Turkey: THE CRIMINALIZATION OF TURKISH LAWYERS

l’AED entend dénoncer la criminalisation des défenseurs des droits de l’homme en Turquie et en particulier la mise en cause personnelle de notre confrère Selçuk KOZAĞAÇLI, visant à déstabiliser la défense et à l’empêcher de mener à bien la défense des droits fondamentaux de ses clients Nuriye Gulmen and Semih Özakça.

L’AED en appelle à la vigilance de toutes les organisations d’avocats en Europe, pour s’assurer que notre confrère CK pourra mener sa mission d’avocat à bien, librement et sans intimidations de quelque nature que se soit.

The AED intends to denounce the criminalization of human rights defenders in Turkey and in particular the personal intimidation of our colleague Selçuk KOZAĞAÇLI, aimed at destabilizing the defense and preventing it from successfully defending the fundamental rights of his clients Nuriye Gulmen and Semih Özakça.

The AED calls for the vigilance of all lawyers’ organizations in Europe to ensure that our colleague Selçuk KOZAĞAÇLI will be able to carry out his duty as a lawyer, freely and without intimidation of any kind whatsoever.

SELÇUK KOZAĞAÇLI’NIN HEDEF GÖSTERİLMESİ HAKKINDA AÇIKLAMAMIZDIR:
NURİYE ve SEMİH’in BİNLERCE AVUKATI VAR
Bugün Star Gazetesi ve Sabah Gazetesi’nde eş zamanlı bir biçimde servis edilen haberler göstermiştir ki; (KHK zorbalığı ile kapatılan derneğimiz Genel Başkanı) Av. Selçuk Kozağaçlı’nın tutuklanmasına yönelik bir planın hayata geçirilmesi için düğmeye basılmıştır. Yine haber içeriğinden anlaşılmaktadır ki, bütün bu ucube yollara başvurulmasının gerisinde, Selçuk Kozağaçlı’nın Nuriye Gülmen ve Semih Özakça’nın avukatlığını yürütüyor olması yatmaktadır. Öncelikle, bu tür tehditlerle, kriminalize etme çabaları ile daha önce de karşılaştığımızı belirtir, zerre kadar kaygı duymadığımızı belirtmek isteriz. Aksine bugün Selçuk Kozağaçlı şahsında cisimleşmiş avukatlık pratiğimizin, üzerine bu derece pespaye kalem oynatılacak denli korku yaratması karşısında kıvanç duyduğumuz da bilinsin isteriz. Bununla birlikte, olası bir hukuksuz tutuklama yaşanmadan önce, bazı önemli hususlara ilişkin yanıtı aslında zaten belli iki temel soruyu kamuoyu ile paylaşmayı bir borç biliriz:
1- Haber, Avrupa İnsan Hakları Mahkemesi kararına atıf yapmaktadır. Tarafımızca ilgili başvuru 28.06.2017 tarihinde yapılmış olup, süreç tüm etkinliği ile devam etmektedir. Bizlerin, Avrupa İnsan Hakları Mahkemesi’nin belirlemiş olduğu usul hukuku gereği sessizliğini koruyup, her türlü hukuki yorum ve değerlendirmeyi kamuoyu karşısında yapmaktan kaçındığımız bir dönemde, ilgili gazeteciye, gerek AİHM ara kararları, gerekse Türkiye’nin savunmasından doğrudan pasajları gazetesine taşıyacak bilgileri kim servis etmiştir?
2- Selçuk Kozağaçlı ve diğer ÇHD’li avukatlar Nuriye Gülmen ve Semih Özakça’nın KHK zorbalığı karşısında direnişe geçtikleri ilk günden bu yana, henüz açlık grevi dahi başlamadan, avukatlıklarını yürütmektedir. Üstelik bu avukatlık, salt bir destekçilik düzeyinde değil ama doğrudan Türkiye Cumhuriyeti Noterliğince düzenlenmiş bir vekalet ilişkisine dayanmaktadır. Doğaldır ki, Derneğimiz’in geleneği olduğu üzere, hukuki tüm başvurular ile birlikte, müvekkillerimiz en başından bu yana bir gün dahi eylem alanında yalnız bırakılmamıştır. Peki Selçuk Kozağaçlı’nın hedef gösterilmesi için, özellikle 13.07.2017 tarihinin seçilmesinin gerisinde hangi nedenler yatmaktadır? Neden dün değil, bir ay önce değil ama bugün? Bu zamana kadar sistematikleştirilen hak ihlallerinin tespitine sadece bir durak kaldığı için mi? Yoksa akıl bulandırmak için mi?
Bu soruların yanıtı, tarafımızca çok iyi bilinmektedir. Hukukun yerlerde süründüğü bir ülkede avukatlık mesleğini sürdürmeye çalışan kişiler olarak, bu sorulara burada yanıt vermek, AİHM sürecini anlatmayı gerektireceğinden şuan için soruları sadece ortaya atmak ile sınırlı kalıyoruz. Zira bugün bitmemiş bir hukuk sürecinden söz etmek, bir hukuksuzluk haline gelecek olup, bizi hedef gösterenlerle, bu anlamda aynılaşmamakta sonuna kadar kararlıyız. Ancak yarın herşeyi, tüm belgeleri ile ortaya koyacağımızdan kimsenin şüphesi olmasın.
Buradan, Selçuk Kozağaçlı’yı krimanize ederek, tutuklama planları yapanlara da sesleniyoruz. Niyetiniz; Nuriye ve Semih’i avukatsız bırakmazsa, boşa kürek çekiyorsunuz. Nuriye ve Semih’in binlerce avukatı var. Kısacası, amacınızın boşa çıkacağını biz şimdiden söyleyelim, gerisi sizin kendi takdiriniz olsun.

USA: Disciplining Lawyers for Harassment and Discrimination: A Time for Change

The American Bar Association (ABA) has proposed a model rule to discipline lawyers who in the practice of law harass or discriminate, by speech or conduct, on the basis of race, sex, religion, national origin, ethnicity, disability, age, sexual orientation, gender identity, marital status or socioeconomic status. This proposed rule constitutes Rule 8.4(g) of the Model Rules of Professional Conduct (the Rule). Since each state drafts its own rules of professional conduct for lawyers, each state is free to adopt with or without amendments, or not to adopt any proposed rule.

This commentary urges state legislatures, state bars, and state supreme courts to seriously consider the adoption of the Rule and reject the misguiding assertions that the proposed rule violates the lawyers’ First Amendment rights of free speech, free exercise of religion, and freedom of association. The Nevada Supreme Court has scheduled a public hearing on July 17, 2017 to determine whether Nevada should adopt the Rule.

Rule’s Rationale

As a matter of policy, the Rule assures that the legal profession functions for all participants, including vulnerable groups, such as racial and sexual minorities and persons with disabilities. Inclusion and accountability, rather than exclusion and immunity, are the core values the Rule seeks to protect.

The Rule democratizes access to all persons involved in the legal profession to play their assigned roles without fear of harassment and discrimination. No lawyer –partner or associate, renowned or unknown — has any constitutional or statutory right in the practice of law to harass clients, witnesses, judges, court officials, support staff at the law firm, or colleagues on the basis of race, color, religion, national origin, gender, or any other unlawful classification. Nor does a lawyer have any constitutional or statutory right to engage in unlawful discrimination in the employment of new lawyers and staff.

Dear Mr. Tarek Hussien,

I have received news of your disappearance with a lot of grief and a little surprise. Yes little surprise for what has happened to you is a natural result of perusing the path of truth and believing in justice and freedom. Dear Tarek, what is happening to us is a result of our belief that law is a mission. There has always been free lawyers and the authorities has always been hostile to us either by arresting us or by draining the roots through opportunist lawyers or through tightening the grip of state security over the council of the lawyers’ syndicates.
Finally I hope to be assured of your safety and your life.

حكاية طارق هي حكاية شباب كتير شقى و تعب و حلم رغم القهر و الظلم و لكن العصابة الإرهابية اللي محتلانا مصممة تدفن مش حلمهم و بس لأ تدفن إنسانيتهم و مستقبلهم .

طارق شاب عنده ٢٣ سنة دلوقت قعد سنتين و شهرين يجري ورا أخوه في الأقسام و أماكن الحجز اللي برضه اتخطف من العصابة و هو طفل لغاية لما ربنا أراد و خرج .

بعدها طارق لانه عاش الظلم و حسه قرر يشتغل محامي يساعد المظلومين بعد ما اتخرج من كلية الحقوق و قد كان .

طبعا لانه كمان مع ثورة ٢٥ يناير و لانه رفض بيع الأرض كان لابد من القضاء عليه زيه زي شباب كتير .

طارق حسين اتخطف من بيته و #داعش فرع #مصر #الشرطة_البلطجيةلفقوله تهمة الإنضمام لجماعة #الإخوان و التحريض على التظاهر علشان أرضنا تيران و صنافير !!!

تخيلوا اللي يدافع عن أرضه يبقى خاين و إخوان !

عادي اتعودنا على فجر العصابة الإرهابية لكن يوصل انه يختفي إختفاء قسري بعد ما يلففوه كعب داير على أقسام مصر تحت بند انه عليه ١١ قضية بالكذب منها قضية تبديد عفش الزوجية و هو كان وقتها في الإعدادية !!!

بعد ما المحامين الجدعان لفوا و أظهروا ان سجله خالي و نضيف تماما طلعوله قضية جديدة بس المصيبة انه بيتحاكم جوه القسم حسب ما وصل للمحامين يعني هيحددوا كمان مدة حبس من غير محكمة !!!

طب قسم ايه منعرفش لان مرة يقولوا في شبرا فأهله يروحوا مع المحامين يعرفوا انهم بيلففوه كعب داير و طبعا بيضرب و يتنكل بيه و بعدين يروحوا قسم عين شمس مش موجود يروحوا تاني يوم يقولوا إتنقل الجيزة و يرفضوا يسمحوا للمحامين يشوفوه كحق أصيل له و يطلعوا لأهله شنطة فيها هدومه متقطعة و آخر مرة رجعوا قالوا موجود بس ما ينفعش تشوفوه و بعدين اترحل و منعرفش فين ! !!

يعني بالفعل طارق كده مختفى لان محدش شافه و لا يعرفوله مكان !

في أي بلد بتحترم آدمية مواطنيها و تحت أي قانون ممكن ده يحصل و إزاي ؟!

البجاحة و البلطجة و الإرهاب بقوا علنا و عيني عينك لتوصيل رسالة ان اللي هينطق أو يطلع نفس ده مصيره !!!

مصيره انه يختفى و إن كان عاجبكم لإرساء قاعدة البجاحة العسكرية إننا مش بيهمنا حد و هو ده اللي هيتعمل في كل بتوع يناير أو اللي بيقلدهم لو ما بطلوش يتكلموا أو يعترضوا مهما حصل !!!

يا عالم في الدول اللي بتحترم آدمية البشر حتى أعتى عتاة المجرمين لهم كل الحقوق في زيارة الأهل و العلاج و طبعا في حق وجود ممثل قانوني لهم و قبل أي حاجة حق الشفافية و عدم تلفيق التهم .

أيا عصابة العسكر السفلة لقد بلغ الظلم مداه و ليسقط مسمى نظامكم الذي جرف كل معنى لكلمة إنسانية و أسقط بل لغى معنى دولة القانون .

Kenya: Shock as KRA lawyer found dead, body dumped on road

A lawyer attached to the Kenya Revenue Authority (KRA) customs department was on Wednesday morning found murdered and is body dumped along Mombasa Road.

Mr Jared Ratemo’s body was discovered early morning by motorists who alerted the police from Embakasi Station. His identification documents were found on him.

Confirming the incident, Embakasi DCIO Peter Ndubi said investigations into the death of the lawyer had been initiated. He refuted claims that he had been shot.

“We are still investigating the circumstances under which he died, but we suspect he may have been murdered elsewhere before his body was dumped there,” Mr Ndubi said.

The Lawyer’s brother, Harun Mokua said Mr Ratemo, a father of three, was abducted on Tuesday, days after he had travelled to Nairobi to solve undisclosed tax issues.

 

MOST FOUL MURDER

A few hours before he disappeared, Mr Ratemo was to travel back to Mombasa where he is stationed, aboard a 9.30am flight.

It is not clear yet, whether he went to his office in Ngara that morning, as he had planned.
An email notifying staff about Mr Ratemo’s death was circulated at the Authority, with the HR department saying that the body was taken to the Chiromo Mortuary.

“Until his death, he was serving as a supervisor in customs and Border Control Department Consol base CFS in Mombasa,” the email said.

Lawyers have condemned the killing and called for speedy investigations.

In statement, the Law Society of Kenya (LSK) President Isaac Okero said: “The circumstances of Ratemo’s demise point to a most foul murder at the hands of people he was familiar with.

“This incident coming barely a month following the brutal murder of another lawyer, Ronald Lubya and one year following the brutal murder of lawyer Willie Kimani has shaken the society to its core.”

Malaysia: Stop intimidating human rights lawyers — Joint Action Group for Gender Equality

The Joint Action Group for Gender Equality (JAG) urges the Attorney General’s Chamber to drop the charge of “obstructing a public servant” against human rights lawyer Siti Kasim. We also call on the Malaysian government to end discriminatory laws, policies, and practices against the transgender community, and further comply with international human rights standards.

Drop the charge against Siti Kasim

Siti Kasim is a prominent woman human rights lawyer known for her advocacy for indigenous, women’s, and LGBT rights. On 13th June 2017, she was charged for allegedly “obstructing a public servant” under Section 186 of the Penal Code.

This occurred after she questioned the legitimacy of a raid conducted by Federal Territories Islamic Affairs Department (Jawi) officers on a private transgender event. Siti Kasim had identified herself as a lawyer and was conducting her professional duties as an advocate and solicitor at the event.

On 23rd June 2017, Siti Kasim pleaded not guilty to the charge and was released on bail. The next court hearing is scheduled for 22nd August 2017. If convicted, she faces up to two years in prison, a maximum fine of RM 10,000 or both.

The charge against Siti Kasim is an affront to the independence of the legal profession. The charge would set a chilling precedent that undermines lawyers’ ability to defend their clients’ rights without fear of arrest and prosecution. The independence of lawyers to freely conduct their professional duties is fundamental to protecting human rights, upholding the rule of law, and administering justice.

We urge the Attorney General’s Chamber to immediately and unconditionally drop all charges against Siti Kasim.
