China: Chinese lawyers investigated for ‘illegally’ defending Christians

January 14, 2018

China Aid

A group of lawyers in China may lose their qualifications after defending 40 Christians.

According to Christian religious freedom charity China Aid, the Christians have been unfairly swept up in a province-wide crackdown on a cult and now their lawyers’ qualifications have come under government review.

The charity said 200 people have been arrested across Yunnan Province for supposed involvement in a religious organisation called Three Grades of Servant’s.

The Chinese Communist Party has deemed the group a dangerous cult and 40 Christians have been accused of being part of it.

Lawyer Li Guisheng told China Aid a group of his clients have been “accused of being cult leaders, gathering secretly in different regions of Yunnan, doing missionary work, recruiting new members, spreading apocalypse rumors, rebuilding Three Grades of Servant’s buildings, accommodating secret gatherings, and fostering new religious leaders”.

Vietnam: Vietnam govt under fire for denying detainees lawyers

January 15, 2018

Detained activists being denied access to legal representation, rights group says

Vietnam govt under fire for denying detainees lawyers

A rights group in Vietnam has accused the communist government of illegally preventing its detained members access to legal representation.

The Brotherhood for Democracy, an independent civil society organization in Vietnam, said the government has harassed, arrested and accused nine of its members of “conducting activities aimed at overthrowing the state.”

Among them are Christian Lawyer Nguyen Van Dai, detained since December 2015, and Pastor Nguyen Trung Ton who was arrested last July.

“Nearly all were prevented from meeting defense attorneys their families had hired to act on their behalf. There were instances where members were forced to refuse to see their assigned lawyers,” the organization said in a statement on Jan. 9.

Dai’s wife Vu Minh Khanh accused authorities of preventing three assigned lawyers from seeing he husband by holding on to his letters.

On December 12 he wrote to tell her that the investigation against him and five other members had ended but she was not given the correspondence until 15 days later.

“This is a trick of Vietnamese authorities to prevent him meeting his lawyers quickly,” Khanh said.

After she received the letter, she said a man called her and said he had been appointed by authorities to represent her husband since Dai did not have a lawyer when in fact he did.

EGYPT – RULE OF LAW ON THE BRINK OF COLLAPSE

The Day of the Endangered Lawyer, marked on January 24th of each year, is a time to reflect on the personal and professional safety of lawyers around the world, who face mounting persecution, prosecution, arbitrary detention, threats, torture, assaults and death in reprisal for their work to protect rights and secure justice.

Each year, the Day of the Endangered Lawyer focuses on the plight of lawyers in a particular country with the focus this year on Egypt.

Join Human Rights Watch, Lawyers’ Rights Watch Canada and the Law Society of Ontario for a special event honouring our legal colleagues in Egypt and calling on authorities to respect their rights to practice law free from “intimidation, hindrance, harassment or improper interference”, to ensure their personal and professional safety and remedy violations against them.
