Turkey: LIBÉREZ IMMÉDIATEMENT TANER KILIÇ

Les Avocats Européens Démocrates (AED), réunis en Bureau à Amsterdam dénoncent la campagne répressive contraire aux Droits Fondamentaux du gouvernement turc contre les défendeurs des Droits de l’Homme et demandent le remise en liberté immédiate de leur confrère arrêté le 6 juin dernier.

Taner Kiliç est accusé, sans la moindre preuve, d’être membre de l’organisation Fethullah Gülen, qualifiée de terroriste par les autorités turques. Il apparaît clairement que le terrorisme est un argument largement utilisé par le régime de l’AKP de Recep Tayyip Erdogan pour détruire la démocratie et convertir le régime truc en une dictature déguisée en Démocratie formelle.

Le régime turc veut étouffer toutes les voix des opposants et pour cela s’attaque aux personnes qui dénoncent la fragilité de la démocratie existant en Turquie. Taner Kiliç œuvrait pour la défense des droits et libertés bafoués par les autorités. Il n’est ni un terroriste ni un criminel. Nous demandons dès lors aux autorités turques de le libérer et d’abandonner les charges infondées et arbitraires retenues contre lui.
L’AED exprime de graves préoccupations concernant les violations des droits de l’homme commises à l’encontre de membres de la profession d’avocat en Turquie. Les avocats devraient être en mesure d’exercer leurs fonctions légitimes sans crainte pour leur vie, pour leur liberté ou pour leur sécurité. L’AED exhorte le gouvernement turc à se conformer aux lois internationales relatives aux droits de l’homme, y compris les Garanties liées à l’exercice de la profession d’avocat contenues dans Principes de base relatifs au rôle du barreau, adoptés par le huitième Congrès des Nations Unies à La Havane (Cuba) en septembre 1990.
Dans ce contexte et après quelques missions d’observation sur le terrain en Turquie, nous considérons qu’il n’existe pas de «système de justice pénale» actif et efficace en Turquie.

Russia: Russia opposition leader detained ahead of mass protests

Alexei Navalny, a Russian lawyer and activist known for establishing the Anti-Corruption Foundation [advocacy wevite], was arrested outside his home in Moscow on Monday, according [TASS report, in Russian] to a state-media new report. His arrest, and almost immediate conviction for “organizing an unauthorized rally,” occurred shortly before an anti-corruption protest targeting President Valdimir Putin and the Kremlin [TASS report, in Russian] was scheduled to take place on Tverskaya, a four-lane avenue and main thoroughfare in Moscow. Navalny was sentenced to a 30-day prison term. According to state-run media [TASS report, in Russian], Moscow officials had approved a protest in a public square just outside the city’s center district, and Navalny’s arrest was the result of a post he had made the night before [YouTube video, in Russian] the protest redirecting protesters. Tweeting from his verified Twitter account shortly after his arrest on Monday, Navalny’s wife Yulia said [Tweet, in Russian] the protest in the Tverskaya area would proceed as planned. The protest in Moscow and similar ones throughout Russia resulted in more than 1,000 arrests.

This is not the first time Navalny has trouble with the Russian legal system. Navalny was arrested [JURIST report] in March at a demonstration protesting the alleged corruption of Russian Prime Minister Dmitry Medvedev [official website]. In February he was convicted and sentenced [JURIST report] for embezzlement. That same month, the European Court of Human Rights ordered [JURIST report] Russia to pay more than €63,000 for arresting Navalny multiple times between March 2012 and February 2014. In May a Moscow court declined [JURIST report] authorities’ request to convert Navalny’s suspended sentence into a prison term. He had been convicted of fraud and sentenced to three-and-a-half-years suspended sentence. In 2015 Navalny was handed [JURIST report] a 15-day prison sentence for distributing leaflets attempting to publicize an “anti-crisis” demonstration. In 2014 Navalny and his brother, Oleg Navalny, were charged [JURIST report] with embezzling approximately 30 million rubles (USD $518,000) from French cosmetics company, Yves Rocher Vostok, and the Multidisciplinary Processing Company by a fraud scheme between 2008 and 2012.

The curious case of CS Karnan: How a HC judge defied Supreme Court and went missing

In a first, High Court judge CS Karnan became the only judge to retire while absconding. He has been evading the police since May 9 after the Supreme Court sanctioned an arrest warrant against him, sentencing him to a six-month jail term. The Supreme Court had held Karnan in contempt of court following a series of defiant counter-orders he had repeatedly issued against the apex court.

Justice Karnan was originally slated to retire on June 11. Since he has been absconding, he has missed the formal farewell which is usually given to every retiring high court judge.

The end of his career as a HC judge comes even as Karnan has had a chequered history of fights with fellow judges of Madras High Court where he was initially posted.

Karnan, a Dalit, has been in the crosshairs of the Supreme Court judges for some time now for going against the edicts of the apex court.

China: Chinese Authorities ‘Appoint’ Government Lawyer For Detained Attorney Wang Quanzhang

Authorities in the Chinese capital have warned off a lawyer hired by the family of detained human rights attorney Wang Quanzhang, saying that he will be represented by a government-appointed lawyer instead.

Wang has been held at an unknown location without trial or access to a lawyer or family visits for nearly two years after being detained in a nationwide July 2015 police operation targeting rights lawyers and associated activists.

Recently, the Beijing branch of the China Law Association contacted his defense attorney Yu Wensheng to inform him that he is no longer instructed to act for his client.

“The Tianjin branch of the Law Association has appointed a lawyer, but we don’t yet know who the lawyer is,” Yu said in a recent interview. “But I and [fellow defense attorney] Cheng Hai want to stand up for our right to represent him.”

“We plan to go to Tianjin, because according to the rules, I and Cheng Hai are his lawyers, and we can only have our instructions terminated by Wang Quanzhang himself,” he said.

Yu said the authorities are likely making it as hard as possible for detained lawyers like Wang to defend themselves.

“If there’s any point to it at all, then it’s to do with stability maintenance,” he said.

Cheng said the Law Association is working with the judicial affairs bureau to control Wang’s choice of lawyer.
