Turkey/UK/Scotland: Imprisoned Aberdeen University graduate shares letter of thanks

Imprisoned Aberdeen University graduate Hanifi Baris has written a letter of thanks to his supporters across the world.

Mr Baris, who graduated last year, has been confined in a Turkish jail since July, charged with “posting items of criminal content” on his social media accounts.

Turkish news outlet Bianet reported that the “content” was a news report about the Kurdistan Regional Government, and confirmed he had been charged with “propagandising for a terrorist organisation.”

In a letter addressed to friends and colleagues, dated September 11, he shared his thanks.

“[Your support] has been the greatest source of my strength and resilience in here,” Mr Baris wrote.

“Please forgive me for not being able to write to all of you separately, for the time I spend reading and answering your messages is very limited.

“I hope I will make it up to you when – hopefully not ‘if’ – I am out of here.”

Mr Baris had been scheduled to return to Aberdeeen last week as a key-note speaker in a conference at the university’s Centre for Citizenship, Civic Society and Rule of Law (CISRUL).

In his letter, he lamented the fact he was unable to participate or listen to “inspiring talks” from Aberdeen students.

CISRUL Director, Trevor Stack, said he was “very concerned” about Baris’s situation.

Turkey/Academics for Peace: Barış akademisyenine avukatlık da yasak

İhraç edilen barış akademisyeninin avukatlık yapabilmesi için Türkiye Barolar Birliği’nin aldığı kararın yürütmesi, Adalet Bakanlığı’nın başvurusu üzerine durduruldu.

Ankara 2. İdare Mahkemesi, “barış” bildirisine imza attığı için Dicle Üniversitesi’nden ihraç edilen akedemisyen Yasin Bedir’in avukatlık yapabilmesi için Türkiye Barolar Birliği (TBB) tarafından verilen kararının yürütmesini durdurdu. Mahkeme, Bedir’in avukatlık yapmasının “terörle mücadeleyi sekteye uğratacağını savundu. Dicle Üniversitesi’nde araştırma görevlisi olarak çalışan Bedir, barış bildirisine imza attığı gerekçesiyle ihraç edildi. Hakkında “terör örgütü propagandası” yapmak iddiasıyla soruşturma başlatılan Bedir, ihraç kararının ardından İstanbul Barosu’na kaydını gerçekleştirerek avukatlık yapmaya başladı. Ancak Adalet Bakanlığı , TBB’nin Bedir’in avukatlık yapabilmesine izin veren kararının yürütmesinin durdurulması istemiyle dava açtı. Ankara 2. İdare Mahkemesi, 3 Mayıs’ta verdiği kararla işlemin yürütmesini durdurdu. Baroların, kamu görevlilerinin bir daha kamu hizmeti yapamayacağına ilişkin KHK’yi “dar yorumlanması”na karşı çıkan mahkeme, “kamu hizmeti” içerisine avukatları da koydu. Mahkeme, kararında barış imzacısı olduğu için ihraç edilenlerin avukatlık yapmasının “terörle mücadeleyi sekteye uğratacağı gibi KHK’nin amacıyla da bağdaşmadığını” öne sürdü.

Açık düşmanlık

Karar sonrası toplanan İstanbul Barosu , Yasin Bedir’in adının baro levhasından silinmesine karar verdi. Mahkemenin kararına tepki gösteren Bedir, burada asıl eleştirilmesi gerekenin siyasi iktidar ve onun emrindeki yargı düzeni olduğunu belirterek, “Bu yapılan açık bir düşmanlıktır. Bizlere, Barış imzacılarına karşı düşman hukuku uygulanıyor. Bizlere adeta nefes aldırmamaya yeminli bir siyasi irade var karşımızda. Bize ağaç kabuğu yesinler diyorlar. Fakat onlara inat ne ağaç kabuğu yiyeceğiz ne de bu adaletsizliğe boyun eğeceğiz” diye konuştu.

N.B. A member of Academics for Peace, lawyer Yasin Bedir has had his lawyer’s practising certificate cancelled because of an investigation launched against him due to signing the Academics for Peace declaration.  Previously he was working at the Dicle law school (Diyarbakir) as a research assistant, but he was dismissed from his position because he signed the declaration. He then applied to the İstanbul Bar to become a practising lawyer. The Bar accepted his application and he received his praticising certificate. He worked as a lawyer about two months, and then the Department of Justice applied to court to cancel his certificate which was granted so he is now unable to work as a lawyer.

25 April | Istanbul|Lawyers Akın Atalay, Mustafa Kemal Gungor, and Bulent Utku were convicted of terrorism charges

Lawyers Akın Atalay and Mustafa Kemal Gungor, Bulent Utku who were chair and board members, and also lawyers of the Cumhuriyet Foundation and its enterprise Cumhuriyet daily were convicted of terrorism charges by Istanbul 27th High Assize Court.

At the end of the 18-month trial against journalists and executives of Cumhuriyet Foundation and its enterprise Cumhuriyet daily, 17 of 20 defendants including three lawyers were convicted of terrorism charges.

Akın Atalay who was chair of the Cumhuriyet Foundation, and also lawyer of Cumhuriyet daily and its several journalists was sentenced to seven years and three months.

Lawyers Mustafa Kemal Gungor and Bulent Utku were sentenced respectively three years and nine months, two years in prison.

25 April | Istanbul|Lawyer and Fox TV Anchor were sentenced to jail term.

Istanbul-Bakırkoy 17th Penal Court sentenced  lawyer Fidel Okan and journalist Ismail Kucukkaya 16 monts and 20 days in prison with the charge of humiliating the public servant.
