India: Uttarakhand HC lawyers boycott court of Lok Pal Singh J after judge imposes costs

Lawyers at the Uttarakhand High Court at Nainital are continuing to boycott the court of Justice Lok Pal Singh, in protest of the judge’s alleged misbehaviour towards the Bar.

The protests started yesterday, with the judge making disparaging remarks against and imposing heavy costs on lawyers appearing before him. Advocates were directed to pay as much as Rs. 2 lakh in costs. This resulted in the High Court Bar Association at Nainital calling for a boycott of Court No 7.

In reaction to the call for boycott of his court, Justice Singh has proceeded to take action against the President of the Bar Association, SN Khurshid, as well as General Secretary Sandeep Tiwari.

Italy: Esplode bomba carta sotto la macchina di un avvocato di Siracusa. Atto intimidatorio oggi a Pachino

Un rudimentale ordigno piazzato sotto l’auto per intimorire un avvocato durante l’esercizio delle funzioni. È successo oggi a Pachino ai danni di Adriana Quattropani, professionista di Siracusa che in qualità di curatore fallimentare stava apponendo i sigilli a una pompa di benzina a Pachino. Un soggetto, identificato dalla stessa e da alcuni testimoni, ha piazzato una bomba carta sotto l’auto danneggiando in pieno giorno.

Il Consiglio dell’Ordine degli Avvocati di Siracusa manifesta infatti la propria solidarietà nei confronti della collega, oggetto di un vile e spregiudicato gesto ritorsivo, avvenuto in pieno centro abitato, in pieno giorno e a seguito dello svolgimento del proprio dovere di pubblico ufficiale, quale curatore fallimentare.

L’Ordine degli Avvocati esprime inoltre sconcerto e grave preoccupazione per l’avvenimento odierno. Il danneggiamento dell’autovettura della collega, sotto la quale è stato collocato da ignoti un ordigno esplosivo, “è un chiaro segnale di escalation della criminalità organizzata che ritiene di poter impunemente compiere atti intimidatori anche nei confronti di chi è preposto alla tutela della legalità e dei diritti dei cittadini”.

Turkey/France: Turquie : “1.486 avocats sont poursuivis”, dénonce le vice-bâtonnier de Paris

Le président turc Erdogan est reçu à l’Élysée ce vendredi 5 janvier par Emmanuel Macron. Une visite qui fait grincer des dents, car du côté du Palais on justifie cet échange dans un souci de maintenir le fil du dialogue, sans cacher les divergences.

Il vaut mieux discuter avec les gens que les ignorer parce que sinon on ne les ramène plus jamais à la raison démocratique”, estime Basile Ader, vice-bâtonnier du Barreau de Paris. “Sur le principe de cette visite je suis pour, à condition qu’on lui (Erdogan, ndlr) dise les choses”, précise-t-il.

Les droits de l’Homme en Turquie sont particulièrement visés, notamment depuis le coup d’État manqué de l’été 2016. Emmanuel Macron a promis que ce dossier serait sur la table des discussions. Actuellement, la situation pour les magistrats et les avocats turcs “est terrible“, souligne Basile Ader, précisant que “c’est sans doute aujourd’hui une des pires du monde“.

Ukraine: Ukraine: killing of lawyer sparks protests against ‘criminal system’

Protesters demand a fair investigation into the death of Iryna Nozdrovska.

The brutal killing of a human rights lawyer in Kiev has sparked widespread anger and protests amid allegations of entrenched corruption within the Ukrainian justice system.

Iryna Nozdrovska’s body was discovered in a river by a passerby in a northern Kiev suburb on 1 January. The 38-year-old lawyer, who had been reported missing on 29 December, had suffered multiple stab wounds, according to reports. “There was such anger, such hatred [in the attack],” her daughter, Anastasiya, told Ukrainian media.

The Ukrainian foreign minister, Pavlo Klimkin, has described the murder as a “challenge to the state” and the case as “a test of our society’s ability to protect female activists and to ensure justice as a whole”.

The US embassy in Ukraine expressed shock over the killing and said those responsible for Nozdrovska’s death must be brought to justice.

Turkey/France/Greece: Athens and Paris Bar Associations denounce the ongoing persecution against Turkish lawyers

Paris Bar Association made a statement on the occasion of Turkey’s Erdogan’s forthcoming official visit (dated 5 January) to French President Emanuel Macron. It was said in the statement dated 4 January 2018 by lawyer Mr. Basile Ader who is vice president of the Paris Bar Association:

“The Paris Bar has noted that the situation of Turkish lawyers and magistrates has steadily worsened for a year, victims of a large purge in defiance of all international conventions and the most basic rights.

Turkey can not claim to be a respectable regime within nations without a rule of law whose lawyers, magistrates and journalists are sentinels.

The Paris Bar expresses to them the solidarity of the lawyers and mobilizes all the means necessary for them to regain their place and their role.

Chairman of Athens Bar Association  Mr. Dimitris Vervesos “..as has been widely judged by the European Court of Human Rights and has occasionally highlighted by the neighbor Bar Associations, Turkey has been had systematic violations of international law against the persecuted Turkish citizens and a large number of Turkish lawyer colleagues. The safeguarding of international law is a self-evident duty of the Bar Association, which has past struggles for democratic gains at national and international level..” said in his intervention in a case.

USA: Where the Poor Face the Death Penalty Without a Lawyer

It has become an annual ritual in Louisiana: Nearly every winter, the state’s public defenders run out of money. Last year, 33 of the state’s 42 local indigent defense offices cut staff or placed thousands of poor defendants on a wait list. The New Orleans public defender’s office began refusing clients, leaving hundreds to sit in jail without representation.

This year, there is another wait list. At least 11 Louisiana defendants facing the death penalty — including five who have already been indicted — have no defense team and may not have one until new money becomes available in July. The list is likely to grow. In Louisiana, all first-degree murder defendants face execution unless a prosecutor explicitly decides otherwise.

The latest crunch in Louisiana emerged from a law passed last year to try to patch up the system. The legislation, signed by Democratic Gov. John Bel Edwards in June 2016, required Louisiana’s state-level indigent defense agency to spend more on the overloaded local defenders — the ones who handle regular felony and misdemeanor cases — by spending less on lawyers in death penalty cases. The law successfully delivered about $5 million in additional cash to indigent defense offices around the state, including a $1.5 million boost for New Orleans, which has since ended its hiring freeze and reduced its wait list to essentially zero.

But funding for capital defenders was cut to $5.5 million from $8.5 million in just a year.

“They robbed Peter to pay Paul,” said Jay Dixon, chief defender for the Louisiana Public Defender Board, which is scheduled to hold a statewide meeting Thursday to discuss the waitlisted capital defendants. “We’re still in crisis; it’s just a different crisis. And now they can’t shift any more money around, so we could be facing an even greater crisis next year.”

Turkey/France: France Judicial Union Urges Macron To Require Erdoğan To Release Jailed Lawyers

The France Judicial Union has sent a mail to French President Emmanuel Macron, who is going to host Turkish autocratic President Recep Tayyip Erdoğan on Friday, and urged him to require the release of jailed lawyer Murat Arslan, the president of the now dissolved Association for the Union of Judges and Prosecutors (YARSAV) and his colleagues, ask for the presence of observers in future trials, the publication of the report of the European Committee for the Prevention of Torture on Thursday.

The France Judicial Union’s open letter to Macron is as follow:

Mr. President of the Republic,

You will receive tomorrow Recep Tayyip Erdoğan, President of Turkey.

We have already had the opportunity to alert you to the serious abuses that have hit this country since the failed coup d’etat of July 15, 2016, in particular the executive’s control over justice and the general degradation of the rule of law.

Under the guise of a state of emergency and the fight against terrorism, tens of thousands of people are victims of an arbitrary repression that continues to worsen and reaching all categories of the population: lawyers, journalists, teachers, academics , researchers … Thus at least 150,000 public officials have been dismissed, nearly 50,000 are in prison, more than 170 journalists are in detention, dozens of lawyers are incarcerated … As for our colleagues, judges and prosecutors, targets priority of this persecution, they are approximately 4,500 to be revoked and 2,500 imprisoned. This purge of justice aims to subordinate it to the executive power by stifling any desire for independence.

The Council of Europe, by awarding the fifth Václav Havel Human Rights Prize to our colleague Murat Arslan, president of the only independent judiciary association in Turkey, YARSAV, and detained for nearly 15 months, has both its extreme concern for the situation in Turkey and the importance of the independence of Justice in a democracy.
