Aasia Bibi's lawyer seeks refuge in Netherlands

The agreement between the Pakistani government and a far-right political group that would see a Christian woman acquitted of blasphemy barred from leaving the country has no legal value, her lawyer, who has sought refuge in the Netherlands, said.

Aasia Bibi, a Christian woman accused of blasphemy, spent eight years on death row after being convicted by lower courts.

Last week, the Pakistani Supreme Court acquitted Bibi, saying there were “glaring and stark” contradictions in the evidence against her.

Saif-ul-Malook, who represented Bibi for years, told Al Jazeera he fled to the Netherlands on Saturday following threats to his life.

On Monday, Bibi’s lawyer Malook addressed the press conference alongside Jan Dirk van Nifterik, the director of the Dutch rights group Stichting Hulp Vervolgde Christenen (HVC, or Foundation to Help Persecuted Christians), who said that they had aided him in his escape from Pakistan.

“HVC was able to get him to the Netherlands, offer shelter and look after him,” said Nifterik. “We are grateful to Malook for his work on human rights.”

Malook said he took Bibi’s case because lawyers “do not have a religion”.

“[Lawyers] only … fight for justice, and only see that no one should be condemned unless there is evidence up to the standard.”

Malook said that he had no information on whether Bibi had been released from jail, saying the last time he spoke to a senior jail official about the matter – on Friday night – she remained in custody.

Malook himself faced numerous threats for representing Bibi, whose case has become emblematic of fair trial concerns in such cases in Pakistan.

Blasphemy is a sensitive subject in the country, and at least 74 people have been killed in violence associated with blasphemy allegations since 1990, according to an Al Jazeera tally.

Malook said that he spent days taking refuge at the French Embassy in Islamabad, before he was able to fly out early on Saturday morning.

He flew through Italy, before finally arriving in the Netherlands, he said.

The lawyer indicated that he was currently on a visit visa, but that he would be staying in the European country for an unspecified length of time. He said he would call his wife and children to join him “when I have a place for them to live”.

USA: Center for Constitutional Rights Demands Malicious Charges Against Board Member Leonardo Aldridge Be Dropped

The Center for Constitutional Rights was recently made aware of the unjust indictment of its board member, civil rights and criminal defense attorney Leonardo Aldridge, on malicious and unjust charges stemming from a homicide police investigation that occurred in San Juan, Puerto Rico on September 21, 2018.

Mr. Aldridge was in the process of counseling a client of his who the police had already questioned as part of what was then a homicide investigation. Rather than being permitted to conclude that counseling, Mr. Aldridge was unlawfully arrested by officers at the scene.

We are deeply concerned about the authorities’ unlawful interference with people’s access and ability to consult with lawyers. The right to consult with a lawyer in matters such as this are basic and fundamental. That the authorities not only impeded that lawful, constitutional process in this case, but also arrested and indicted Mr. Aldridge for seeking to confer with his client is an outrage to the constitutional protections that govern the sacrosanct lawyer-client relationship and the right to counsel.

Le projet de loi de programmation 2018-2022 et de réforme pour la justice est examiné au Sénat de demain. The lawyer for a Christian woman cleared of blasphemy after spending eight years on death row in Pakistan has fled the country and her husband has asked Britain, the US and Canada to grant the family asylum.

Saif-ul-Mulook feared for his safety after the Supreme Court ­acquittal of Asia Bibi on Wednesday infuriated hardline Islamists, who held nationwide protests demanding her execution.

“In the current scenario, it’s not possible for me to live in Pakistan,” the 62-year-old lawyer said before boarding a plane to Europe on Saturday. “I need to stay alive as I still have to fight the legal battle for Asia Bibi.”

Ms Bibi’s husband, Ashiq Masih, called for Britain to grant the mother and their family refuge amid fears for their safety.

In a video, he says: “I am requesting the Prime Minister of the UK help us and as far as possible grant us freedom.”

Speaking in Punjabi, he also called for asylum from Canadian Prime Minister Justin Trudeau and US President Donald Trump.

The lawyer said the Islamist outcry was “unfortunate but not unexpected”. “What’s painful is the response of the government. They cannot even implement an order of the country’s highest court,” he said, adding that “the struggle for justice must continue”.

Dawn, the country’s oldest newspaper, in an editorial on Saturday blasted the deal as “another surrender”. “Yet another government has capitulated to violent ­religious extremists who neither believe in democracy, nor the constitution,” it read.

Mr Mulook said last week that he would have to leave Pakistan because the followers of hardline cleric Khadim Hussain Rizvi had threatened to kill him as well as the judges who acquitted Ms Bibi.

Iran: Protesters Sentenced in Unfair Trials – Human Rights Lawyer Arrested for Exposing Death in Detention

Iran’s judiciary convicted at least 24 protesters on vaguely defined national security charges, Human Rights Watch said today. Their prison sentences ranged from six months to six years.
They were among more than 50 people arrested on August 2 during a protest in Tehran about deteriorating economic conditions and corruption. On October 28, authorities also arrested a human rights lawyer who had been convicted to three years in prison for reporting a protester’s death in detention.
“Iranian government officials repeatedly advertise to the world that the repeated protests in the country signal that there are real freedoms in Iran, while these same protestors languish in prison for years,” said Michael Page, deputy Middle East director at Human Rights Watch. “Prosecuting peaceful protesters will only add fuel to Iranians’ boiling frustration and discontent with the situation.”

 

Three sources with close knowledge of the protesters’ cases told Human Rights Watch that prosecutors charged them with “assembly and collusion against national security” due to “participating in a protest without a permit that disrupted public order.” In the sentencing of at least two people, including Saba Kordafshari, 19, the evidence prosecutors presented was solely their social media posts reporting on the protest.

In reprisal for exposing Heidari’s death in custody and reporting that his body bore marks of torture and other ill-treatment, including cuts and bruises, the authorities arrested Mohammad Najafi, a lawyer. On July 26, Branch 2 of Arak’s criminal court sentenced Najafi to three years in prison for “disrupting public order through unconventional acts such as chanting slogans” and “publishing false information to disturb public opinion.” He began serving his sentence on October 28.

Aujourd’hui, le CCBE a exhorté le président iranienHassan Rouhani حسن روحانی à libérer immédiatement l’avocat Mohammad Najafi, condamné à trois ans de prison et à la peine #inhumaine de 74 coups de fouet.

Les journées mondiales se succèdent et rien ne change. Elles n’en sont pas moins utiles pour autant, dès lors où elles sont de réels temps forts pour la solidarité et la réflexion, et non des alibis récurrents pour s’exonérer des résistances quotidiennes.

La “Journée mondiale des écrivains en prison” qu’est-ce donc  ?

Cette journée est organisée depuis 1981 afin d’attirer l’attention mondiale sur des écrivainEs et des journalistes dont le travail leur attire des représailles.

Il n’y a pas si longtemps, le 10 novembre 1995 très exactement, l’écrivain nigérian Ken Saro Wiwa a été pendu pour avoir défendu les droits de son ethnie minoritaire dans une région d’agriculture et de pêche spoliée et dévastée par l’exploitation pétrolière. Ses convictions l’avaient amené à plaider jusque devant la Commission des Droits de l’Homme.

EcrivainEs en danger

Le 15 novembre a lieu la Journée pour les Écrivains en prison, organisée par une dizaine de milliers de membres du P.E.N. International. Pour mémoire, fondée en 1921, l’association mondiale de poètes, de romancierEs et de journalistes s’engage à défendre la libre circulation des idées entre toutes les nations, à promouvoir une littérature sans frontières et à s’opposer à toute restriction de la liberté d’expression. Au siège du P.E.N. International à Londres, le Comité des Ecrivains emprisonnés avait recensé 775 cas de femmes et d’hommes de lettres persécutés et réprimés pour délit d’opinion pendant le premier semestre de l’an 2003 par exemple. Nombre d’entre eux ont été arrêtés, torturés, emprisonnés ou contraints à l’exil. 22 personnes ont été tuées ou assassinées, 13 portées disparues. Le Comité a établi une liste non exhaustive des Etats à haut risque: Algérie, Bangladesh, Chine, Cuba, Iran, Birmanie, Syrie, Turquie, Vietnam… Depuis quinze ans, la liste des Pays et ces cas a explosé en courbe exponentielle

Aussi, cette Journée pour les EcrivainEs en prison, est-elle au fil des années devenue un moment fort de solidarité et de soutien envers touTEs les écrivainEs victimes de l’intolérance et de la dictature, sans oublier leurs familles harcelées, intimidées ou menacées, qui n’empêche pas un soutien continu et actif.

Réduire les gens de lettres au silence, briser leur plume, confisquer et brûler leurs œuvres, c’est la pire des tortures.

Cette année, PEN présente les cas de :

  • Cesario Alejandro Félix Padilla Figueroa, membre de PEN et militant, risque d’être poursuivi en justice au Honduras
  • Nguyen Ngoc Nhu Quynh, blogueur purgeant une peine de 10 ans de prison au Viet Nam
  • Ramón Esono Ebalé, caricaturiste et militant primé, actuellement détenu en Guinée équatoriale
  • Razan Zaitouneh, défenseur des droits de l’homme, blogueur et avocat a disparu en Syrie
