Les avocats manifestent ce mercredi dans plusieurs wilayas du pays contre le régime en place.

Une centaine de magistrats ont manifesté samedi dernier devant le ministère de la Justice à Alger afin d’exprimer leur refus de superviser l’élection présidentielle prévue le 4 juillet prochain.

UK: Leading climate lawyer arrested after gluing herself to Shell headquarters

Breaking the law has become more important than making the law, said Farhana Yamin, who charged through a police cordon outside the oil company on Tuesday

After decades working inside the law, international climate lawyer and diplomat Farhana Yamin charged through a police line, dived under the arms of an officer and superglued her hands to the pavement outside the London headquarters of oil company Shell.

Her action, which took place on Tuesday, was part of a rolling set of protests taking place across London and the world under the Extinction Rebellion banner. She later joined a growing tally of activists to be arrested.

Yamin is a legal expert who has advised various developing countries in climate negotiations and is an associate fellow at Chatham House. On Tuesday, she told Climate Home News that the Paris Agreement, which she helped negotiate in 2015, was “not delivering”.

“I thought that was my story,” she said. “I thought that the law and science and speaking truth to power worked. That we would be able to act with kindness and in time and on the basis of the precautionary principle and all these lovely ideas that we enshrined in law in the early 80s and 90s.

29-year-old purge-victim lawyer commits suicide in Turkey’s Zonguldak: report

 

Emir Said İnam, a Turkish lawyer from Zonguldak’s Devrek district, killed himself at his home April 16, Turkish police said.

According to the Cumhuriyet daily, his family members called for an ambulance and  he was taken to hospital where he was later pronounced dead.

İnam’s father was a purge-victim teacher as he was dismissed from his job with a decree issued by the Turkish government after a coup attempt on July 15, 2016. The family was often subject to mistreatment and harasment over their alleged links to Turkey’s Gulen movement.

Turkish government accuses Gulen movement of masterminding the July 15, 2016 failed coup while the latter denies involvement. More than 150,000 people have been detained and 90,000 arrested over Gulen links since the summer of 2016.

Turkey: Eighteen Lawyers from People’s Law Office sentenced to between three and 18 years in prison

On 18, 19 and 20 March 2019, three hearings were held in the Istanbul 37th High Criminal Court in the case of 20 lawyers from the People’s Law Office, six of them currently in detention. Eighteen human rights lawyers were prosecuted on terrorism-related charges and sentenced to between three and 18 years in prison. The cases of the remaining two human rights lawyers, Oya Aslan and Günay Dağ, remain open due to their absence from all three hearings.

On 18 March 2019, the Chief Justice opened the hearing by stating that the judges would hear the final statements of the defendants and announce the final verdict thereafter. The defence of the human rights lawyers objected by arguing that the case had not yet arrived at the defence phase. The defence further argued that according to the interim decision made by the court on 7 December 2018, the defendants had been given time until the hearing which was scheduled for 18 March 2019 to submit their demands regarding an extension to the scope of the prosecution as well as their responses to the statements made by the witnesses. The court initially rejected these objections, stating that they constituted an attempt at prolonging the legal proceedings. However, the defence lawyers insisted that they had the right to raise all issues related to the accusations during the hearings as well as to discuss their requests submitted to the court between the two hearings. Further, they argued that the court was obliged to at least hear all their requests and statements before pronouncing the final judgement. In reaction to the insistence of the lawyers, the court allowed them to respond to the statements made by the witnesses, and then changed its decision again in the middle of the hearing to only allow for a discussion on the requests regarding the extension of the prosecution. While the defence lawyers drew attention to the irregularities in the legal proceedings and the importance of impartiality and fair trial standards, they received warnings from the court for “objecting to court decisions”, “using accusatory language towards the judges” and “speaking without permission”. The court closed the hearing by announcing that there was nothing left to discuss regarding the accusations, and asked the defendants to prepare their defence for the next day.

Honduras: Asesinan a un abogado en la colonia capitalina Kennedy

Un abogado fue asesinado de varios impactos de bala la tarde de este martes en la colonia Kennedy de la capital.

La victima es Jairo Samuel Medina (37), a quien algunos testigos lo identificaron como secretario de la junta directiva del patronato de la colonia La Vega y que también laboraba el departamento legal de la Secretaría de Trabajo.

De acuerdo a información preliminar, el profesional del derecho fue atacado por desconocidos, mientras reparaba su vehículo en un taller automotriz de la populosa colonia Kennedy.

Hasta el lugar del hecho se trasladó personal de medicina forense para el levantamiento del cadáver.

Este el segundo asesinato que se registra en menos de una semana, ya que el viernes anterior la abogada Ana Lourdes Arriaga y su cuñado fueron asesinados de varios impactos de bala en San Pedro Sula.

Cabe recordar, que la profesional del derecho fue la apoderada legal de los hondureños extraditados en EE.UU. por narcotráfico, Carlos Arnaldo Negro Lobo y Neptalí Duarte Mejía.

USA/Ecuador/Canada/The Netherlands: Dutch Supreme Court Rules for Chevron in Ecuador Dispute

The Supreme Court of the Netherlands has ruled in favor of Chevron Corporation, rejecting the Republic of Ecuador’s attempts to annul decisions of an international arbitral tribunal in The Hague that ordered Ecuador to take all steps necessary to prevent enforcement of a $9.5 billion Ecuadorian judgment against Chevron anywhere in the world. The Ecuadorian judgment previously was found by the international arbitral tribunal and by U.S. courts to have been obtained through fraud, bribery and corruption.

The arbitral tribunal, administered by the Permanent Court of Arbitration in The Hague, issued interim and partial awards in favor of Chevron in 2012 and 2013 in proceedings brought by Chevron to hold the Republic of Ecuador accountable for the fraudulent and corrupt litigation against the company in that country. The arbitral awards ordered the Republic of Ecuador “to take all measures necessary to suspend or cause to be suspended the enforcement and recognition within and without Ecuador” of the fraudulent Ecuadorian judgment against Chevron. The decision by the Supreme Court of the Netherlands upholds the rulings of two Dutch lower courts that rejected the Republic of Ecuador’s attempts to annul those awards.

“The highest court in the Netherlands confirmed that Ecuador is required under international law to prevent enforcement of the corrupt Ecuadorian judgment against Chevron anywhere in the world,” said R. Hewitt Pate, Chevron’s vice president and general counsel. “The Dutch Supreme Court joins the courts of the United States, Argentina, Brazil, and Gibraltar in rejecting the Ecuadorian fraud against Chevron. Chevron urges Ecuador to honor its obligations under international law, comply with the lawful orders of The Hague tribunal and put an end to the fraud and extortion against Chevron.”

These failed efforts to enforce the Ecuadorian judgment were led by adjudicated racketeer and suspended lawyer Steven Donziger. In 2018, Donziger was suspended from practicing law in New York State and Washington, D.C. after having been found by U.S. federal courts to have engaged in a longstanding pattern of racketeering activity in procuring the Ecuadorian judgment, including multiple acts of fraud, bribery and judicial corruption.
