Summary

In 2008, encouraged by a sense that China was opening up to more democratic norms, a group of lawyers in Beijing sought to directly elect the Beijing Lawyers Association, which was controlled by the government and did not serve lawyers’ genuine interests. In this exclusive interview, nine lawyers tell the story of their endeavor, the government’s response, and how the lawyers and law firms that participated were punished for their roles in the effort.

Turkey: Turkey must rebuild trust in judiciary, protect human rights – CoE commissioner

The Council of Europe Commissioner for Human Rights Dunja Mijatovic has called on Turkey to urgently take measures to re-establish trust in its judiciary and repair the rule of law, which was damaged during two years of emergency rule following the July 2016 coup attempt.

Constitutional changes regarding the Council of Judges and Prosecutors (HSYK) made during the two-year state of emergency “are in clear contradiction with Council of Europe standards,” Mijatovic said following a five-day visit to Turkey.

“The suspension of ordinary safeguards and procedures for the dismissal, recruitment and appointment of judges and prosecutors’’ were an additional cause for concern, she said.

Turkey’s state of emergency came into effect on July 20, 2016, days after the Justice and Development Party (AKP) government survived a coup attempt.

The state of emergency allowed the government to issue decree laws, bypassing legislative and judicial procedures. Over 77,000 people have been arrested and another 150,000 civil servants, military personnel and others have been fired from the government as part of a crackdown by Ankara following the failed putsch.

L’avocat et défenseur des droits de l’homme, Salah Dabouz entamera une grève de la faim illimitée cet après-midi. Par ce geste, l’avocat compte dénoncer le contrôle judiciaire auquel il est soumis depuis plusieurs mois – 3 fois par semaine et un déplacement de 600 Km-. Selon lui, la justice continue de brimer les droits des activistes mozabites, notamment lui et la famille du défunt Dr Fekhar. Nous reviendrons avec plus de détails sur cette grève de la faim.

بسبب ما اعانيه من جراء الرقابة القضائية المفروضة علي ثلاثة مرات في الاسبوع وعلى بعد ستمائة كيلومتر من مقر اقامتي، منذ تاريخ 8 ماي 2019 في نفس الملف الذي اعتقل من أجله الدكتور كمال الدين فخار في 31 مارس 2019 والذي أدى إلى وفاته في 28 ماي 2019 والذي جمد نشاطي كمحامي ومدافع عن حقوق الإنسان وهو الإجراء الذي لم يحدث ابدا من قبل في تاريخ الجزائر، قررت إخطار صديقي مايكل فرست، المقرر الخاص بوضعية المدافعين عن حقوق الإنسان من أجل التكفل بوضعيتي.

 

Concernant le contrôle judiciaire que les autorités judiciaires de Ghardaia me font subir, 3 fois par semaine, depuis le 8 avril 2019, et à 600 km de chez moi, une mesure jamais décidé en Algérie, dans le même dossier qui a vue Dr Kameleddine Fekhar mourir en prison le 28 mai 2019, et vue que cette mesure me met dans l’incapacité d’exercer mes fonctions d’avocat et de défenseur des droits humains, j’ai officiellement saisis mon ami Michel Forst, le Rapporteur spécial sur la situation des défenseurs des droits de l’homme.

Macau/China: COURTS | ONE FOUND GUILTY IN ATTACK ON LAWYER JORGE MENEZES

One of the two assailants who attacked lawyer Jorge Menezes has been sentenced to one year and nine months of imprisonment, the Court of First Instance announced on Friday morning. Meanwhile, the other has been acquitted, considering that his identification is “questionable”.

Walking his 5-year-old son to pre-school on the morning of May 16, 2013, lawyer Jorge Menezes was suddenly ambushed in Sintra Square by two mainland assailants who swung at him with bricks strapped to their hands. The attack reportedly had all the hallmarks of organized crime with, according to some, an obvious triad connection.

The Public Prosecutions Office (MP) and the Court of First Instance disagreed. In Friday’s sentencing, just one of the two defendants – both Chinese nationals from the mainland – was sentenced and to less than two years in prison.

The Philippines/Iceland: Karapatan calls on UN member states to push Iceland’s proposal concerning human rights in PH

Human rights group Karapatan has called on the United Nations member states to support Iceland’s resolution regarding concerns on the prevailing rights woes in the Philippines.

On June 4, 2019, Iceland tabled a proposed resolution to the UN Human Rights Council, asking member-states to take concrete steps on the promotion and protection of human rights in the Philippines during the council’s 41st session.

The said resolution was supported by 28 states, urging for further action on the reported rights violations in the country.

“We welcome the proposed resolution by Iceland and urge other UN HRC member-states to vote for its adoption.

Halfway into the Duterte government, extrajudicial killings have worsened within the regime’s repressive anti-narcotics drive and counterinsurgency campaign. While there are ongoing efforts to investigate these violations in the domestic front, the adoption of this resolution should jolt this government into remembering all the human rights obligations and treaties that it is mandated to uphold,” said Karapatan secretary general Cristina Palabay.

Palabay is currently monitoring the HRC sessions in Geneva, Switzerland.

The proposed resolution expressed concern on reported cases of extrajudicial killings, enforced disappearances, arbitrary arrest and detention, intimidation and persecution of or violence against members of civil society, human rights defenders, indigenous peoples, journalists, lawyers, members of the political opposition, and restrictions on the freedoms of opinion and expression, peaceful assembly and association.
