India: Court review: Finally a film on the Indian legal system with more insight than ‘tareekh pe tareekh’

September 23, 2015

An ageing folk singer-performer and Dalit activist, Narayan Kamble (Vira Sathidar) is arrested during a performance in a Mumbai slum. The charge: allegedly abetting conservancy worker Vasudev Pawar’s suicide. Kamble, according to the police, performed an explosive song which incited Pawar to kill himself by drowning himself in a manhole. Perhaps because of the total lack of drama in the way all this unfolds and the matter-of-fact nature of the arrest, the absurdity and the irony of the charge and Kamble’s arrest is biting.

Reality is surreal business in Chaitanya Tamhane’s award-winning film, Court. Inspired perhaps by the state witch-hunts of dissenting activists like Dr Binayak Sen, Vilas Ghogre, Vernon Gonsalves, Arun Ferreira, and members of Kabir Kala Manch, Tamhane’s film languidly moves through the workings of a court case in Mumbai.

Slowly, it unravels the social reality of the conservancy worker and the blatant, political arrests in lower courts. Why did a “gutter-cleaner” enter a manhole without any equipment? Was it because, as the state suggests, that Pawar was driven to kill himself because he heard Kamble’s songs? What kind of equipment is he given by the municipality? What kind of a life does his profession afford him?

And then there’s the social activist-cum-singer Kamble, who actually does want to write a song about suicide — not because he wants to incite people to such acts, but because nothing else communicates the hopelessness he sometimes feels about Dalit lives. Sathidar, who plays Kamble, should know. He’s a human rights activist in real life and editor of the radical Nagpur-based publication, Vidrohi. The songs he sings as Kamble were voiced by Sambhaji Bhagat, a friend of Vilas Ghogre, the Dalit poet and activist who committed suicide to protest the 1997 killing of Dalit residents of Ramabai Colony, in Mumbai.

Much of Court is akin to a real life courtroom, where cases often unfold without drama.

Egypt: LIKELY PRESIDENTIAL CANDIDATE IN EGYPT ORDERED DETAINED

Khaled Ali, 45, a prominent human rights lawyer who ran in Egypt’s 2012 election, has suggested he might run against President Abdel Fattah al-Sisi in a presidential election slated for 2018.

At the time, notorious lawyer Samir Sabry, well-known for his multiple lawsuits in the name of morality, filed a complaint with the public prosecutor against Ali for “committing a public act of indecency”.

His questioning will be resumed on Wednesday when a prosecutor will decide whether to release him on bail or extend his detention.

A former Egyptian presidential candidate and rights lawyer who challenged the government for handing over islands to Saudi Arabia was detained today on suspicion of illegal political work, a judicial official said.

The prosecutors ordered him detained for 24 hours after he refused to answer questions before reviewing the evidence brought against him, including a video clip of the alleged incident. “They could have gotten him on a variety of other charges, but this?” said Taher Abo el-Nasr, one of at least 60 lawyers who waited for Ali to arrive at the prosecutors’ office on Wednesday.

Ali, who has suggested he might run against President Abdel Fattah el-Sisi in an election slated for 2018, was the main lawyer to bring a case against the government after it agreed to hand over two Red Sea islands to Saudi Arabia in April a year ago. Policemen took Ali from the court complex he was being questioned into to a police station where he will be kept overnight.

Ali’s defence team paid a bail worth 1,000 Egyptian pounds ($55) after his release was ordered, his lawyer said.

UAE/Prix Ludovic Trarieux: Jailed UAE lawyer awarded major human rights prize

May 27, 2017

According to Amnesty International, UAE lawyer Mohammed al-Roken's trial

A UAE lawyer sentenced to 10 years in 2013 for plotting against the regime was on Saturday awarded a major human rights award.

Mohammed al-Roken was among 69 people jailed on charges of conspiring to overthrow the government following a mass trial criticised by rights groups.

Awarding him the Ludovic Trarieux Award, the prize committee said Roken had devoted two decades to defending fundamental freedoms.

A former head of the UAE Jurists’ Association, Roken, 54, was arrested in July 2012, after taking on the defence of several government opponents, including seven islamists.

The prize jury lamented that Roken’s trial had gone ahead behind closed doors and demanded his immediate release.

Amnesty International’s Middle East and North Africa deputy director at the time staunchly criticised both the proceedings and the verdicts.
