Cameroon: Cameroun: un tribunal militaire pour juger l’opposant Maurice Kamto

Au Cameroun, la Cour d’appel de Yaoundé a rejeté, ce jeudi, la requête des avocats de l’opposant Maurice Kamto. Ils souhaitaient que cette juridiction déclare le Tribunal militaire incompétent dans cette affaire parce qu’elle concerne un civil. Ils ont été déboutés au motif que les juges militaires avaient déjà été saisis. L’ancien ministre, qui est inculpé « d’hostilité envers la patrie », est emprisonné depuis sept mois.

Les avocats de Maurice Kamto auraient voulu que la Cour d’appel du centre tranche sur le fond : le procès d’un civil devant un tribunal militaire est-il, oui ou non, conforme à la Constitution du Cameroun et des engagements internationaux de l’État camerounais ? Devant cette juridiction, les avocats de l’opposant ont fait valoir que non. Mais ce jeudi, à Yaoundé, la Cour d’appel a préféré esquiver la question :elle a estimé que le Tribunal militaire, ayant déjà été saisi de l’affaire Kamto, ne pouvait pas, par conséquent, être déclaré incompétent.

Selon maître Emmanuel Simh, un des avocats de Maurice Kamto et de ses coaccusés, ce raisonnement est « tout à fait étonnant » : « Le juge devait connaître la question au fond et ne pas nous imposer simplement l’irrecevabilité, en prétextant que le tribunal est saisi pour juger les civils. Et on nous dit que, ce tribunal étant saisi, notre requête est irrecevable. C’est un vrai non-sens juridique, c’est un scandale en matière de droit. »

Le porte-parole de Maurice Kamto, Olivier Nissack, accuse la Cour d’appel d’être « extrêmement politisée ». Sur sa page Facebook, il dénonce son « instrumentalisation criarde par le régime ». Maurice Kamto reste en prison malgré les nombreux appels à sa libération. Son procès, comme celui de ses partisans, doit débuter le 6 septembre. Il risque la peine capitale.

The Philippines: Cebu lawyer wounded in ambush

A veteran lawyer was ambushed and wounded in a busy street here Monday morning.

Lawyer Inocencio De La Cerna Jr. attended a hearing at the Qimonda IT Center, Cebu City’s temporary courthouse at around 9:15 a.m. and was driving his vehicle along Port Service Road when he was attacked.

Two men on a motorcycle overtook the lawyer’s vehicle and opened fire.

They sped off after the attack.

Chief Master Sergeant Ruth Bongo, investigator of the Waterfront Police Station, said De La Cerna managed to return fire.

The lawyer sustained a gunshot wound to the right arm.

“He sought help from us after the ambush,” Bongo said.

Further investigation is ongoing.

Indian troops, in their continued acts of state terrorism, martyred 16 Kashmiris, including a young boy and a woman, during the past month in the occupied Kashmir.

During the period, at least 366 people were injured due to the firing of bullets, pellets and teargas shells on peaceful protesters by Indian troops and police personnel.

Over 5,000 people, including Hurriyat leaders, Syed Ali Gilani, Mirwaiz Umar Farooq; Mian Qayoom, president of the Jammu and Kashmir High Court Bar Association; Mohammed Yasin Khan, chairman of the Kashmir Economic Alliance; Raja Muzaffar Butt, an anti-corruption crusader; National Conference leaders Omar Abdullah and Farooq Abdullah, PDP President Mehbooba Mufti, Engineer Rashid, activists and youth, were arrested.

Turkey: New Report: Mass Prosecution of Lawyers in Turkey

As 2019 Judicial Year starts on 1st of September tomorrow in Turkey. The Arrested Lawyers Initiative published a new report named Mass Prosecution of Lawyers in Turkey.

According to report, since 2016’s coup attempt, there has been a relentless campaign of arrests which has targeted fellow lawyers across the country. In 77 of Turkey’s 81 provinces, lawyers have been detained, prosecuted and convicted due to alleged terror-linked offenses. As of 1 September 2019, more than 1500 lawyers have been prosecuted and 599 lawyers arrested. So far, 321 lawyers have been sentenced to 2022 years in prison on the grounds of membership of an armed terrorism organization or of spreading terrorist propaganda.
