Turkey: Eight more Turkish lawyers were convicted of arbitrarily terrorism provisions

Denizli 2nd High Assize Court convicted eight lawyers of the membership to the armed terrorist organisation and sentenced them to ranging from six to seven years.

Ten lawyers who are members of the Denizli Bar Association were taken into custody on August 2016 in the wake of the failed coup attempt. Eight of them, lawyers Muhammed İkbal Çil, Muammer Güler, Özcan Aksoy, Emre Karcı, Yusuf Yılmaz, Müdayi Kaplan, Hüdayi Kayhan, Mustafa Maskan were subsequently arrested because of their (alleged) links or affiliation to Gulen Movement.

After 20-month pre-trial detention, the Court sentenced lawyers Muhammed İkbal Çil, Muammer Güler, Özcan Aksoy to seven years and six months and decided to hold them in remand.

Lawyers Emre Karcı, Yusuf Yılmaz, Müdayi Kaplan, Hüdayi Kayhan, Mustafa Maskan were sentenced to six years in three months and released with probation by the court. They’ll serve the remaining term of the sentence If the convict was upheld by the Court of Cassation.

Lawyer shot dead in Allahabad, protest turn violent

Protest against the murder of a lawyer turned violent in Colonelganj’s Manmohan Park area in Allahabad on Thursday. A lawyer named Rajesh Srivastava was shot dead in Colonelganj early morning. Lawyers set ablaze a bus near District Magistrate’s office in Allahabad, protesting after lawyer Rajesh Srivastava was shot dead.

According to reports, SSP Akash Kulhari told media that land dispute could be reason behind the murder of lawyer. The slain Rajesh Shrivastav was advocating an old land case.

Ironically, the incident has occurred when the DGP is reviewing the crime in the city. The entire city’s police force has been deployed to avoid untoward incidents.

Lawyers alleged that law order situation in deteriorated in Allahabad. Two days ago, BJP leader Pawan Kesari was killed in Phulpur. A few days ago, robbers looted Rs 10 Crore from UCO Bank.

So far no arrests have been made in connection with these cases.

Burundi: Me Cyriaque Nibitegeka Libéré

L’avocat burundais, Maître Cyriaque Nibitegeka est enfin libre après 14 mois de détention arbitraire en République Démocratique du Congo. Il avait été arrêté le 16 février 2017 par le renseignement militaire congolais alors que l’avocat “avait pris rendez-vous avec les autorités [congolaises] afin d’offrir ses services d’avocat à deux burundais qui étaient alors détenus et menacés d’extradition irrégulière vers leur pays d’origine” selon le communiqué de CAVIB. Loin d’être reçu comme avocat, Me Nibitegeka a été détenu avec ses clients dans des conditions horribles. Il aura passé un mois au centre d’interrogatoire de l’armée congolaise à Uvira, quatre jours dans des cachots secrets à Bukavu et Goma, 7 mois dans le cachot du renseignement militaire à Kinshasa et six mois à la prison centrale de Makala. Pourtant, ce n’était qu’un avocat, un défenseur de droits humains qui ne volait qu’au secours de ses frères burundais. Il n’a jamais été présenté devant un juge. Maitre Nibitegeka et ses deux clients ont été libérés sur une décision du parquet.

Me Cyriaque Nibitegeka est un militant des droits humains très engagé, il a déjà payé un lourd tribut pour son activisme dans la lutte contre la violation de la constitution burundaise. Il a dû sacrifier sa carrière d’enseignant à l’Université du Burundi alors qu’il était sur le point d’entamer une formation doctorale en Belgique. Le 29 mai 2015, il avait déjà été arrêté et séquestré à l’Aéroport de Dar-es-Salaam en Tanzanie où il se rendait pour le plaidoyer auprès des instances de l’EAC. Son engagement n’a pas faibli pour autant et il se dit toujours déterminé à continuer la lutte.

Nous nous réjouissons de sa libération (de même que ses deux clients) et saluons tous ceux qui, en toute discrétion, ont intervenu en sa faveur. Encore une fois, notre profonde gratitude à l’ONG Defend Defenders qui s’est particulièrement démarquée dans l’assistance à ce défenseur des droits humains.

Kinshasa : l’UDPS dénonce l’enlèvement de l’un de ses cadres de la ligue des jeunes

L’Union pour la démocratie et le progrès social (UDPS) dénonce l’enlèvement la nuit de mardi à mercredi 9 mai de Me Evariste Kalala Kwete, l’un de ses cadres de la Ligue des jeunes. Selon le porte-parole de ce parti de l’opposition, Augustin Kabuya, les faits se sont déroulés dans la maison familiale, dans la commune de Matete, à Kinshasa.

Le père de la victime, Pierre Kwete Minga, relate que son fils a été amené sans que les hommes armés à sa recherche ne leur donnent le motif.

« Vers minuit, cinq véhicules 4X4 se sont arrêtés et ont bouclé notre maison. Plusieurs hommes armés sont descendus et ont cassé le portail. Ils ont aussi cassé les vitres du salon pour casser le cadenas. Ils ont saccagé toute la maison », a relaté Pierre Kwete.

Dans sa relation des faits, il a indiqué que les hommes armés les ont par la suite rassemblés au salon et leur ont demandé de présenter leurs cartes d’identité.

« Ils l’ont embarqué [Me Evariste Kalala Kwete. Ils n’ont donné aucune raison. Nous sommes sans nouvelles de lui depuis lors », a raconté le père de la victime.

India: Woman Lawyer alleges assault by male colleagues, SC grants her protection

The Supreme Court today issued notice to the Delhi Bar Association in a case concerning assault on a woman lawyer by male members of the Bar in the premises of the Tis Hazari Court.

The Supreme Court has also ordered for security to be provided to the petitioner, advocate Afshan Pracha.

Pracha filed a writ petition before the Supreme Court raising the issue of safety of woman lawyers at their workplace, after allegedly being subjected to assault by certain male members of the Delhi Bar Association. The petitioner alleged that earlier this month, she was subjected to physical assault at the Tis Hazari Court in Delhi, and has been afraid to return to the court ever since. She also asked for protection in light of the incident.

The incident took place on May 4, when certain lawyers at the Tis Hazari Court were observing a strike called by the President and the Secretary of the Delhi Bar Association.

The petitioner claims that when she entered the court premises, she was given “rude directions” by some male lawyers to remove her bands, and that she complied with the same. She was also asked to remove her black coat, but refused to do so.

Pracha claims that the President and the Secretary of the Delhi Bar Association, along with a few other male advocates, threatened her of dire consequences continually and also photographed and filmed her following these threats. The petitioner also states that she was “abused, manhandled and assaulted”.

India: Supreme Court expresses anguish over lawyers targeting judges, court orders

A trend has started among lawyers to target the judges, which would ultimately lead to the “killing of the institution”, a Supreme Court bench observed today.

A bench of Justices Arun Mishra and U U Lalit, while hearing a Kerala medical college matters, was critical of the lawyers criticising the orders and judgements of the courts in television debates.

“Who is spared in this court? Every Judge is targeted. By one arrow you want to kill all. You people are destroying this institution. If this institution is destroyed, then you people won’t survive”, Justice Mishra said.

The judge’s outburst came when the lawyers appearing in the matter started arguing simultaneously by raising their pitch.

Justice Mishra said, “You (lawyers) are killing this institution every day. Lawyers will survive only if this institution survives.”

Justice Mishra also expressed displeasure that the Supreme Court Bar Association was silent on the issue.

The Philippines: Law profs, deans: Ousting Sereno not by impeachment is ‘unconstitutional’

With the Supreme Court set to rule on the quo warrants petition filed against Chief Justice Maria Lourdes Sereno, deans and professors of various law schools have expressed concerns over the process, saying that the Chief Justice can only be removed from office by impeachment.

“Any other means would be unconstitutional,” more than 130 law faculty members said on Thursday through a manifesto entitled “A Call for Adherence to Constitutional Process.

“It will expose those involved in the same vicious cycle of extrajudicial removal process which will subvert the constitutional check and balance and endanger judicial independence,” they added.

The manifesto was signed by more than 130 deans and professors, including Deans Hector Hofileña of Pamantasan ng Lungsod ng Maynila (PLM) Graduate School of Law; Jose Manuel Diokno of De La Salle College of Law; Maria Soledad Derequito-Mawis of Lyceum College of Law; Anna Maria Abad of Adamson College of Law; Melencio Sta. Maria of Far Eastern University Institute of Law; and Manuel Quibod of Ateneo de Davao University College of Law.

They claimed that law schools have always taught that a chief justice can only be removed from office through impeachment proceedings in the House of Representatives and in the Senate.

“We are not questioning the motivation, integrity and patriotism of anyone involved in this process but we must remind them that the integrity of the process is as important as its result,” the manifesto added.

On July 9, 2015, Wang Yu (王宇) became the first target in a campaign of mass arrests against human rights lawyers in China. Over the next roughly two weeks, over 300 rights lawyers were arrested, interrogated, detained, and threatened — thus begetting the notorious ‘709 Incident.’ After over a month in secret detention at a black site in Beijing, Wang Yu was transferred to Tianjin for a continuation of her detention, then under so-called ‘residential surveillance at a designated place’ (指定居所監視居住). For over a year she was not allowed to see her lawyer, family, or communicate with the outside world. Another 20 or so lawyers and activists, including Wang Yu’s husband Bao Longjun (包龍軍), were given similar treatment. During the secret detention and their time in detention centers, they were severely tortured, including by sleep deprivation, prolonged interrogation, forced-feeding with unidentified drugs, beatings, insults, being hand- and foot-cuffed, or having their family’s safety threatened. Some were even placed in cages submerged in water, so-called ‘water cage’ torture. Currently, three individuals are serving prison sentences, three were released on suspended sentences, and all others except one were released on a probationary form of ‘bail.’  Lawyer Wang Quanzhang (王全璋) has been detained for over 1,000 days, neither sentenced nor released, and no one even knows whether he is dead or alive.

In August 2016, Wang Yu and her husband were released on a probationary form of bail (取保候審), whereupon they were forcibly taken to an apartment building in Ulanhot, Inner Mongolia. There they were reunited with their son, Bao Zhuoxuan (包卓轩), who had previously been coercively removed from Beijing and placed in Ulanhot to continue high-school. In Ulanhot, their movements were closely monitored, they were followed wherever they went, and their apartment was fitted out with an extensive array of surveillance cameras that pointed to their doorway, stairs and in and out of the building entrance. Wang Yu believed that the apartment itself was bugged too. Around a year later they were allowed to return to their own home in Beijing. Now, though they’re apparently ‘free,’ every move they make is still surveilled by the authorities, and Wang Yu has been unable to resume her profession as a lawyer.

Among China’s human rights lawyers, Wang Yu has been called the ‘Goddess of War.’ Prior to the 709 crackdown, she traveled the country taking on all manner of human rights cases. The image of Wang the lawyer in the ‘Hooligan Sparrow’ documentary, handing out fliers about the law under the beating sun in Hainan, left a deep impression of her commitment.

On July 8, 2016, the American Bar Association announced that it had selected Wang Yu to receive its inaugural ABA International Human Rights Award, “in recognition of her dedication to human rights, justice and the rule of law in China.” This news seemed to rattle the Communist Party. The authorities knew perfectly well that the 709 crackdown was an illegal, politically motivated large-scale persecution of human rights lawyers, and that the cruelty of torture methods they used exceed what most people can conceive. They fear the moral support that the international community was extending to the targets of their attacks.
