ADALET NÖBETİ SUSTURULAMAZ!
44 haftadır her Perşembe günü Çağlayan Adliyesi’nde tutulan Adalet Nöbeti’nin katılımcısı ve sözcülerinden avukat Kemal Aytaç hakkında İstanbul Cumhuriyet Başsavcılığı tarafından gözaltı kararı verilmiştir.
01.02.2018 günü saat 01.30 civarında Kemal Aytaç’ın evine giden polisler, meslektaşımızın evde olmaması nedeniyle gözaltı işlemi yapamamış ve tutanak tutarak evden ayrılmışlardır.
Gözaltı işlemi yapmaya gelen polisler, soruşturma dosyasında gizlilik kararı bulunması nedeniyle gözaltı kararının gerekçesine dair bir bilgilendirme yapmamıştır. Ancak tutanaktan görüldüğü kadarıyla gözaltı kararının aynı gün 44 üncüsü tutulan Adalet Nöbetine ilişkin olduğu anlaşılmaktadır. 44 üncü Adalet Nöbeti’nde, Türk Tabipleri Birliği’nin (TTB) “savaşın doğada ve insanda tahribat yapan, toplumsal yaşamı tehdit eden, insan eliyle yaratılan bir halk sağlığı sorunu olduğu”na dair basın açıklaması, Kemal Aytaç’ın da arasında olduğu avukatlar tarafından yüksek sesle okunmuştu.
Bilindiği üzere bu basın açıklamasının ardından TTB’nin Merkez Konseyi üyesi 11 hekim gözaltına alınmış, gözaltı kararını ve hekimlere yönelik operasyonları protesto eden, TTB’ye destek veren kişi ve kurumlara yönelik operasyonlar başlatılmıştı.
Avukat Kemal Aytaç hakkında verilen gözaltı kararının gerekçesini her ne kadar soruşturma dosyası üzerinde gizlilik kararı olması nedeniyle tam olarak bilmiyorsak da, TTB’ye destek amaçlı olarak okunan barış talepli bildiriye dair olduğunu tahmin edebiliyoruz. Her türlü haksız ve adaletsiz uygulama karşısında bugüne dek meslektaşlarının yanında olmaktan ve adalet talebini haykırmaktan geri durmayan Kemal Aytaç’ın nezdinde “adalet ve barış talebi” susturulmak, dayanışma engellenmek istenilmektedir.
Kemal Aytaç’ın avukatları bugün (02.02.2018) günü yakalama ve gözaltı işleminin kaldırılması için savcılığa bir itiraz dilekçesi vermek istemiş, ancak soruşturma dosyasının sistemde görünmediği gerekçesi ile itiraz dilekçesi verilememiştir. İtiraz dilekçesinde, Adalet Nöbetinde sarf edilen sözlerin düşünce ifade özgürlüğü kapsamında olduğu ve suç teşkil edemeyeceği, Kemal Aytaç’ın avukat olduğu ve savcılığın daveti üzerine ifade vermeye gidebileceği ve Avukatlık Kanununun gerektirdiği usulü işlemlerin yapılmadığı belirtmekteydi.
Avukat Kemal Aytaç, ifade vermek üzere 05.02.2018 tarihinde avukatlarıyla birlikte saat 10.00’da Çağlayan Adliyesi’nde olacaktır. Tüm meslektaşlarımızı Kemal Aytaç ile dayanışmak, Adalet Nöbetine sahip çıkmak için Çağlayan Adliyesine davet ediyoruz.

Russia: Environmental rights defender and lawyer Valentin Karelin physically attacked

On 30 January 2018, three unidentified, masked men physically attacked environmental rights defender Valentin Karelin in the vicinity of “Krylatskoe” metro station in Moscow.

On 30 January 2018, three unidentified men physically attacked environmental rights lawyer, Valentin Karelin, in the vicinity of “Krylatskoe” metro station in Moscow. He was attacked from behind, pushed to the ground and severely kicked in the head until a passerby intervened and attempted to pull the assailants off the defender. When the assailants fled the scene, the defender immediately called the police and reported the incident. The police opened a criminal investigation under Point “a” of Part 2 of Article 115 of the Criminal Code of the Russian Federation on deliberate attempts to inflict physical harm. Valentin Karelin sustained fractures to his head, the zygomatic bone, the nose, a paraorbital hematoma, concussion and other injuries.

This is the latest in a series of five recent attacks against human rights defenders in the Russian Federation.

Kenya: Doctor loses bid to bar LSK from murder hearing

The High Court yesterday dismissed an application to stop the Law Society of Kenya from participating in the murder case against Dr David Muchiri.

Muchiri is accused of killing Kenya Revenue Authority lawyer Jared Ratemo on July 11, last year at the Fig Tree Medical Centre in Ngara, Nairobi.

Muchiri, through lawyer John Khaminwa, wanted the LSK barred from participating in the case.

Justice James Wakiaga dismissed the application, saying it lacked merit. Wakiaga said the LSK has a right to be enjoined in the proceedings as an interested party.

Muchiri wanted LSK barred, saying it was not a victim in the case. The LSK has assigned lawyer Stephen Ongaro to take part in the case on it’s behalf.

Ongaro opposed Muchiri’s application, saying the matter before court was of public interest.

Obligado por el régimen cubano al exilio, el equipo del Centro de Información Legal (Cubalex) ha sufrido un “cambio radical y doloroso”. Sin embargo, reorganizado en EEUU, pretende continuar “la misma línea” de su proyecto: “elevar el récord de denuncia internacional contra el Estado cubano por la violación de los derechos humanos y visibilizar la situación del país”.

Su directora, Laritza Diversent, habla con DIARIO DE CUBA sobre algunos aspectos del trabajo de la organización, lo que ha dejado atrás, pero sobre todo acerca del porqué de las líneas establecidas y los procedimientos que utilizarán ante las nuevas circunstancias.

¿Cómo se ha reorganizado Cubalex en el exilio?

Cubalex se registró en el estado de Tennessee en los EEUU. Actualmente tenemos una Junta Directiva que gobierna la organización. El equipo, en el que me incluyo, trabaja online porque residimos en diferentes estados, la mayoría en Pennsylvania.

¿Qué ha representado para los miembros de Cubalex tener que abandonar la Isla?

Ha sido difícil aceptar que forzosamente tienes que iniciar una nueva vida, asumir nuevas costumbres, adaptarte a una nueva idiosincrasia. Se extraña todo, especialmente el aroma del café en la terraza donde nos reuníamos casi todas las mañanas para empezar nuestra labor, trabajar en un mismo espacio físico y atender personalmente a quienes nos visitaban en la oficina en Cuba. Hoy nos vemos a través de una pantalla. Ha sido un cambio radical, difícil y doloroso. No han faltado las lágrimas de nostalgia en cada uno de nosotros.

KP lawyers boycott courts to protest killing of colleague’s family members, medical student

The legal fraternity of Khyber Pakhtunkhwa province on Thursday boycotted courts to protest the brutal killing of family of a lawyer in a blast and murder of Asma Rani, the medical college student, after she refused a marriage proposal.

The lawyer community stayed away from court proceedings across the province. The lawyers observed the strike on the call of Khyber Pakhtunkhwa Bar Council.

Like other districts of the province, the lawyers in Peshawar also stayed away from courts. They demanded the provincial government to arrest the killers of the family of lawyer Gul Nawaz Khan Advocate killed in a landmine blast in Kurram Agency and Asma Rani. The lawyers also demand Shaheed Package for the family members of the lawyer in a terrorists attack.

Reportedly, the family of the lawyer was traveling from Muqbal area near the border to attend a funeral in Upper Kurram’s Basu area when their vehicle hit a landmine killing three women, two minor girls and three men on the spot. The car was destroyed in the blast.

In Peshawar, the lawyers leaders, including President of the PHC Bar Association, Arbab Usman, General Secretary Rahmanullah Khan, former joint secretary Kashif Jan and President of the Peshawar Bar Association, Fazl-e-Wahid condemned the brutal killing of the lawyer family and Asma Rani. They offered Fateha for the departed souls of the deceased persons.

Egypt: Appeal Court postpones appeal in foreign funding case

The court of appeal postponed on Thursday its review of the appeals submitted by 16 defendants in foreign funding case to April 5.

On Thursday, the court of appeals was scheduled to hear the first appeal hearings of 16 defendants out of 43 Egyptian and foreign workers who were sentenced in June 2013 with prison sentences between one and five years in the case No. 173, known as the foreign funding case.

The appeal was introduced by several human rights workers standing trial for the case of August 2017 at the State Council.

In this regard, the prosecution appeal provided the court of appeal an advisory opinion not to consider the appeal submitted by five defendants who were sentenced to two years in prison as they have not submitted themselves to the implementation of the judgment.

The case was internationally criticized, for example former U.S. secretary of state John Kerry expressed his concern over the case against NGOs in March 2016.

The case sentenced 43 defendants including 14 Egyptians and 29 American, European and Arab defendants who are charged of taking $60 million foreign funds of human rights organizations and NGOs working in Egypt without license to use it in banned activities and in violation of the states’ policy.

Also the renowned rights activist Hossam Bahgat is being investigated. He is a journalist and founder of the Egyptian Initiative for Personnel Rights (EIPR), as well as Gamal Eid, a lawyer and founder of the Arabic Network for Human Rights Information (ANHRI) as they are accused of receiving illegal funds for their NGOs.

They both have been banned from traveling and their assets were frozen along with the assets of Eid’s daughter and wife. The Cairo Criminal Court approved a freeze on their assets in September 2016.

Nigeria: Lawyer: Policemen called me prostitute, beat, detained me

The drama between a lawyer, Miss Chiamaka Nwangwu, and a Divisional Police Officer (DPO), Mrs. Jane Mbanefo, which started last week, is definitely not over.
If anything, more facts are crawling out as Nwangwu insisted that she was called several names, including being called a prostitute by Mbanefo and her men, before being beaten and then locked up in a police cell.
Mbanefo, however, countered Nwangwu, insisting that the lawyer was lying. She stressed that nobody touched the lawyer, let alone beat her.
Our correspondent gathered that the Nigerian Bar Association (NBA) has already stepped into the matter and is presently carrying out an investigation.
Nwangwu said she was beaten by policemen at 3-3 Police Station, Onitsha, Anambra State, after she went to see a client. She also alleged that the NBA Chairman, Onitsha branch, Ikenna Okwudili, pressurised her into writing an apology letter to Mbanefo.
“I didn’t want to write the letter of apology, because I didn’t see reason to do that. I was the one that was abused,” she fumed.
Recollecting how the drama started, the lawyer said she was called from Abuja by a family friend to see about getting a client, Chukwudi, out of police detention. Chukwudi was arrested over an issue with his landlord.
