France: Justice : avocats et greffiers dans la rue contre la réforme judiciaire

Les avocats et les greffiers dénoncent la rapidité et le manque de concertation dans le projet de réforme de la Justice, que le gouvernement veut boucler très vite : alors que la proposition a commencé à être divulguée en octobre 2017, la Ministre Nicole Belloubet voudrait que tout soit bouclé d’ici la fin du mois de février 2018, pour une présentation au Conseil d’État en mars. Jeudi 15 février 2018, ils se rassembleront sur les marches des Palais de justice de toute la France.

Est-ce là le nouveau rythme auquel la justice va désormais devoir traiter ses dossiers ? Le projet de réforme de la Ministre Nicole Belloubet a été dévoilé en octobre 2017, et tout devrait être bouclé pour fin février 2018.

Une réforme en 5 volets

Le projet comporte plusieurs volets, dont la réforme de la procédure pénale, la numérisation des communications, ou encore la refonte de la carte judiciaire, tout cela mené au pas de charge, et sans réelle consultation, dénoncent avocats et greffier qui se réuniront sur les marches des 114 Tribunaux de Grande Instance de France jeudi 15 février 2018, pour signifier leur désaccord sur la méthode.

Kenya/Canada: Judge directs government to respond to Miguna suit within two days

The Government has been given two days to respond to an application by lawyer Miguna Miguna who is seeking to be returned to Kenya from Canada.

Justice Chacha Mwita issued the order as lawyers representing the Opposition politician said he wanted to come back to face his accusers in person.

“Miguna wants to come back and prosecute the case against the violation of his rights in person. It is only desirable that the court orders his return to square it out face to face in court with those who have mistreated him,” said John Khaminwa.

Mr Mwita said the case was urgent and that he needed to hear why the Government deported Miguna despite an order to have him presented in court.

The dispute is whether the State can deport Miguna and declare him an unwanted person when he is a Kenyan citizen, and whether he was given a fair hearing.

“That is why it is only fair to hear what the respondents have to say before I make any decision on Friday,” said Mwita.

Lawyers Waikwa Wanyoike, Apollo Mboya, Nelson Havi and Khaminwa wanted the judge to order the Government to return Miguna, arguing his deportation was unlawful.

Turkey: “I felt violated by Gülenists” – purged judge

A former head of Turkey’s Supreme Board of Judges and Prosecutors, Ahmet Hamsici, has stated that the Turkish judiciary had an “unspoken pact” with followers of the Turkish Islamist cleric Fethullah Gülen, which was broken when the Gülenists staged the July 2016 coup attempt, the Turkish news site Haber7 reported on Monday.

Hamsici was arrested shortly after the coup attempt, and was released pending trial after confessing that Gülen’s organisation had a hold over the judiciary that allowed them to convict hundreds of their opponents, often based on forged evidence.

“We had a secret agreement with the (Gülen) community’s leaders, and the coup had no place in it. They broke that agreement,” Haber7 quoted Hamsici as saying. “I confessed because I felt I had been tricked, even violated, by them.”

Thousands of personnel in the judiciary and security services have been purged, with many of them facing trial on terrorism charges, since the failed coup attempt.
