Pakistan/Day of the Endangered Lawyer: Lawyers to observe strike on Monday

August 25, 2019

Day of the Endangered Lawyer

The lawyers on Saturday announced to observe a strike across the country on August 26 against the government references against judges, alleged harassment of legal fraternity and the Indian aggression in Kashmir.

The All Pakistan Lawyers Convention by Karachi Bar Association at the City Courts decided that the lawyers throughout the country as well as in Gilgit Baltistan and Azad Jammu and Kashmir will boycott courts on Monday and hold protest meetings at the bar rooms. A resolution was passed at the convention, saying the references against Supreme Court’s Justice Faez Isa and Sindh High Court’s Justice K.K. Agha were “frivolous, concocted and malafide” and are tantamount to an attempt to muzzle and subjugate the independence of the judiciary.

The lawyers demanded putting the petition filed by Justice Isa, the Pakistan Bar Council and the Supreme Court Bar Association against the references before a full court bench of the apex court for hearing by intelligible judges. Criticizing the Supreme Judicial Council, they said they deprecated the language used against Justice Isa in the SJC Order disposing of reference no. 427 of 2019 and added the neutrality and impartiality of the SJC has come into question.

The lawyers also criticized Peshawar High Court’s contempt of court notice to the PBC vice-chairman Syed Amjad Shah and condemned the alleged forced disappearance of former vice president of Multan High Court Bar Association Wasif Naveed Qureshi. They also condemned the announced and unannounced restrictions on the media against fair reporting and asked journalists, civil society and political parties to align against these attacks on the freedom of speech.

The lawyers in the resolution also condemned the barbaric acts of the Indian government in Kashmir and expressed their complete solidarity with the people of the occupied valley in their struggle for legitimate rights and aspirations.

The Punjab Bar Council strongly condemns the missing of Mr. YAFIS NAVEED HASHMI Adv. Multan from blue area Islamabad. It is very strange that despite registration of an FIR ,no coercive measures have so far been taken by the law enforcement agencies for the recovery of the aforementioned person. The Pb B C demands all the concerned authorities to take immediate action and adopt all measures for recovery of Yafis Naveed. In condemnation of the above, the lawyers of Punjab will observe a full day strike on 20.08.2019 and will not appear in courts.

Pakistan Bar Council (PBC) Thursday demanded the government to implement, in letter and spirit, Inquiry Commission report on Quetta tragic incidents, wherein 54 lawyers were martyred and many other got seriously injured. All Pakistan Lawyers Representatives Convention was held here on Thursday under the chairmanship of Syed Amjad Shah to discuss unfortunate and sad incidents of 8th August 2016 in Quetta. They said the enforcement agencies and concerned authorities till date failed to arrest culprits behind the incidents, and rather involved the author of the report, Justice Faez, in a baseless/false reference.

The PBC demanded immediate withdrawal of mala fide references against Justice Faez and Justice Agha, and requested the chairman Supreme Judicial Council (SJC) to exclude those members from the Council against whom references/complaints are still pending. It urged the chairman SJC to hear and decide those references which were filed with the Council earlier than the references against Justice Faez and Justice Agha.

The PBC demanded the chief justice of Pakistan to implement the decision of the Supreme Court regarding Faizabad Dharna (sit-in). The judiciary, SJC and Judicial Commission of Pakistan were urged to prevent interference of other institutions in their functioning and process of dispensation of justice and other functions assigned to them under the Constitution, while rendering decisions/judgments.

Day of the Endangered Lawyer

Pakistan/Day of the Endangered Lawyer: DAY OF THE ENDANGERED LAWYER – 24 January 2020 – PAKISTAN

Preparations are now well underway for the Day of the Endangered Lawyer (DOTEL) on Pakistan for January 24, 2020. At a preparatory meeting about 16 to 20 participants representing the Foundation of the Endangered Lawyers Day, AED, International Association of Peoples Lawyers, ELDH, CCBE, CBE, Institut des Droit de l’Homme, several Bar Associations, Avocats sans frontiers, Law Society, CNB have decided to dedicate the Day of the Endangered Lawyer to the solidarity with endangered lawyers in Pakistan.

Meanwhile, since our Brussels meeting our Pakistani colleagues continue to face chronic danger and a risk of serious harm.  They continue to be subjected to acts of violence, and very recently a lawyer was seriously assaulted by a judge during a trial, which led to a local strike („Black Day“) of lawyers lasting at least a week: https://defendlawyers.wordpress.com/2019/07/10/pakistan-day-of-the-endangered-lawyer-lawyers-strike-continues-for-sixth-consecutive-day/   At the national level there have been a number of strikes by lawyers, especially in solidarity with two judges who have been under attack by Pakistan President Arif Alvi.  The latest national strike organized by the Pakistan Bar Council was held on July 13th:   https://defendlawyers.wordpress.com/2019/07/10/pakistan-day-of-the-endangered-lawyer-pbc-gives-call-for-countrywide-strike-on-july-13/  Invidual lawyers, like high-profile lawyer Saif-ul-Malook who represented Asia Bibi (the famous woman who was on death row for blasphemy), continue to face a high risk of death or physical harm: https://defendlawyers.wordpress.com/2019/06/23/pakistan-day-of-the-endangered-lawyer-the-pakistani-lawyer-putting-his-life-on-the-line/.

Lawyers‘ Rights Watch Canada (LRWC) reports that they will  invite the Canadian Human Rights Museum in Winnipeg to host and finance an event on January 24th and to bring one or two lawyers from Pakistan. LRWC has started a paper on Pakistan focused on two needs: to effectively prevent and punish the murder of lawyers through protective measure and proper investigations, prosecutions and trials and second to develop pan Pakistan education to promote religious diversity and tolerance. They will also invite the Law Society of Ontario to hold an event.  As well, at the beginning of July the G7 Bars Meeting was held in France, with representatives of the Bars of France, Canada, Germany, USA, Japan, England & Wales and Italy, representing 1.8 million lawyers.  They adopted 20 proposals to G7 governments, including one: „Commit to support actions marking the Day of the Endangered Lawyer and to encourage other countries to do likewise.“  The New Zealand Law Society has the honour of publishing the first article about DOTEL 2020, which they did in mid-July: https://defendlawyers.wordpress.com/2019/07/18/pakistan-new-zealand-pakistan-the-focus-of-2020-day-of-endangered-lawyer/

Turkey/Day of the Endangered Lawyer: Trial against lawyer Can Tombul

December 13, 2018

On 12 December, Lawyers for Lawyers, Fair Trial Watch, Lawyers’ Rights Watch Canada, the European Democratic Lawyers and the Human Rights Committee of the Norwegian Bar Association called on the authorities of Turkey to immediately release lawyer Can Tombul.

Can Tombul works as a lawyer of the Law Bureau of the Oppressed (EHB). Together with his colleagues Mr. Tombul represents victims and family members of victims of the bombings / massacres in Ankara and Suruç in 2015. He has also been involved in documenting human rights violations in South-East Turkey.

Can Tombul was arrested on 31 July 2018 in Istanbul on charges of ‘membership of a terrorist organization’, and has been held in pre-trail detention ever since. The first hearing in his case was on 13 December 2018. We were informed that his case file contains information that directly relates to his work as a lawyer: regarding meetings with clients, telephone calls, twitter messages about cases and about human rights violations, demonstrations etc. Two funerals he attended in 2013 and 2015 are also cited as evidence of the charges against him.
