Turkey/ECHR: Local court rejects Demirtaş’s appeal for release despite ECtHR ruling

The Ankara 19th High Criminal Court on Friday rejected a request for release filed by Kurdish politician Selahattin Demirtaş which was based on a European Court of Human Rights (ECtHR) ruling that his pre-trial detention had gone on longer than could be justified.

The court decided to ask Turkey’s Justice Ministry whether the ECtHR ruling was final.

Former co-chairman of the Peoples’ Democratic Party (HDP) Demirtaş has been in pre-trial detention since November 2016 along with the other former co-chair, Figen Yüksekdağ.

“The Court found that the judicial authorities had extended Mr Demirtaş’ detention on grounds that could not be regarded as ‘sufficient’ to justify its duration,” the Strasbourg-based ECtHR said in a statement on Nov. 20.

The ECtHR ruled that Ankara “was to take all necessary measures to put an end to the applicant’s pre-trial detention.”

President Recep Tayyip Erdoğan responded to the ECtHR decision by saying that the European court’s rulings did not bind Turkey.

Iran/UN: UN Experts: Iran Must Protect Women’s Rights Advocates

UN human rights experts* have called on Iran to guarantee the rights of human rights defenders and lawyers who have been jailed for publicly supporting protests against the mandatory wearing of the hijab in Iran.

“We urge the Government to immediately release all those who have been imprisoned for promoting and protecting the rights of women,” the experts said.

In particular, the experts expressed alarm at the critical health of Farhad Meysami, a medical doctor, who was arrested in July after his advocacy in support of women protesting against the hijab law. Mr. Meysami began a hunger strike in August in protest at the charges and the lack of access to a lawyer of his choosing. Reports indicate that he has been moved to the medical centre in the prison, where he has been restrained in a bed and given intravenous injections. He is being held in isolation.

The experts said they were deeply disturbed by the reported lack of due process guarantees and said authorities had an obligation to respect the wishes of those who use hunger strikes as a form of protest.

The experts also reiterated their concern at the in-absentia conviction and subsequent imprisonment of Nasrin Sotoudeh, legal counsel for a number of the women protesters. She was convicted on security-related charges which appear to stem from her work representing the protesters. In September, her husband, Reza Khandan was arrested for “spreading propaganda against the system”, amongst other charges, and was accused of “promoting the practice of appearing in public without a veil”.

The experts called on Iran to urgently address Mr. Meysami’s grievances, and to guarantee the rights of Mr. Meysami, Ms. Sotoudeh, and of Mr. Khandan to not be deprived arbitrarily of their liberty. They also urged authorities to guarantee their right to fair proceedings before an independent and impartial tribunal.

The UN experts have notified the Government of Iran about their concerns.

Rob Tibbo arranged for the U.S. whistleblower, then the planet’s most-wanted man, to hide with three refugee families. Now they seem to be facing the consequences

As Rob Tibbo raced to the Hong Kong International Airport one day last November to catch his getaway flight, a nagging fear followed close behind.

Tibbo, a Canadian expatriate lawyer and respected officer of the local courts, had been in hiding from the police for a month and still worried he could be arrested at any moment.

But his taxi arrived at the airport without incident, and Tibbo was soon in safe hands: Pascal Paradis, a Montreal-based leader of the group Lawyers without Borders, and two Canadian diplomats who shadowed him through security, making sure he safely boarded the Vancouver-bound Air Canada jet.

First, though, he bid an emotional final farewell to several of his impoverished clients also waiting in the terminal, among them migrants who, along with Tibbo, had found themselves in the midst of a story that shook the world.

A year earlier, the National Post — along with the New York Times and Germany’s Handelsblatt — had revealed that the lawyer had arranged for American spy-agency whistleblower Edward Snowden, at the time the planet’s most-wanted man after leaking details of U.S. mass-surveillance programs, to hide in the Hong Kong homes of three refugee families before catching his own flight to Moscow.

Now they all seemed to be facing the consequences of that fateful act.

Tibbo himself faced escalating pressure from the authorities. The legal-aid organizations that funded the refugee cases choked off payments and questioned his professionalism, while Hong Kong’s legal regulator peppered the lawyer with disciplinary charges after a spotless 15-year career in the territory.

When it seemed the police, too, were on his trail, Tibbo decided he had to leave.

“I’m pretty much out of money. My wife and I are pretty much living in poverty,” he told the Post. “The bottom line is my career in Hong Kong is over.”

Turkey: Turkish police intervene in commemoration for slain Kurdish lawyer Elçi

Turkish police intervened with lawyers in Ankara gathered to commemorate Tahir Elçi, former president of the Diyarbakır Bar Association and a prominent human rights lawyer, on the third anniversary of his killng, Cumhuriyet newspaper reported on Wednesday.

Police prevented lawyers from openning banners to commemorate Elçi in front of the Turkish capital’s court house, Cumhuriyet said.

Tahir Elçi, a prominent Kurdish human rights lawyer, was shot dead during a gun battle between the police and unidentified gunmen in the southeastern province of Diyarbakır three years ago, while delivering a speech to advocate peace.

Elçi was speaking in front of the historic minaret in Diyarbakır, which was destroyed during Turkish security forces’ operations in the Sur district, which Ankara says is the urban center of the Kurdistan Workers Party (PKK).

Elçi was killed following numerous death threats he received following his statement on a television program that the PKK is not a terrorist organisation. He was later prosecuted for the statement and was facing trial, despite having denounced PKK’s violence.

Thousand gathered for the funeral  of Elçi in Diyarbakır, including former co-chair of the dominantly Kurdish People’s Democratic Party (HDP), Selahattin Demirtaş, who was arrested in November 2016  over terror charges and remains in prison.

China/Sweden: Wife of Detained Human Rights Lawyers Wins Human Rights Prize

Li Wenzu, wife of disappeared human rights lawyer Wang Quanzhang, has been awarded Sweden’s Edelstam Prize for “exceptional courage” in defending human rights, the organizers said.

But the prize was presented to U.S.-based activist Yuan Weijing in her place, as Li was prevented from traveling to Stockholm to receive the award in person.

“Actually, I was very unsettled when I found out I had won the award, because so many other relatives and lawyers affected by the July 2015 crackdown have done so much more than I did,” Li told RFA on Wednesday. “But I was very moved [to see] photos and videos [of the ceremony].”

“There have been so many people who have offered me their silent help over the past three years, and we wouldn’t have made it through with their support,” she said. “Some people told me that we are opposing an authoritarian power with love.”

The award ceremony featured a large Chinese character meaning “love,” as well as the iconic red buckets used by Li and fellow activists to highlight the plight of detainees.

“Everyone who attended the ceremony was given the character for ‘love,’ as well as a little red bucket,” Yuan Weijing told RFA after receiving the award on Li’s behalf.

“This award is intended as moral support for Li and for the other wives and family members, who, like her, have been fighting for their husbands’ rights and freedom,” she said.

Yuan, who now lives in the United States with her husband, human rights lawyer Chen Guangcheng, said the award should also heighten awareness outside China of the plight of the country’s lawyers.

Cameroon: prominent Anglophone lawyer kidnapped in Bamenda

A prominent Anglophone lawyer was kidnapped in Bamenda, North West region of Cameroon by unidentified gunmen, sources have said.

Barister Suh Fuh Ben was kidnapped on Tuesday November 27 in Bamenda as he had just returned from Douala where he took part at the General Assembly of the Cameroon Bar Association at the weekend.

The identity of his kidnappers is not yet known but it is suspected armed separatists in the area are responsible for the act following threats in the past weeks on Anglophone lawyers.

Separatists activists had warned Anglophone lawyers not to take part in the last week elections claiming their participation would be a betrayal to the Anglophone course.

Lawyers and other civil society activists have called for the immediate and uncondition release of Barister Suh Fuh Ben who has defended several Anglophone activists in court.

“The authors of this misfortune were misguided. As a consequence they should proceed to realease him immediately and let us concentrate on on freeing our brothers and sisters languishing in jail,”Barrister Akere Muna said in a statement.

France: La justice française ordonne le blocage du site raciste Démocratie participative

Le tribunal de grande instance de Paris a confirmé le blocage de ce portail d’extrême droite, qui a pris pour cibles de nombreuses personnalités publiques.

Le site Internet raciste, antisémite et homophobe Démocratie participative va être bloqué en France. Ainsi l’a ordonné le tribunal de grande instance de Paris, dans une décision rendue mardi 27 novembre. Le procureur de Paris avait déjà ordonné début octobre à neuf fournisseurs d’accès à Internet français, dont les principaux comme Orange, Free ou Bouygues Telecom, de rendre impossible l’accès depuis la France à ce site internet, dont la violence n’a pas d’équivalent dans la nébuleuse d’extrême droite.

La décision du tribunal de grande instance oblige désormais les fournisseurs d’accès à rendre ce blocage effectif, sans limite de temps, sur le territoire français dans les quinze prochains jours. Passé ce délai, ils seront condamnés à payer 10 000 euros par jour de retard, si ce blocage n’est pas mis en place. Ce dernier concerne également, selon la décision du tribunal que Le Monde a pu consulter, « tout site comportant le nom democratieparticipative.biz », une manière, semble-t-il, de bloquer aussi d’éventuels nouveaux sites portant le même nom mais disposant d’une autre adresse.

 

Créé en 2016, Démocratie participative a multiplié les articles débordant d’injures antisémites, homophobes, antimusulmanes et racistes. De nombreuses personnalités publiques y sont traitées de « youpins », de « nègres » ou, pour les personnes homosexuelles, de « dégénérés ». Dans sa décision, le tribunal en donne un aperçu non exhaustif en listant dix-sept injures à caractère raciste, homophobe ou antisémite, trois incitations à la haine en raison de la religion, cinq incitations à la haine en raison de l’orientation sexuelle, quatre injures en raison de l’orientation sexuelle, et trois cas d’apologie de crime contre l’humanité.

Une procédure rare

La demande du parquet de Paris est une mesure rare. La justice, du siège comme du parquet, ne s’est que rarement aventurée vers le blocage judiciaire d’un site internet raciste, par méconnaissance des textes ou par frilosité à appliquer des lois jugées trop floues. Comme ont pu le constater procureurs et juges à l’audience, la loi française dispose pourtant d’outils pour bloquer un site internet lorsque les circonstances l’obligent. « Ce blocage est une décision importante, car elle va faire précédent : cette victoire en appelle d’autres », ajoute Frédéric Potier, en réaction à l’annonce du tribunal de grande instance de Paris.

Plusieurs associations antiracistes (SOS Racisme, Licra, MRAP…), de lutte contre l’antisémitisme (CRIF…) et l’homophobie (SOS Homophobie) et certaines victimes du site étaient, par le biais de leurs avocats, présentes à l’audience, notamment les youtubeurs Marie S’infiltre et Aurélien Enthoven, l’ancien bâtonnier du barreau de Grenoble Denis Dreyfus ou encore Marc Knobel, directeur des études au Conseil représentatif des institutions juives de France (CRIF).

Turkey/Day of the Endangered Lawyer: Trial of lawyers from People’s Law Office to continue between 3 and 7 December

The trial of lawyers from People’s Law Office will continue between 3 and 7 December 2018 at 10 a.m. at Silivri Prison. Seventeen lawyers are accused of “being members of a terrorist organisation”, while three of them are charged with “being managers of a terrorist organisation”. Six lawyers from People’s Law Office remain in detention.

People ‘s Law Office is a public interest law firm known for its work on high profile cases such as that of 15- year old Berkin Elvan, who died during the Gezi Park protests after being hit on the head by a tear-gas canister fired by a police officer, and Dilek Doğan, a young woman who was shot and killed by a police officer during an anti-terror raid on her house on 18 October 2015. The Office also represented Nuriye Gülmen and Semih Özakça, two educators dismissed from their positions following the failed coup attempt of 15 July 2016. One of the organisation’s lawyers, Selçuk Kozağaçlı, worked on the “Soma Mine” disaster, the worst mine disaster in Turkey’s history, in which 301 miners were killed.

On 14 September, after a full week of hearings, Istanbul’s 37th High Criminal Court ordered the release of all 17 detained lawyers from People’s Law Office, who had been in pre-trial detention since 2017. They were released the following morning. The Court then ordered the re-arrest of 12 lawyers less than 24 hours after its previous decision, after the prosecutor had contested the court’s decision. To date, six lawyers from the People’s Law Office, namely Selçuk Kozağaçlı, Engin Gökoğlu, Aycan Çiçek, Aytaç Ünsal, Behiç Aşçı and Ahmet Mandacı have been re-arrested, and the re-arrest orders for six other lawyers are still pending. While the Court confirmed the release of the remaining five lawyers, namely Yaprak Türkmen, Yağmur Ereren Evin, Didem Baydar Ünsal, Ayşegül Çağatay and Zehra Özdemir, the criminal proceeding against all 20 lawyers charged remains ongoing.

Turkey/Day of the Endangered Lawyer: 3 Years Pass Since Murder of Tahir Elçi, No Lawsuit Filed Yet

It has been three years since Diyarbakır Bar Association Chair Tahir Elçi was murdered; but, the perpetrators have not been brought to justice. In a parliamentary inquiry, it has been stressed that the video footage of the incident “could not be found.”

Tomorrow (November 28) will mark the third year since the murder of Diyarbakır Bar Association Chair Tahir Elçi; however, not only have the perpetrators of the incident not been found in this three-year period, but no progress has been made in his case file as well.

Submitting a parliamentary inquiry regarding the issue, Peoples’ Democratic Party (HDP) Siirt MP Meral Danış Beştaş has emphasized, “The investigation into the death of Tahir Elçi will also be a step towards bringing several other unidentified murders into light.”

In the inquiry submitted to the Parliament, it has been stated that “the ones who could be the suspects of the murder of Elçi were listened only as witnesses; no crime scene investigation was conducted at the scene of incident after Elçi was murdered; and the prosecutors conducting the investigation into his murder have been constantly changed.”

What did the authorities of the time say?

Tahir Elçi was murdered in Sur in Turkey’s southeastern province of Diyarbakır on November 28, 2015 while making a statement for the press.

In her parliamentary inquiry, Danış Beştaş has also referred to the remarks made by the authorities of the time regarding the murder of Tahir Elçi:

“The then Prime Minister Ahmet Davutoğlu said, ‘This incident will definitely be brought to light. We will not let unidentified murders in our time. No matter who has done it, the target is not only Dear Tahir Elçi, but, Turkey.’

“The then Vice Prime Minister Numan Kurtulmuş also stated that the attack against Tahir Elçi was ‘a brutal assassination’.”
