India/Jammur: Deepika Singh Is The Brave Lawyer Who Is Defying Death Threats To Seek Justice For Asifa

April 14, 2018

The horrific Kathua gang rape and murder case has shaken the entire nation just like the Nirbhaya incident. Our country is losing sleep over the perennial attitude of denying and delaying justice. While the 8-year-old deceased victim’s family is currently in an inexplicable state of grief, the government’s deafening silence is simply baffling. Amidst this horrific situation, one voice that is fighting hard to stay strong is that of Deepika Singh Rajawat. A young lawyer who is defying every death threat coming her way only to ensure the accused are punished and justice is delivered to Asifa and her grieving family.

Rajawat is the chairperson of an NGO called ‘Voice For Rights’  which ardently works towards fighting for human rights. She is currently representing Asifa’s family in the Jammu and Kashmir High Court and is trying to bring the accused to face a trial. The eight-year-old child was drugged and brutally gang-raped for days before she was killed and thrown in the forest.  The criminals behind this monstrosity simply wanted to fulfill their lust and drive away the minority from that area. The gory details of the charge sheet are enough to send shivers down anyone’s spine. However, Deepika’s fight is not without hurdles, as she is facing a barrage of life threats ordering her to step away from the case.

Deepika has now requested the Chief Justice of the Jammu & Kashmir High Court for additional security. The Jammu Bar Association has been protesting against the police and is even inviting a CBI probe into the matter. India stands united and is demanding justice for the child’s murder. It is a situation of utter disgrace and shame for the police and the judiciary if Deepika has to guard her own life to fight for justice. A prompt action is yet awaited, but at least the authorities know that voices can no more be silenced.

Turkey: Turkish court sentences pro-Kurdish journalists Keskin and Çapan to prison

March 29, 2018

A Turkish court sentenced pro-Kurdish journalists Eren Keskin and Reyhan Çapan to 7,5 years in prison for contempt of the state by the articles published in pro-Kurdish Özgür Gündem newspaper.

According to a report by Fırat news agency (ANF) on Thursday, Eren Keskin, who is also a long-time human rights activists and a lawyer, was sentenced to jail term for her activities at the time that she worked as editor-in-chief for Özgür Gündem newspaper.

İstanbul 2nd Criminal Court sentenced Keskin and Çapan to 2 years and 3 months each for contempt of the state. In another case, both journalists were sentenced to 5 years and 3 months in prison for allegedly insulting autocratic Turkish President Recep Tayyip Erdoğan. Journalists Hüseyin Aykol and Ersin Çaksu were also sentenced to jail terms.

Özgür Gündem newspaper was shut down back in August 2016 by a Turkish government decree under emergency rule declared in the aftermath of a controversial coup attempt on July 15, 2016.

Turkey is the biggest jailer of journalists in the world.

China: Disbarment, Suspension and Harassment: Outcast Lawyers in China

March 30, 2018

JURIST Guest Columnist Patrick Poon, a China researcher at Amnesty International, discusses the tactics used by Chinese authorities to keep lawyers from changing the political and social environment…

human rights lawyers

When Sui Muqing became a lawyer in 1993, he couldn’t imagine that 25 years later he would become a “post-lawyer” (lvshihou), a self-deprecating term often used by lawyers in China who have been stripped of their license to practice.

The authorities accused Sui Muqing of confronting a trial judge and separately of taking a picture of his client, dissident writer Chen Yunfei, when visiting him in detention. This was enough for the Guangdong Provincial Department of Justice to formally revoke his license, after a heavily guarded hearing in early February this year.

However, it is more likely the authorities’ motivation was to neuter a vocal and effective human rights lawyer. A thorn in the side of the government, Sui Muqing defended many activists and victims of human rights abuses, including representing high-profile human rights defenders like Guangdong activists Guo Feixiong and Wang Qingying and Falun Gong practitioners. Together with other lawyers, he had written statements on the difficulties for lawyers in sensitive cases, ranging from not being allowed to meet clients to challenges in defending their clients in court.

Bangladesh: Missing Bangladesh Hindu lawyer’s body found

April 1, 2018

Bangladesh’s police on Wednesday recovered the bloodstained body of prominent Hindu lawyer Ratish Chandra Bhowmik, who had gone missing last week after he left home in the Rangpur district.

The police also arrested four persons, including his wife, suspecting their link to the murder.

Mr. Bhowmik, 58, had fought the state’s case in high-profile murder trials against Islamist extremists.

“Their confessional statements led us to the dead body from an under construction building near Bhowmik’s own house,” said Benazir Ahmed, Director General of police anti-crime Rapid Action Battalion, referring to Mr. Bhowmik’s family. He added that the lawyer’s wife, a teacher, and one of her arrested colleagues, were directly involved in the murder.

Police said mobile phone records gave them the clue to the murder leading to his wife’s arrest.

India: Buxar boils over acquittal of lawyer murder case accused

April 3, 2018

Social activists, intellectuals, litterateurs and students took out a candlelight march in Buxar on Sunday evening in protest against the acquittal of accused in the case of murder of advocate Prem Prakash Sinha. The processionists were led by Sinha’s widow Urmila Devi.
Sinha’s colleagues also staged protests on the civil court premises on Monday. “We will boycott the court work from Tuesday in protest,” District Bar Association secretary Ganesh Thakur told newsmen.

The advocates said Sinha was shot at in November 2015 by miscreants who had earlier tried to molest his daughter. He later succumbed to his injuries. An FIR was lodged against six people, including a driver of the civil court.

In protest against the murder, the local civil court advocates had boycotted the courts, including the lok adalat, for a fortnight to press for the arrest of the culprits.
