Turkish Judge and President  of the Turkish Judges Syndicate, Mr Mustafa Karadag, has been under disciplinary proceedings/investigations by the High Council of Judges and Prosecutors due to his support for journalist Can Dundar and Erdem Gul. Pursuant to its bylaws, the Syndicate supports judicial independence, democracy, a secular and social state governed by the rule of law as required by essential principles.

Democratic Republic of Congo: Procès Muyambo l’audience renvoyée au 12 avril, les avocats parlent d’un procès politique

Le président national de la SCODE, Jean-Claude Muyambo Kyassa, n’a pas été fixé sur son sort, le mercredi 5 Avril 2017, tel que fixé dans l’ordonnance du Président du Tribunal de Grande Instance/Gombe, Roger Songambele.

Pour motif, les juges ayant siégé dans cette affaire ont fait remarquer, devant les chevaliers de la plume et du micro, que le dossier opposant l’ancien ministre des Affaires sociales, Jean-Claude Muyambo, au Grec Stoupis, est “volumineux”, et qu’il leur faudra du temps pour examiner pièce par pièce ce dossier, afin de rendre un jugement équitable. Pourtant, la composition avait demandé une prolongation du jugement depuis le 28 mars, date à laquelle la cour devrait rendre son prononcé dans cette affaire.

Les vraies raisons de la remise ne résident pas là, selon les avocats du bâtonnier ainsi que d’autres sources concordantes au Palais de Justice. On soutient que les violons ne s’accordent pas entre les juges ayant siégé dans cette affaire. « Ces derniers subissent des pressions pour que Muyambo soit condamné à une lourde peine. Ce que refusent les juges ayant siégé dans l’affaire. Car, selon eux, la vérité doit être connue dans cette affaire, et Muyambo fixé sur son sort », selon les avocats.

C’est pour dire que « le président du Tribunal de grande instance de la Gombe, Roger Songambele, et Masudi Mpiye, d’après le collectif d’avocats de Muyambo conduits par Me Georges Kapiamba, veulent condamner Muyambo à cinq années de servitude pénale tel que requis par le ministère public à la dernière audience du 20 mars », a fustigé Georges Kampiamba, clamant l’innocence de son client. Pour cet avocat, Muyambo est en prison suite à ses convictions politiques.

Eski HSYK Genel Sekreteri'nin iki kolu kırılıp tek kişilik hücreye konuldu!

6 Kasım’da Malatya’da kimlik kontrolü sırasında yakalanan ve 23 Kasım 2016’da tutuklanan eski HSYK Genel Sekreteri ve Kütahya Savcısı Muzaffer Bayram, Keskin Cezaevinde iki kolu kırık olmasına rağmen tek kişilik hücrede tutuluyor.

Şahsi ihtiyaçlarını dahi karşılayamayan Bayram’ın ve ailesinin cezaevi yönetimine verdiği dilekçeler işleme konulmuyor.

CHP Milletvekili Barış Yarkadaş, daha önce Savcı Bayram’ın durumu ile ilgili açıklama yapmıştı.

Yarkadaş açıklamasında şunları söylemişti:

“Sayın Bozdağ, Meclisi fesh edecek olan anayasayı kabul ettirmek için uğraşmaktan, cezaevlerinde ne olup bittiğine bakamıyor. Oysa ki; cezaevlerindeki hak ihlalleri katlanılmaz boyutlara ulaştı. Bakın sadece bugün iki şikayet geldi bana. Bunlardan biri Ankara Keskin Cezaevi’nden. Tutuklu Savcı Muzaffer Bayram’ın her iki kolu da bileğinden kırılmış. Buna ilişkin rapor da var. Ancak Muzaffer Bayram, buna rağmen hücrede tek başına tutuluyor. Bu kabul edilebilir bir uygulama değil. Savcı Muzaffer Bayram’ın eşi durumu dilekçeyle bana da aktardı. Tek istekleri tutuklu savcıya bir koğuş arkadaşı verilmesi. Eğer bu yapılırsa, iki kolu da bileğinden kırık olan Muzaffer Bayram, günlük ihtiyaçlarını görebilecek. Ancak ne yazık ki; ailenin dilekçeleri cevapsız bırakılıyor. Savcının can güvenliği dolayısıyla tek başına tutulduğu şifahi olarak söyleniyor.”

Ancak Yarkadaş’ın açıklamasına rağmen savcının durumunda bir değişiklik olmadığı öğrenildi. İki elini de kullanması mümkün olmayan savcı hala tek kişilik hücrede tutuluyor.

India: TN Lawyer Allegedly Hacked to Death Over Derogatory Facebook Posts

Chennai Police said on Thursday said that a lawyer was murdered in Kancheepuram district over a dispute on Facebook.

On Wednesday night, a gang of five men allegedly hacked to death M Chandrasekar in front of his house in Vellaikulam, around 90km from Chennai, according to a report by A Selvaraj in The Times of India.

An investigating officer said that Assistant Superintendent of Police N Shreenatha, along with his team, have nabbed the culprits, but it is not clear how many have been detained.

The officer added that a local thug in Kancheepuram is believed to have masterminded the murder.

There was an argument between Chandrasekar, who is also a DMK worker and a repeat offender Thaniga and his brother over local body polls, the report states.

China: Wife of 709 Lawyer Fears Arrest

Below is a message sent today by Wang Qiaoling (王峭岭), wife of lawyer Li Heping (李和平), who has been in detention since July 2015 in the 709 Crackdown and is facing “subversion of state power” charges. She reports that in recent days cameras are mounted in front of her apartment building tracking her movement, and she is being followed by several security policemen. She fears that she will be arrested soon.

Wang, who has been an active advocate for the release of her husband and of other 709 detainees, is the recipient of the 2016 Franco-German Prize for Human Rights.

In recent days, I’ve had a strange feeling as soon as I stepped outside my house. It’s been like this every day. But it was yesterday when I discovered that there’ve been more and more cameras pointed at me. By my count, outside our apartment building, at the entrance to the basement, etc., there are, all of a sudden, three to four additional cameras. Last August, the very day after I moved to Song Zhuang [a suburb east of Beijing], I was locked out of the building by the landlord. Later, I rented a place in the Daxing Junyue International Neighborhood, and had a peaceful half year without being evicted. These past few days, these cameras have been recording my every move.

The Observatory for the Protection of Human Rights Defenders, a partnership of the World Organisation Against Torture (OMCT) and FIDH, has received new information and requests your urgent intervention in the following situation in Egypt.

New information:

The Observatory has been informed by reliable sources about the disciplinary harassment of Judges Assem Abel Gabbar, former Deputy Chief Justice of the Court of Cassation, and Hesham Raouf, who sits at Cairo’s Appeal Court and former Justice Minister’s assistant, to the ‎Disciplinary Council to consider their dismissal for “engaging in political activities” during their participation in the revision of the anti-torture bill.

According to the information received, on March 30, 2017, the Supreme Judicial Council referred the two judges to the Disciplinary Council for their removal from office on accusation of “engaging in political activities”. Messrs. Assem Abel Gabbar and Hesham Raouf had collaborated with Mr Negad El-Borai, human rights lawyer and Director of the “United Group – Attorneys-at-law, Legal Advisors” (United Group)[1], in the drafting of an anti-torture bill. The first hearing is scheduled to take place on April 24, 2017.

The Observatory recalls that Mr. El-Borai is facing criminal charges of “establishing an unlicensed entity with the intent of inciting resistance wards to the authorities”, “implementing human rights activities without license”, “deliberately spreading false information with the purpose of harming public order or public interest” and “receiving funds from the National Center for State Courts (NCSC)” (see background information) in an investigation regarding the same anti-torture activity.

The Observatory considers that the aforementioned investigation and disciplinary harassment will further undermine human rights defenders’ efforts to fight against torture in the country.
