India: FIR against Lawyers’ Collective a ‘witch-hunt’ against outspoken human rights defenders

In a statement, Ravi Kiran Jain* and Dr V Suresh** of the People’s Union for Civil Liberties (PUCL) have said the CBI’s FIR against the Lawyers’ Collective and senior advocate Anand Grover is an undisguised attempt to silence not just the top human rights organization but is also meant to “serve as a lesson to all others who dare to challenge the Central Government.”
Calling the FIR “motivated, vengeful and vituperative act”, PUCL said the Lawyers’ Collective, which has for 38 years of its existence has taken up cases related with domestic violence, human rights, labour and womens’ rights, adding, among the important ones are the “Naz case on rights of the LGBTQ community, the Novartis case, the Sabarimala case, the triple talaaq case and the Sohrabuddin case, in which current Home Minister and BJP leader Amit Shah was involved.”
Demanding immediate withdrawal of the FIR, PUCL said, “The case lodged against the organization smacks of vendetta for its exceptional work on securing rights for the marginalized. It is ill-conceived, vindictive, politically motivated and designed to have a chilling effect on all those who raise a voice of dissent.”

India: Attack on Bar members: City lawyers abstain from court work

Members of the Bhubaneswar Bar Association Thursday abstained from court work in protest against the alleged failure of the police in arresting unidentified miscreants who have been accused of assaulting two lawyers Wednesday morning near an apartment at Jharpada here.

The victim lawyers identified as Md Alam and Umakanta Tandi sustained varying degrees of injuries in the attack. Alam Thursday underwent surgery on his fractured leg.

According to sources, advocate Tandi, who has landed property at the Mahadev Nagar in Jharpda, along with an amin had reportedly gone to the spot Wednesday for measurement of the plot. Md Alam, a friend of Tandi, was also present at the place during the measurement.

It is said that Tandi has an old dispute with the owner of the adjacent plot. When Tandi reached the spot a heated argument ensued between the lawyer and the family members of the adjacent plot over the measurement issue. Later, the argument turned violent and the owner of the adjacent plot along with some locals attacked Tandi and Md Alam with bamboo sticks and other sharp weapons.

As the news about the incident spread, the lawyers’ fraternity reached the spot and lodged a complaint with the Laxmisagar police in this regard. Police have initiated a probe into the incident after registering a case (163/19).

The American Bar Association announced today that it will honor Saudi lawyer Waleed Abu al-Khair with its 2019 ABA International Human Rights Award in recognition of his work to advance human rights and advocate for justice in the Kingdom of Saudi Arabia. The award will be presented during a dinner at the ABA Annual Meeting in San Francisco, August 8, 7:30 p.m. at the Westin St. Francis Hotel.

The International Human Rights Award was established to honor and give public recognition to a lawyer, human rights luminary or international human rights organization that has made an exceptional contribution to the advancement of human rights outside of the United States. The award is given on behalf of the ABA Center for Human RightsSection of International LawSection of Civil Rights and Social JusticeSection of Litigation and Rule of Law Initiative.

Abu al-Khair is the founder of Monitor for Human Rights, one of only a few human rights organizations in Saudi Arabia, which he established in 2008, just a year after he began practicing law. As an attorney, Abu al-Khair dedicated his career to defending human rights and the right to freedom of expression, even after government authorities banned him in 2009 from representing specific defendants in courts. Abu al-Khair also used his legal background to advocate for an elected parliament, independent judiciary and other democratic reforms in Saudi Arabia.

Nasrin Sotoudeh is a human rights lawyer who has represented imprisoned Iranian opposition activists and politicians following the disputed June 2009 Iranian presidential elections as well as prisoners sentenced to death for crimes committed when they were minors. Sotoudeh was arrested in September 2010 on charges of spreading propaganda and conspiring to harm state security and was imprisoned in solitary confinement in Evin Prison. In January 2011, Iranian authorities sentenced Sotoudeh to 11 years in prison, in addition to barring her from practicing law and from leaving the country for 20 years. An appeals court later reduced Sotoudeh's prison sentence to six years, and her ban from working as a lawyer to ten years. On 26 October 2012, Sotoudeh was announced as a co-winner of the Sakharov Prize of the European Parliament. She shared the award with Iranian film director Jafar Panahi. Sotoudeh was released on 18 September 2013 along with ten other political prisoners, including opposition leader Mohsen Aminzadeh, days before an address by Iranian President Hassan Rouhani to the United Nations. Cette avocate de 56 ans est aujourd’hui la prisonnière la plus célèbre de la République islamique. Son cas fait l’objet d’une mobilisation importante à l’étranger.


Elle a recopié sa sentence à la main. C’est la procédure dans les tribunaux révolutionnaires iraniens. La somme des peines donne le tournis : sept ans et six mois de prison pour « collusion en vue de nuire à la sécurité nationale », 74 coups de fouet pour être apparue sans voile en public, un an et six mois pour « acte de propagande contre l’Etat », sept ans et six mois pour « appartenance à un groupe illégal », trois ans et 74 autres coups de fouet pour diffusion de fausses informations, deux ans pour trouble à l’ordre public et douze ans pour avoir encouragé la « corruption » et la « dépravation ».

Cette dernière peine, la plus lourde, s’impose aux autres. Nasrin Sotoudeh, avocate et militante des droits humains, devra donc passer les douze prochaines années de sa vie entre les murs de la prison d’Evin, à Téhéran. Au risque d’en faire une martyre, la justice de son pays a résolu de faire disparaître cette quinquagénaire au visage pâle et osseux.

Pakistan/Day of the Endangered Lawyer: Over 70 traders booked for clashing with lawyers in Pakpattan

Police have registered an FIR of a clash between traders and lawyers over a parking dispute in Arifwala tehsil of Pakpattan district.

According to the police, more than 150 people have been booked under different provisions of Pakistan Penal Code (PPC) with Section 7 of the Anti Terrorism Act. The FIR was registered on the complaint of Advocate Riaz Hussain.

More than 77 traders and 70 unknown people have been named in the case.

Meanwhile, a complete strike is being observed at local courts across the district against yesterday’s incident which resulted in injuries to seven people.

The Pakpattan Bar Association had given a call for the strike following the dispute.

A clash had erupted between lawyers and shopkeepers in Arifwala over a parking dispute yesterday as the two sides used sticks, hurled stones and resorted to firing at each other.

The clash started after a lawyer was allegedly locked up inside a shop by shopkeepers for parking his bike outside their shop.

Upon being informed of the incident, a large number of members of the legal fraternity gathered on the spot. The situation took a turn for worse when the two sides engaged in a brawl, using sticks and hurling stones at each other.

Afterwards, a heavy contingent of police reached the site and lobbed tear gas shells on both the sides to disperse them.

Wakil Khan, who also worked as a reporter in a local evening daily, was targeted with a knife when he was going to court in the morning.

A lawyer on his way to court was assaulted by four persons over some personal enmity in the Sadar Bazar area here in Uttar Pradesh on Thursday, police said.

The assailants fled from the spot after passers-by raised alarm.

China: Chinese Human Rights Lawyer Becomes a Street Vendor After Regime Suspended His License

Chinese human rights lawyer Liu Xiaoyuan recently posted a picture of himself on Twitter selling pesticides on the street in Beijing. He also announced that he started a new business after his law firm’s license was suspended. His post may have embarrassed the Chinese authorities, as they notified him on the following day that his license to practice law was suspended.

In the picture, Liu sits on the curb, next to a small vending cart, holding a board that reads: “Fly glue trap, Cockroach killer, Rat glue trap.”

Liu wrote in his Twitter post: “I, Liu Xiaoyuan, a Beijing lawyer who has become unemployed through no fault of my own, will not rely on government social assistance programs or financial help from the Lawyer’s Association. Although I am over 50, I have decided to start my own business. I will make a living by selling poisons and devices that can eliminate the ‘four harms.’” “Four harms” is a Chinese term referring to four major types of insect pests.

A report from Radio Free Asia revealed that the Judicial Bureau of Chaoyang District in Beijing informed Liu on June 19, the day after he posted his street vendor picture on Twitter, that his law license had been suspended.
