Nicaragua: Ortega Police Arrest Opposition Lawyer Jose Pallais

Under the orders of Daniel Ortega the Nicaraguan Police arrested the constitutional lawyer Jose Pallais, a member of the National Coalition, at noon on Wednesday. The Police continue with the persecution, harassment, and arrest of opposition leaders in Nicaragua. The arrest occurred after hours of police siege that, in addition, ended with the raid on the opponent’s home located in the city of Leon, in the west of the country.

The officers stormed into Pallais’ home minutes after the news of the imposition of sanctions by the United States Department of the Treasury on four Ortega officials became known and a day after opposition presidential candidates Juan Sebastian Chamorro, Felix Maradiaga, and opposition leaders Jose Adan Aguerri and Violeta Granera were arrested.  Also arrested in the previous days were candidates Cristiana Chamorro and Arturo Cruz.

The Police justified the arrest by claiming that Pallais “was under investigation,” in accordance with article 1 of Law No. 1055 Law in Defense of the Rights of the People to Independence, Sovereignty, and Self-Determination for Peace, for “carrying out acts that undermine independence, sovereignty and self-determination; incite foreign interference in internal affairs; request military interventions; organize with financing from foreign power to carry out acts of terrorism and destabilization; propose and manage economic, commercial and operational blockades against the country and its institutions; demand, exalt and applaud the imposition of sanctions against the State of Nicaragua and its citizens; and harm the supreme interests of the nation.” These are the same motives that the Police used to justify other arrests in the last hours.

When confirming the arrest, the Police released photos of Dr. Pallais with Leon’s police chief, Fidel Dominguez.

Hours before being arrested, the lawyer reported that a group of paramilitaries had surrounded his home since Tuesday night, when the arrest of Juan Sebastian Chamorro, Aguerri and Granera occurred, and on several occasions threatened to enter the house.

South Africa: Senior advocate deems attack on him ‘a hit’

A senior advocate at the Johannesburg bar narrowly escaped with his life after two men assaulted him while he spent the night at Klipspringer Lodge on the Uitkyk Road.

The advocate, Leon Halgryn, told Lowvelder that the attack was not a robbery, but a hit. “I am very lucky and very thankful to be alive,” said Halgryn.

“There were two men who attacked me. Their intention was not to rob me, but to kill me. This was a hit.”

Halgryn said all the windows of his vehicle had been shot out by the attackers during the attempted hit.

The revered advocate was in Mbombela for a court case and had been staying overnight at Klipspringer before travelling back to Johannesburg on Wednesday.

He phoned the lawyer who was briefing him in the case after the incident had occurred.

Il diritto di difesa è un diritto fondamentale che gli avvocati, tramite la loro attività, promuovono insieme agli altri diritti e libertà. Pur tuttavia, non è sempre scontato, né rispettato: in troppe occasioni, infatti, nostre Colleghe e Colleghi sono ostacolati, perseguitati o minacciati, addirittura uccisi, solo perché svolgono il loro dovere.

Gli avvocati in pericolo sono spesso isolati, abbandonati. Ricevere un supporto, sia di tipo morale che materiale, da parte della società civile ed in particolare dai Colleghi, dà loro la forza di proseguire nelle loro battaglie.

L’Unione delle Camere Penali Italiane ha da sempre dimostrato una forte sensibilità e solidarietà nei confronti dei colleghi perseguitati, in particolare attraverso l’attività dell’Osservatorio Avvocati Minacciati e dell’Osservatorio Europa.

L’impegno verso gli avvocati e gli human rights defenders in pericolo si è già concretizzato in numerose iniziative, tra le quali:

l’interlocuzione col Relatore Speciale delle Nazioni Unite sulla situazione dei difensori dei diritti umani;
la partecipazione a fact finding missions e alle udienze nei confronti di Colleghe e Colleghi ingiustamente processati a causa del libero esercizio della professione;
la partecipazione ai network nazionali ed internazionali in difesa degli avvocati e degli human rights defenders in pericolo;
l’organizzazione di eventi su tutto il territorio nazionale, in particolare, in occasione della Giornata Internazionale degli Avvocati Minacciati (24 gennaio);
la stesura di comunicati in supporto di colleghi in pericolo, anche in sinergia con ordini ed associazioni forensi internazionali, ed in occasione di eventi e celebrazioni di risalto nazionale ed internazionale.

È dal desiderio di essere al fianco dei difensori in pericolo in modo ancor più fattivo, che l’Unione delle Camere Penali Italiane si fa promotrice dell’iniziativa “Adopt an Endangered Lawyer/ Adotta un avvocat@ minacciat@”, coordinata dagli Avv.ti Federico Cappelletti, Nicola Canestrini, Ezio Menzione e Giorgia Cigalla.
