Comores: Vendredi 5 juillet 2019. 10h00.

Turkey: 13 FETO terror suspects arrested in Turkey

July 4, 2019

13 FETO terror suspects arrested in Turkey

At least 13 people were arrested on Thursday for their suspected links to Fetullah Terrorist Organization (FETO), the group behind the 2016 defeated coup in Turkey, according to a security source.

The suspects were rounded up within the scope of simultaneous counter-terrorism operations in 17 provinces across Turkey.

Earlier, the prosecutor’s office in capital Ankara had issued arrest warrants for 29 suspects as part of an investigation into irregularities in staff recruitment exams, said the source, who asked not to be named due to restrictions on speaking to the media.

The suspects, which included “covert imams” — senior FETO members — civil and military judge candidates, expelled officers and on-duty lawyers, are accused of staying in FETO/PDY (Parallel State Structure) houses to study for judicial exams held in 2013, the source added.

They are sought for being member of a terror organization, aggravated fraud, and forgery with terror aims.

FETO and its U.S.-based leader Fetullah Gulen orchestrated the defeated coup attempt of July 15, 2016, which left 251 people martyred and nearly 2,200 injured.

Ankara also accuses FETO of being behind a long-running campaign to overthrow the state through the infiltration of Turkish institutions, particularly the military, police, and judiciary.

Nigeria: Certificate seizure: Court orders Police to pay N5m in damages to lawyer

July 4, 2019

Group hails FG for directing police to mop-up all illegal arms

Justice Nicholas Oweibo of a Federal High Court in Lagos has ordered the Police to pay N5 million in damages to Anthony Makolo, a Human Rights Campaigner, over the seizure of his Call to Bar Certificate.
Makolo had sought a court order to enforce his fundamental rights against the Police over unlawful detention and seizure of his Call to Bar Certificate.

Makolo said he was surprised when on November 12, 2018, the third and fourth respondents accosted him (applicant) at the Yaba Magistrates’ Court, handcuffed him, pushed him into a waiting Honda car and drove off to their office.
He said when it dawned on him the possible reason for his arrest, he immediately reminded them that he was not a surety for his client, but had only recommended their bails, adding that the surety is the proper person to be invited where they failed to show up.
According to him, the respondents replied that “they had no time for that”.
He said it took the intervention of his colleagues, who had seen him being whisked away from the Yaba Court’s premises, to seek his bail the following day, November 13, 2018.
He said he was admitted to bail with two sureties, while the original copy of his Call to Bar Certificate was seized by the respondent and same has not been released to him till date in spite of repeated demands.
The applicant, therefore, sought an order declaring the seizure of his Certificate as a flagrant abuse and violation of his right to legal practice, and urged the court to order the immediate release of same.
Besides, the applicant had claimed the sum of N50 million in damages against the respondents, jointly and severally, for breach of his fundamental rights.

Australia/Timor Leste: PM leaves door open to dropping spy case

July 5, 2019

The government has been urged to drop its prosecution of Witness K and lawyer Bernard Collaery.

The former president of East Timor, Xanana Gusmao, has urged the federal government to abandon its prosecution against a former spy known as Witness K and Canberra lawyer Bernard Collaery.

“These are matters that obviously get considered within the government and with the attorney-general,” Mr Morrison told ABC radio on Friday.

“Based on that advice, we’ll continue to consider all those matters very cautiously.”

The pair are charged with exposing an Australian spying operation against East Timor.

Mr Gusmao, who is now a senior minister, has described the charges as an injustice.

1.     Introduction

Since 30 June 2016, the Government of the Philippines has engaged in a continuing, gross, and systematic campaign of extrajudicial killing in violation of the Philippines’ international law obligations. Since President Rodrigo Duterte (President Duterte) took office on 30 June 2016, an estimated 27,000[1] persons, including children,[2] have been extrajudicially killed with impunity, as part of a “war on drugs.” The Philippines’ official number is 6,600.[3] Among the victims are 43 lawyers, prosecutors and judges (jurists) assassinated between August 2016 and May 2019 and numerous human rights defenders (defenders). This pattern of gross and systematic violations contravenes the Philippines’ obligation to prevent and remedy violations of the right to life. The widespread murders of jurists also causes violations of the rights to legal representation and a fair trial.

In only five cases are suspects in custody or charges pending against a suspect. In the remaining  cases there appears to have been no effective investigation or minimal progress on investigations. In addition to the 43 jurists murdered, eight lawyers have survived murderous attacks, and one has been abducted and disappeared. A court worker and two paralegals are also among those extrajudicially killed. A list of the 43 jurists with dates of death and status of investigations as of 10 June 2019 is found in the Appendix to this report.
