the ruling to oust chief justice Maria Lourdes Sereno.

“No considerations of politics or animosity justifies the refusal to recognize the constitutionally designed mechanism of impeachment and the doctrine of judicial restraint which are clearly proper,” said IBP President Abdiel Dan Elijah Fajardo said in a statement Friday (June 8).

The SC en banc voted last May 11 to grant the quo warranto petition which sought to nullify the 2012 appointment of Sereno for her failure to comply with the requirements set by the Judicial and Bar Council (JBC).

“The Rule of Law cannot survive in a legal system where the law changes like sand dunes at the whim of desert winds,” he said.

“As universally recognized, the law is a set of open, general and relatively stable laws. The stability of the system of laws is what draws the line between a rule of law or a rule of men,” he added.

Meanwhile, Fajardo said the IBP is set to file a motion this Monday appealing to the SC to void its decision to oust Sereno.











China: China Slaps Prominent Human Rights Lawyer With Effective Travel Ban

Chinese authorities in the northern region of Inner Mongolia have refused to issue a passport to a prominent human rights lawyer detained in a recent crackdown, effectively banning her from leaving the country.

Human rights lawyer Wang Yu and husband Bao Longjun were both detained in a massive nationwide crackdown on rights lawyers and activists that began in July 2015.

They have been prevented from sending money out of the country to finance their son’s studies in Australia, and Wang had hoped to take him the money in person.

But she has now been slapped with an effective travel ban by the police-run entry and exit bureau in Inner Mongolia’s Hinggan (in Chinese, Xing’an) League, Bao told RFA on Friday.

“The moment she got out her ID card and swiped it, they said ‘no way’,” he said. “They said they couldn’t process her passport application for reasons of national security.”

Bao said Wang had hoped to visit the couple’s son, Bao Zhuoxuan, who is currently studying in Melbourne after being denied permission to leave China for more than two years in the wake of his parents’ detentions.

Egypt: Solidarity with Egyptian Human Rights Defenders and Civil Society

We, the undersigned organizations and individuals, express solidarity with the bloggers, journalists, human rights defenders, and other civil society members in Egypt who have been arrested with unprecedented frequency in recent weeks. The current escalation is the latest installment in the government’s sustained crackdown on civil society, which initially intensified with the 2011 NGO trial, or Case 173, that was reopened in March 2016. We are gravely concerned by this escalation and fear it may mark the beginning of a trend that could continue throughout President Abdel-Fattah El Sisi’s second term.

Despite having no involvement with terrorism or militant activities, many of those arrested have been detained on charges of belonging to terror groups in accordance with the Counter-terrorism Law. Misapplication of this law and others being used to legitimate this crackdown does little to address Egypt’s real security challenges. Rather, it erodes citizens’ willingness to cooperate with and support the government’s efforts to address Egypt’s terror threat.

The arrests have targeted individuals such as former Sisi campaigner Dr. Hazem Abdel Azim, accused of belonging to an outlawed group and disseminating fake news. Prominent blogger and rights activist Wael Abbas was also arrested last week, and his detention was ordered by the State Security Prosecution. Abbas joins activist Amal Fathy, satirical blogger Shady Abu Zeid, activist Shady al-Ghazaly Harb, and labor lawyer Haytham Mohamadeen, among many others. This period follows the government’s repression of media, with several journalists being arrested in the wake of the presidential election. Authorities have also targeted civil society actors with court cases; researcher and writer Ismail Iskanderani received a 10-year prison sentence in military court last month after spending over two years in pretrial detention. This week Abdel Azim, Abu Zeid, and Abbas had their detentions extended by an additional fifteen days.

India: Bhima Koregaon arrests: Protesters demand release of poet Sudhir Dhawale and others held in Pune

Nearly a hundred activists from Dalit and socialist organisations held a protest rally outside the suburban District Collector’s office in Mumbai on Friday afternoon, demanding the release of writer Sudhir Dhawale and four other social activists arrested by the Pune police on June 6.

Other activists from these organisations held simultaneous rallies in Pune, Nagpur and Gadchiroli districts, to protest the police’s claims that the five people arrested are “top urban Maoists” who incited the violence in Pune district’s Bhima Koregaon town on January 1.

In a co-ordinated operation on the morning of June 6, teams from the Pune police arrested Sudhir Dhawale from Mumbai, activist Rona Wilson from Delhi and lawyer Surendra Gadling, professor Shoma Sen and Adivasi rights activist Mahesh Raut from Nagpur. All five were produced before a Pune court judge on Thursday and remanded to police custody till June 14.

In addition to charges of inciting the Bhima Koregaon violence, the police have charged all five under sections of the controversial Unlawful Activities (Prevention) Act, for alleged links with the banned Communist Party of India (Maoist).

In fresh allegations made in court on Friday, the police claimed that they had found a letter in Rona Wilson’s house that allegedly mentions a requirement of Rs 8 crore to procure M-4 rifles and four lakh rounds, and discusses plans of “another Rajiv Gandhi type incident”. Some media outlets have reported this as being indicative of a plot to assassinate Prime Minister Narendra Modi.

At the rally outside the Collector’s office in Mumbai, protesters claimed that these allegations are false and that the letter itself is fabricated.
