Egypt/Italy: Regeni family lawyer detention extended (2)

The detention in jail of Ibrahim Metwaly, an Egyptian human rights activist and legal consultant to the family of Giulio Regeni, has been extended by 15 days, his lawyer Ezzat Ghonem told ANSA on Wednesday. Metwaly was arrested at Cairo airport on September while on the way to take part in a session of the UN Human Rights Council in Geneva.
Regeni was an Italian postgraduate student who was tortured and murdered in Egypt last year.
Egypt has denied suggestions its security forces, frequently accused of brutal repression of opposition, had anything to do with the death of Regeni, a 28-year-old who was researching Cairo street seller unions.

Turkey: Turkey Weaponised Interpol System To Persecute Critics, New Study Exposes

The Turkish government’s blatant abuse of the International Criminal Police Organization (Interpol) to persecute, harass and intimidate critics and opponents is much worse than one can imagine, new research by Stockholm Center for Freedom (SCF), an advocacy group that tracks rights violations in Turkey, has revealed.

The dubious and false charges filed by Turkey through Interpol to hunt down legitimate critics of Turkey’s autocratic President Recep Tayyip Erdoğan have in some cases succeeded in extraditing people from abroad, subjecting returnees to torture and ill treatment in notorious Turkish prisons. In other cases, people were stranded in third countries while travelling and were forced to fight the forcible return as they remained in detention facilities.

Turkish government also revoked travel documents and passports of many Turks without informing them and filed missing and lost reports with Interpol on their behalf when in fact no such request was made by passport holders. Erdoğan has also pursued his witch-hunt persecution against foreign companies that made a trade with almost 1,000 Turkish companies that were unlawfully seized and nationalized by the government on fabricated terrorism charges. Interpol mechanisms were used to gather information on foreign partners on absurd charges of terrorism which sparked a diplomatic crisis with other countries.

“The cases we have documented so far represent only the tip of the iceberg and show a deliberate, systematic and aggressive pattern in these abuses. Real storm has not hit the Interpol yet,” the President of SCF, has said.

“Considering the fact over 150,000 people faced legal actions in the last year alone and over 50,000 were formally arrested on alleged links to the Gülen movement with many had to flee the country to escape massive persecution, we’ll see a serious escalation of abuses of Interpol notices by Turkey as the politically motivated criminal cases move forward,” he added.

SCF report warns that Interpol, set up for cooperation among member states’ law enforcement agencies to arrest and extradite criminals and terrorists, is being undermined by the Turkish government, which is dealing a lethal blow to its integrity and credibility of the system.

The report calls for vigilance and better screening by Interpol on notices and urges further reform on filtering mechanisms. It joins recommendations made by the Parliamentary Assembly of the Council of Europe (PACE), the Organization for Security and Co-operation in Europe (OSCE) and the European Parliament on how to improve Interpol mechanisms and halt politically motivated notices and diffusions that violate Interpol’s own Constitution

Turkey: 16 Avukat 9 Gün Sonra Savcılıkta


Açlık grevindeki tutuklu eğitimciler Nuriye Gülmen ve Semih Özakça’nın, gözaltındaki 16 avukatı bugün savcılık ifadesine çıkarıldı.

Gülmen ve Özakça’nın yargılandığı davanın ilk duruşmasından iki gün önce 12 Eylül’de gözaltına alınan avukatlar Çağlayan’daki İstanbul Adliyesi’nde ifade veriyor.

Gözaltındaki avukatların isimleri şöyle: Barkın Timtik, Ebru Timtik, Behiç Aşçı, Aytaç Ünsal, Naciye Demir, Ezgi Çakır, Süleyman Gökten, Didem Baydar Ünsal, Ayşegül Çağatay, Şükriye Erdem, Engin Gökoğlu, Özgür Yılmaz, Ahmet Mandacı, Yağmur Ereren, Zehra Özdemir, Aycan Çiçek.

Halkın Hukuk Bürosu’nun İstanbul ve Ankara’daki ofisleri ve avukatların evleri 12 Eylül’ün ilk saatlerinde basıldı, avukatlar gözaltına alındı.

Halkın Hukuk Bürosu, twitter adresinden yaptığı açıklamada “Semih Ve Nuriye’yi avukatsız bırakmak istiyorlar. İstanbul ve Ankara Halkın Hukuk Bürosu basılıyor. Siz Semih ve Nuriye de kendi sonunuzu görüyorsunuz. Duruşmaya 2 gün kala avukatlarını gözaltına almanız bu yüzden” dedi.

Avukatların gözaltına alınması üzerine, 14 Eylül’deki duruşmaya iki yüze yakın avukat, baro başkanı eğitimcileri savunmak ve meslektaşları ile dayanışmak üzere  duruşma salonundaydı. 1030 avukat dava için ise yetki belgesi vermişti. (BK)

Maldives: Australian Lawyers for Human Rights (ALHR) Speaks out in Support of 56 Lawyers Summarily Suspended in Maldives After Calling for Judicial Reform

Australian Lawyers for Human Rights (ALHR) has joined a number of prominent international non-governmental organisations in calling on the Supreme Court of the Maldives to rescind the indefinite suspension of 56 lawyers who signed a joint petition raising concerns over the conduct of the judiciary and calling for judicial reforms and independence.

Following receipt of the petition, the Department of Judicial Administration published an announcement via Twitter stating that 56 lawyers would be indefinitely suspended from legal practice and investigated for obstructing the independence of the judiciary, remarking on the duties of the judiciary and attempting to influence the courts by preparing and signing an illegal document against the jurisdiction, procedures and decisions of the courts in violation of various laws, including the Constitution of the Maldives.

It is reported that the lawyers’ petition had raised several rule of law concerns including the Court’s alleged tendency to rule on critical matters late at night and suspend dissenting lawyers without due process. The UN Human Rights Council has previously raised concerns about violations of the right to a fair trial and allegations of political bias by the judiciary of the Maldives, however the Maldivian Government rejects all such criticism as unlawful infringements against the judiciary.

ALHR President Benedict Coyne said, “It appears that none of the 56 lawyers have been allowed to exercise their right to defend themselves or be heard before a professional disciplinary body and have no redress mechanism available to challenge their suspension.”



Hong Kong/China: Sorry shouldn’t be the hardest word for Junius Ho

Junius Ho Kwan-yiu has become one of the most recognisable faces in the legislature, but not necessarily for the right reason. News stories have the government-friendly lawmaker quoted as saying pro-independence activists should be “killed”. And he wasn’t misquoted.

Ho was doing so well with his campaign in recent weeks to pressure the University of Hong Kong to sack Occupy co-founder and law lecturer Benny Tai Yiu-ting, by building up momentum and a following. Then three words tripped him up: “Kill without mercy.”

The occasion was a rally attended by thousands against Tai and those advocating Hong Kong independence on university campuses. Afterwards, Ho was in an agitated state, being surrounded by reporters as he went into a tirade against their being ignorant, stupid and biased.

“If Hong Kong independence advocates are subverting the fate of a country … why not kill them?” Ho asked. “‘To kill them without mercy’ means we deplore wrongdoers like our enemies.”

You can watch the widely circulated clip on YouTube and his own defence on his online channel. I am absolutely convinced he didn’t mean actually killing or murdering such activists.

To put the Chinese phrase in context, he probably meant they should be charged, jailed, fired from their jobs, kicked out of school, and/or hounded out of town, all done without mercy.

But even if he didn’t mean it literally, the metaphor came across as overly aggressive and violent.
