India: Illegal for advocates to boycott court: Uttarakhand HC

The Uttarakhand High Court on Wednesday ordered that it is illegal for advocates to resort to strikes or boycott of the courts, and disciplinary action can be taken by the State Bar Council and its disciplinary committee for such misconduct. The court also said that a litigant, who suffers entirely on account of his advocate’s non-appearance in court, can sue the lawyer for damages.

A bench comprising Chief Justice Ramesh Ranganathan and Justice Alok Kumar Verma ruled that no court is obliged to adjourn a case because of a strike call as it is its solemn duty to proceed with judicial business during court hours.

The order came on a PIL filed by one Ishwar Shandilya in 2016. The petitioner’s counsel, Kartikey Hari Gupta, said the hearing of Shandilya’s case in Dehradun district court was getting repeatedly deferred due to strikes called by lawyers.

Gupta said that lawyers of District Bar Association of Dehradun, Haridwar and Udham Singh Nagar have been boycotting work on all working Saturdays for the last more than 35 years.

Kashmiri Lawyer, Who Encouraged People to Vote, Detained to Prevent Protests

In occupied Kashmir, senior High Court lawyer and former Bar president, Nazir Ahmad Ronga has been booked under the black law PSA for speaking against India’s illegal and unilateral decision to revoke the territory’s special status.

Nazir Ahmad Ronga, who is also a close aide and legal adviser of Hurriyat forum Chairman, Mirwaiz Umar Farooq, was taken into custody by the Chrar-e-Sharief police station on August 9 and subsequently booked under the draconian Public Safety Act on the orders of District Magistrate, Srinagar, Shahid Iqbal Choudhary on August 17.

“You are very vocal against abolishing of Article 370 and 35(A) of the Constitution of India and also against bifurcation of erstwhile J&K state. You have led many protest marches in general and created problems in public order within Srinagar district, besides instigated youth in general and party workers and youth belonging to your community in particular,” reads the grounds of detention signed by the magistrate concerned while passing PSA detention orders against Ronga.

“The subject by way of (enjoying) influence in his community can get large number of protest(s) against the decision (abrogation of 370 &35A) taken by the Government of India,” the grounds read.

Though initially he was lodged at Central Jail, Srinagar, but later he was shifted to a jail in Uttar Pradesh, India.

Tunisia: Les avocats annoncent une journée de colère demain vendredi 27 septembre

Le conseil national de l’ordre des avocats annonce une journée de colère nationale demain, vendredi 27 septembre, qui sera marquée par des sit-in avec la robe officielle, au Palais de Justice de Tunis et dans l’ensemble des tribunaux du pays, sous le signe « Non à l’agression contre le barreau, le droit à la défense est une garantie fondamentale pour l’indépendance de la justice ».

Réuni en urgence hier mercredi après la décision de faire comparaitre six avocats membres du collectif de défense des martyrs Chokri Belaïd et Mohamed Brahmi devant le juge d’instruction, le conseil de l’ordre des avocats annonce « le boycott du procureur de la république du tribunal de première instance de Tunis 1, tout en lui faisant assumer la responsabilité de ce qu’il en est advenu de la situation, et le dépôt d’une plainte à son encontre auprès du conseil supérieur de la magistrature et du ministère de la Justice ».

Il a, par ailleurs, dit son intention « de prévenir les organisations régionales et internationales, le rapporteur spécial auprès des Nations-Unies, et le comité des droits de l’homme, de l’agression contre les avocats et la violation du droit de la défense », annonçant son rejet catégorique de la comparution des avocats devant le juge d’instruction, au nom du principe de l’immunité de l’avocat pendant l’accomplissement de ses missions, conformément à l’article 105 de la constitution et les articles 46 et 47 du décret-loi n’o 20 organisant la profession d’avocat.

Le CNOA appelle « à réformer le dispositif judiciaire, ce qui garantit une indépendance du pouvoir judiciaire, tout en l’éloignant de tous les tiraillements politiques ».

Il a qualifié en préambule les événements survenus dernièrement au tribunal de première instance, dénoncés par les juges comme étant une intrusion dans l’enceinte du tribunal et une atteinte à l’autorité du pouvoir judiciaire et de l’Etat, comme étant « une agression contre la défense, suite à l’intervention des forces de sécurité au sein du tribunal de première instance de Tunis 1, sur instruction du procureur de la république ».

Le barreau a exprimé sa totale solidarité avec le collectif de défense des deux martyrs, et réclame l’accélération du processus de révélation de la vérité sur les assassinats politiques et l’appareil secret.

Egypt: Egyptian authorities threaten to ‘decisively confront’ protesters

Over 1,900 arrested as Egypt braces for more demonstrations planned for Friday against rule of Abdel Fatah al-Sisi

Egyptian authorities have made it clear that they intend to use force to quell Friday’s planned demonstrations against the rule of the president, Abdel Fatah al-Sisi.

Public dissent has been all but extinguished under the former army general, who swept to power in a military coup in 2013, making any form of protest extremely dangerous.

More than 1,900 people have been arrested since rare protests broke out last weekend, and on Thursday the ministry of the interior “affirmed that it will confront any attempt to destabilise the country with decisiveness”, according to local media.

Central Cairo was heavily guarded as riot police, vans of security officials and plainclothes police spread out along the network of streets surrounding Tahrir Square, the epicentre of Egypt’s 2011 revolution.

The figures for the arrests were compiled by the Cairo-based NGO the Egyptian Center for Economic and Social Rights. Bystanders and others who had little to do with the protests were reportedly detained along with the demonstrators, and those arrested were being held across the country.

Several prominent opposition figures have been detained, despite no indication that any were involved with the new wave of dissent.

The award-winning human rights lawyer Mahienour el-Massry was seized outside a Cairo courthouse where she was defending protesters. Days later, journalist and opposition politician Khaled Dawoud was arrested, as well as the political scientist Hassan Nafea and Hazem Hosny, a former spokesperson for the former military chief of staff Sami Anan, who remains in detention after attempting to run for president last year.
