India: ‘Divided’ Jammu Bar suspends 2 eminent lawyers for supporting Article 35-A

August 1, 2019

Jammu Bar Association on Thursday suspended two eminent lawyers from basic membership and issued show cause notices to them, after they demanded strengthening of Article 35-A which has lead to division among the lawyers with regard to special status of Jammu and Kashmir.

Many lawyers who spoke to Greater Kashmir have threatened en-masse resignation from the Jammu Bar in support of suspended senior lawyers, while terming the decision as inspired by a political party’s agenda.

Two days back, around 150 advocates including senior, youth and female lawyers assembled in Jammu and Kashmir High Court complex to discussed attempts being to revoke special status of J&K. During the meeting, constitutional experts like former Jammu Bar Association president Advocate AV Gupta and former AAG, Advocate SC Gupta, spoke in support of Article 370 and 35-A. They appealed that the special status must be “retained and strengthened.”

After the executive committee meeting, Abhinav Sharma told journalists that all the members of Executive Committee of Jammu Bar have unanimously decided to suspend two lawyers including former Jammu Bar president Adv AV Gupta and former senior AAG Adv SC Gupta from the basic membership and they have been asked to explain their position.

USA/Ecuador: Donziger Facing Prosecution in Chevron Saga

August 1, 2019

Steven Donziger is going to have his day in court, again — this time as a criminal defendant.

Donziger, the lawyer, Obama buddy, and climate activist who tried to extort a few billion dollars from Chevron, is the target of an order from district judge Lewis Kaplan, who has on his own authority appointed three lawyers to prosecute Donziger on criminal contempt charges.

Donziger’s shakedown was, by my reckoning, the largest extortion attempt in human history, and the case involved everybody from activist rock stars such as Roger Waters to Democratic operatives such as Karen Hinton, sometime contributor to Politico and the Huffington Post

From Judge Kaplan’s original ruling:

Iran: A Young Attorney And Rights Defender In Iran Sentenced To 30 Years

August 1, 2019

An “Islamic Revolutionary Court” in Tehran has upheld a thirty-year sentence against a prominent Iranian lawyer and defender of human rights.

A member of the Iranian Bar association and defender of several political activists, Amirsalar Davoudi, was initially sentenced to thirty years last June. He refused to appeal, and the sentence was automatically upheld on Tuesday, July 30.

“Fifteen years of the sentence is obligatory and implementable,” Davoudi’s fellow attorney, Mostafa Tork Hamadani twitted a day later, reiterating,”We will do everything possible under the law, to urge the head of the Judiciary and Tehran’s Attorney General to cancel this verdict.”

Furthermore, Davoudi has been sentenced to 111 lashes, 60 million Rials (approximately $1410) court fine and deprivation of his social rights for two years.

Amirsalar Davoudi was initially convicted by an “Islamic revolutionary court” for “propaganda against the state” and “insulting officials”.

According to his lawyer Vahid Farahani, Davoudi was also accused of “collaborating with an enemy state” after giving an interview to Voice of America Persian-language television.
