In sommige landen worden advocaten bedreigd en geïntimideerd door de overheid, louter omdat zij mensen bijstaan die als ‘vijanden van de staat’ worden bestempeld. De afgelopen jaren zijn in Turkije om die reden honderden advocaten gearresteerd en vervolgd. Lawyers for Lawyers woont al sinds 2011 zittingen bij in een groot aantal van deze zaken.

De prominente Turkse mensenrechtenadvocaat Ramazan Demir ondervindt dagelijks de gevolgen van de afbraak van de Turkse rechtsstaat, maar blijft standvastig zijn werk doen. Mede daarom ontving hij in 2017 de Human Rights Award van de International Bar Association (IBA). “Deze erkenning”, zo zei hij over de eervolle prijs, “is genoeg om de wolken te verdrijven en de lucht weer even blauw te maken”.

Op uitnodiging van Lawyers for Lawyers en het Amsterdam Center on the Legal Professions zal Ramazan Demir op de Dag van de Bedreigde Advocaat, donderdag 24 januari a.s., een lezing geven (voertaal Engels). Hij zal uit de eerste hand bespreken hoe de Turkse autoriteiten rechtsbijstand in politieke- en mensenrechtenzaken vrijwel onmogelijk maken en aan welke risico’s advocaten blootstaan.

Nigeria/USA: US Congress Queries FG Harassment Of Atiku, Obi, Falana

The subcommittee of the US Congress for Africa, Human Rights, Global Health and International Organizations has queried the US government on its responses to reports of repression of opponents by the government of Nigeria.

During the hearing on Nigeria entitled, “Nigeria at a Crossroads: The Upcoming Elections” held on December 13, 2018, the Chairman Representative Chris Smith cited reports in the Vanguard and PREMIUM TIMES pertaining to reported freezing of Gov Peter Obi’s bank accounts as well as a raid on VP Atiku’s sons. Both men are leading opposition challengers to General Buhari.

Specifically Chairman Chris Smith informed the top diplomat for Africa, Assistant Secretary of State Ambassador Tobir Nagy, that the subcommittee was in possession of a memo by the Nigerian embassy targeting a human rights lawyer for testifying before them. Concerned at the apparent repression of “opponents” of the Buhari regime, the Chairman asked the representative of the Trump administration whether the US government was engaged with Nigeria on these violations of citizens’ rights just for holding “contrary” views.

The Assistant Secretary of State for Africa responded that the US embassy in Nigeria was quite “concerned” and robustly engaged on such rights violations and election malpractice as just witnessed in Osun State and gave kudos to US ambassador Symmington whom he was impressed with during his recent visit to Nigeria last month.

Following the hearing, Washington-based Nigerian human rights lawyer Emmanuel Ogebe, who was the target of the Nigerian embassy referenced by the Chairman, submitted a letter to the State Department attaching the incriminating exhibit indicting the Nigerian embassy in Washington of attempting to subvert the US Congress by witness intimidation and retaliation.

In the letter he called for the revocation of the diplomatic immunity of the Nigerian diplomats involved in threatening his passport and their prosecution by the US government for violations of American law.

Iran: Law Student Begins Six-Month Prison Term for Social Media Posts Critical of State Policy

In a continuing assault on freedom of speech—particularly the peaceful expression of views critical of state policy—the law student and civil rights activist Amir Chamani was taken from his place of work and transferred to Tabriz Central Prison in northwest Iran on December 17, 2018, after the Appeals Court upheld his six-month prison sentence for posts on social media about political and economic issues, his lawyer told the Center for Human Rights in Iran (CHRI).

“Yes, it’s true he has been taken into custody,” attorney Abbas Jamali said on December 19. “My client was detained without my knowledge and taken to Tabriz prison in connection with the six-month sentence he received following his arrest in late May 2018. He was also charged with ‘insulting the Supreme Leader,’ for which he was fortunately not found guilty, but the Appeals Court upheld the sentence [for ‘propaganda against the state’] despite our objection.”

A law student at Payame Noor University in Tabriz, Chamani specializes in social and political issues. He had an active presence on social media through his FacebookTwitter and Instagram accounts and regularly commented on current affairs with a critical eye, particularly about labor and human rights issues.

The preliminary sentence against him was issued on September 1, 2018 by Branch 1 of the Revolutionary Court in Tabriz presided by Judge Rahim Hamlbar, whose name is on a UK sanctions list for issuing harsh sentences against numerous peaceful activists in Iran’s East Azerbaijan Province.

The same judge had previously sentenced Chamani to nine months in prison for “propaganda against the state” and “insulting the Supreme Leader,” which the activist served in Tabriz Central Prison until his release on October 3, 2013.

Turkey: Avukatlara bilgi vermeyen İstanbul Emniyeti, gözaltında işkence gören iki kişiyle ilgili AKP medyasına ‘bilgi’ verdi!

İstanbul Emniyeti, 16 Aralık günü Ataşehir’den işkenceyle gözaltına alınan iki kişinin avukatına bilgi vermezken gizlilik kararı olduğu iddia edilen dosyayla ilgili havuz medyasına bilgi verdi

16 Aralık günü, İstanbul Ataşehir’de sokak ortasında darp edilerek gözaltına alınan Birgül Mızrak ve Göksel Dillibal’ın ne ile suçlandığı halen bilinmezken, savcılık avukatlara vermediği bilgiyi havuz medyasına verdi. Dosyada gizlilik kararı olduğunu belirten avukatlar, Mızrak ve Dillibal’a İstanbul Emniyeti’nde işkence yapıldığını duyurmuşlardı.

İstanbul Emniyeti’nin basına gönderdiği fotoğraflarda da darp edildikleri belli olan Dillibal ile Mızrak, 4 günlük gözaltı sürelerinin sonunda, Çağlayan’da bulunan İstanbul Adliyesi’ne götürülerek, ek gözaltı süresi için savcılık karşısına çıkartıldılar. Burada da avukatlarıyla görüşmeleri engellenen iki kişinin sağlık durumu tam olarak bilinmiyor.

Dosyada gizlilik kararı

Avukatların, sorgu sırasında içeride olması gerekirken, hâkim sorgusu sırasında salonda bulunan TEM polisleri tarafından darp edilerek salondan çıkartılmaları ve Mızrak ile Dillibal’ın ek gözaltı süresi verilerek İstanbul Emniyeti’ne götürülmeleri ailelerinde endişe yarattı.

Dosyada gizlilik kararı olduğunu belirten avukatlar, gizlilik kararı olsa bile görmeleri ve örnek almaları gereken, gözaltı kararı, doktor raporları, bilirkişi raporları gibi almalarında sorun olmayan evrakların dahi kendilerine verilmediğini belirttiler.
