Egypt: Arrests raise fears of fresh crackdown against peaceful critics

The arbitrary detention of labour rights lawyer, Haytham Mohamdeen, and former political activist, Mostafa Maher, this week has raised fears that the Egyptian authorities might be embarking on a fresh crackdown targeting peaceful dissent or individuals with history of activism, said Amnesty International.

“These latest arrests have reignited a climate of fear amongst independent activists and human rights organizations about a renewed assault by the Egyptian authorities on the right to freedom of expression and peaceful assembly,” said Magdalena Mughrabi, Deputy Middle East and North Africa Director at Amnesty International.

“The Egyptian authorities have an appalling record of arbitrarily detaining peaceful activists over unfounded charges for months and sometimes for years, without ever referring them to trial, before releasing them under harsh probation measures. Instead of stepping up their repression with a fresh round of arbitrary detentions, the authorities should stop harassing peaceful critics and ensure all those detained solely for peacefully exercising their rights to freedom of expression, association or assembly are immediately and unconditionally released.”

Amnesty International is calling on the Egyptian authorities to immediately and unconditionally release Mostafa Maher and Haytham Mohamdeen as their detention is arbitrary, and the charge against them is overly vague and has no credible basis. They appear to have been targeted solely because of their history of peaceful activism. The authorities also violated their fair trial rights during arrest, detention and questioning.

Background

On 13 May, Haytham Mohamdeen was summoned to Saf police station, in Giza governate, south of Cairo, after being wrongfully accused of violating his probation terms. When he went to the police station, the police arrested him and held him without access to his lawyer or family until 16 May. Haytham Mohamdeen had been under probation since his release on 30 October 2018 from five months of arbitrary  detention over trumped up charges of inciting peaceful protests against austerity measures.

France: Une avocate expulsée «manu militari» d’une salle d’audience

Une avocate en robe a été traînée de force par plusieurs policiers hors d’une salle d’audience du tribunal d’instance de Paris, jeudi 16 mai, sur ordre de la magistrate qui présidait l’audience. L’incident ne passe pas auprès des avocats.

L’affaire suscite une forte indignation. L’Ordre des avocats de Paris et l’Association des avocats pénalistes vont saisir sans délai le président du tribunal de grande instance de Paris, Jean-Michel Hayat. Jeudi, une avocate en robe a été expulsée manu militari d’une salle d’audience du tribunal d’instance de Paris par une demi-douzaine de policiers, selon des informations obtenues par Mediapart.

Traînée par les chevilles et les épaules, selon son récit écrit, Me Anna Salabi a obtenu le soir même d’un médecin une interruption de travail temporaire de deux jours pour des douleurs thoraciques, des douleurs au genou, et un traumatisme psychologique. Elle envisage de porter l’affaire devant le Conseil supérieur de la magistrature (CSM), compétent pour instruire les manquements disciplinaires et déontologiques des magistrats.

C’est lors d’une banale audience du tribunal d’instance, portant sur un dossier de saisies de rémunérations, que cet incident inédit a eu lieu, le 16 mai dans l’après-midi, au sixième étage du nouveau tribunal de Paris, porte de Clichy. Le point de départ est insignifiant.

La présidente du tribunal, Laurence Haiat, aurait reproché à Me Salabi d’avoir fait « non » de la tête pendant qu’elle parlait. Après un échange verbal assez tendu, la magistrate aurait décidé de reporter l’affaire, alors que l’avocate se plaignait de ne pas avoir eu la parole sur le dossier, et qu’aucune demande de report n’avait été déposée.

La présidente du tribunal a alors demandé à l’avocate de quitter la salle d’audience, ce que celle-ci a refusé, demandant une suspension pour faire venir un membre du Conseil de l’Ordre des avocats. Plusieurs policiers ont alors été appelés dans la salle à la demande de la présidente, et ont expulsé Me Salabi par la force, malgré ses protestations, et alors qu’elle était en train de téléphoner à l’Ordre des avocats.

Le Conseil de l’Ordre, en sa séance du 21 mai, a voté une motion de soutien à sa consoeur Anna Salabi :

“Le Conseil de l’Ordre condamne l’agression d’une avocate au sein du Tribunal de Paris. Ça suffit !

L’expulsion par la force d’un avocat en cours d’audience est intolérable.

Le 16 mai 2019, au Tribunal d’instance de Paris, une avocate, Madame Anna Salabi, a été évacuée de force de l’audience par six policiers, à la demande du magistrat, alors qu’elle était en ligne avec les membres du Conseil de l’Ordre de permanence, pour les saisir d’un incident qu’elle rencontrait.

Le Conseil de l’Ordre des avocats de Paris, révolté, condamne cette agression. L’usage de la force contre un avocat est inacceptable. Il rappelle que l’article 434-8 du Code pénal réprime tout acte d’intimidation commis envers un avocat dans l’exercice de ses fonctions.

Le Conseil de l’Ordre assure notre consœur de son entier soutien, et s’associera à toute procédure engagée devant le Conseil supérieur de la Magistrature, comme devant les juridictions répressives.

Il rappelle que tout différend entre un avocat et un magistrat doit être réglé en présence du Bâtonnier, dans la dignité et l’esprit de dialogue qui caractérisent leurs actions quotidiennes.”

Spain: Scholars at Risk concerned about prosecution of 4 academics and a lawyer

On October 25, 2018, a Court charged four professors, along with a lawyer, with “disobedience” and “usurpation of functions,” for accepting appointments to serve on an electoral commission for Catalonia’s independence referendum in September 2017. If convicted, they would face up to two years and nine months’ imprisonment.

On September 6, 2017, the Parliament of Catalonia passed the Law on the Referendum on Self-determination of Catalonia. Its passage required the establishment of an electoral commission that would oversee the referendum. The five commission members appointed included four academics — Jordi Matas and Marc Marsal, of Universitat de Barcelona; Tània Verge, of Universitat Pompeu Fabra; and Josep Pagès, of Universitat Autònoma de Barcelona — and lawyer Marta Alsina. All five accepted their appointments. Shortly thereafter, a public prosecutor charged the commission members with “disobedience,” “misappropriation of public funds,” and “usurpation of functions.”

Nearly two weeks before the referendum was scheduled to take place, the Spanish government challenged its legality. On September 20, the Spanish Constitutional Court issued a judgment imposing a 12,000 Euro daily fine to each member of the electoral commission until they resigned. They did so on September 22, one day before the fine would go into effect.

South Africa: Lawyers’ strike threatens to shut down courts countrywide

Lawyers being attacked by disgruntled legal aid clients because of a lack of security and monstrous workloads are just two of their grievances.

The wheels of justice could grind to a halt countrywide if a brewing national strike at Legal Aid SA is not averted, and workers’ grievances regarding a lack of security at their offices, debilitating workloads and bullying are not addressed.

Following years of fruitless engagements with management, aggrieved workers – including lawyers and support staff – fired the first salvo last year when they obtained a strike certificate from the Council for Conciliation, Mediation and Arbitration (CCMA).

As part of the picketing rules agreed upon with the employer building up to a full-blown strike, workers will today hold demonstrations at the public legal agency’s Braamfontein offices.

The agency yesterday confirmed that chief executive officer Vidhu Vedalankar will accept a memorandum of grievances from the workers, with timeframes for a response.

Legal Aid SA provides legal services in criminal and civil matters for those earning between below R8,000, and receives funding from parliament. The agency has 64 local offices, six provincial offices, and one national office.

According to its annual report, the vast majority of cases it handled were criminal cases at 371 202 (87%), compared to 55 794 (13%) in the previous financial year.

UK: WhatsApp hackers targeted London lawyer

A UK lawyer has vowed to “persist” after being targeted by not one, but two shady intelligence organisations.

The London-based human rights lawyer, who asked not to be named, is involved in a US lawsuit against NSO Group, an Israeli surveillance company whose clients have allegedly used its software to hack the phones of Mexican journalists and a Saudi dissident associated with the murdered journalist Jamal Khashoggi.

Its advanced malware, known as Pegasus, was recently revealed to be capable of giving the user access to a target’s phone simply by ringing them over WhatsApp. It was effective even if the target didn’t answer the call.

“WhatsApp video calls could be used to deliver the payload of Pegasus”, the lawyer told RollOnFriday, “and there were attempts to do this against my phone.”

“Who exactly it is, is not clear”, he said, only that they were “actors who use this technology and think they can benefit from accessing my data”. He discounted the possibility a rival employer was using unorthodox methods to poach him. “I think they have much nicer ways of doing that”, he said.

The lawyer said he has not just faced attempts to hack his phone. “Before that, there were attempts by Black Cube”, he revealed, referring to the Israeli intelligence group which became infamous for attempting to entrap Harvey Weinstein’s accusers on the disgraced movie mogul’s behalf.

Iran: Proposed law restricting access to lawyer would be crushing blow for justice

A contemptible amendment to Iran’s code of criminal procedure could effectively strip detainees who are facing punishments such as the death penalty, life imprisonment and amputation, of the right to access a lawyer while they are under investigation, said Amnesty International.

An analysis of the bill published by the organization today details how, if passed, the amended law would permit the prosecution to immediately deprive individuals arrested on “national security” and certain other serious criminal charges of access to a lawyer for 20 days, which could be extended to cover the whole investigation phase. In Iran, those charged with “national security” offences include human rights defenders, journalists and political dissidents targeted solely for the peaceful exercise of their human rights.

“This is a regressive piece of draft legislation which would effectively remove the right to a lawyer in a wide range of criminal investigations and contravene Iran’s obligations under international law. If passed by MPs it would be a crushing blow to Iran’s already deeply defective justice system and could further consolidate patterns of torture and other ill-treatment against detainees to extract forced confessions during interrogations,” said Philip Luther, Research and Advocacy Director for the Middle East and North Africa at ‎Amnesty International.

“Denial of prompt access to a lawyer is a serious violation of the right to a fair trial in all circumstances, but it is particularly shocking in cases where individuals are at risk of being sentenced to severe or irreversible punishments such as execution, amputation and life imprisonment.”
