Day of the Endangered Lawyer/China: Den Haag doet te weinig voor bedreigde advocaten in China

Volgende week, op 24 januari, wordt er voor de zevende keer de Dag van de Bedreigde Advocaat georganiseerd. In Nederland spreekt het vanzelf dat advocaten niet door de regering in hun werk worden belemmerd. De onafhankelijkheid van de advocatuur – een van de kernwaardes vastgelegd in de Advocatenwet – is er immers ook ter bescherming van advocaten tegen beïnvloeding door de regering. Ook op internationaal niveau is dit een van de uitgangspunten voor het goed functioneren van de rechtsorde.

In de Basic Principles on the Role of Lawyers van de Verenigde Naties uit 1990 wordt onder meer vastgelegd dat de regering van elke lidstaat ervoor moeten zorgen dat advocaten hun professie naar behoren kunnen uitoefenen, zonder bedreiging, belemmering, intimidatie of beïnvloeding en zonder vrees voor arrestatie of strafvervolging. Maar in veel landen staat het werk van advocaten onder druk. De Stichting Advocaten voor Advocaten zet zich wereldwijd in voor onderdrukte of bedreigde advocaten en vraagt al jaren aandacht voor de situatie van advocaten in landen als Cambodja, Honduras, Rusland of Turkije.

China intimideert advocaten

Dit jaar is de focus van de Dag van de Bedreigde Advocaat gericht op China, waar advocaten die politiek gevoelige zaken doen, stelselmatig worden bedreigd en geïntimideerd. Volgens Advocaten voor Advocaten variëren de zaken die de Chinese regering dwars zitten “van het verdedigen van Tibetaanse demonstranten en aanhangers van de Falun Gong tot slachtoffers van het melkpoederschandaal en inwoners van Peking die in verband met de stadsuitbreidingen ten tijde van de Olympische Spelen uit hun huis werden gezet.”

India: The Arrest Of Advocate Murugan And Charging Him With UAPA Is Condemned

Committee for Protection of Democratic Rights – Tamil Nadu, (CPDR-TN) strongly condemns the arrest of Advocate Murugan, Secretary Centre for Protection of Civil Liberties (CPCL), on 8th January by the Tamilnadu Q branch police. The police had gone to his house in the early morning 4 o’clock, in the pretext of search operations with the search warrant order from Karur district magistrate. And the Q branch police arrested him under Unlawful Activities Prevention Act (UAPA) sections 18(a), 18(b), 20 and 38 & IPC 120(b) for allegedly arranging shelter for two women Maoists who were arrested in Karur five months before. And they took with them all the case documents , files, preparations for final arguments for some cases, some common books and Homeopathy medicines & medical book.

Advocate Murugan has been in the civil rights activity for more than 10 years and has been in the forefront taking up the cause of political prisoners cases including that of maoists. He has also been representing the two women maoists arrested five months before in Karur. The court had issued search warrant of Advocate Murugan, in compliance with the Q branch, in the Karur case. The order issued by the district magistrate should have ordered restraint on the search, as he must know that advocates , who are regarded as officers of the court, are part and parcel of the court and play vital roles in the administration of justice, are bound to be in possession of all documents for reference and defence of their clients who are accused before court of law.

Section II of Bar Council of India 1975, in part VI chapter II provides for duties of advocates towards his clients. Rules 15 and rules 19 has relevance to the same.

The State closes in! Targets human rights activists engaged in providing legal aid to political prisoners.
Janakeeya Manushyavakasha Prasthanam (People’s Human Rights Movement) Kerala State president comrade C. P. Rasheed and activist Hariharasharma were arrested yesterday in Tamil Nadu as they went to meet jailed Maoists Shyna and Anoop. This follows an earlier action a few months back, when Adv. Murugan, a human rights activist and lawyer appearing for Maoist accused, had been arrested alleging that he was aiding Maoists. He is still in jail. In December a fact finding team comprising Advocates and journalists, who went to Bastar region in Central India were arrested and the allegation was the same, aiding the Maoists. They too are still in jail.
Yesterday’s arrests were on the absurd charge that the human rights activists were trying to hand over a PEN-DRIVE to the prisoners. As pointed out by Adv Thushar Nirmal Sarathy, General Secretary of the Janakeeya Manushyavakasa Prasthanam, “Any one can understand that the case against Rasheed and Harihara is a false one. The accusation is that they tried to hand over a pen drive. That too to the prisoners, who do not even have access to books, let alone a computer. This is an attack to suppress the activists and advocates who are helping political prisoners including Maoists fight the legal battle,”

24 janvier 2017 : 7e journée de l’avocat en danger - Dénonciation de la situation des avocats en Chine

Mise en place depuis plus de sept ans par plusieurs organisations d’avocats, la journée de l’avocat en danger permet de mobiliser chaque année les autorités en attirant l’attention sur la situation d’avocats particulièrement menacés dans leur pays, dans le cadre de l’exercice de leur fonction. Cette année, la journée de l’avocat en danger est consacrée à la situation des avocats en Chine. Le CCBE avait attribué son prix des droits de l’Homme 2015 au cabinet d’avocats chinois Feng Rui, particulièrement touché par les attaques menées contre les défenseurs des droits de l’Homme.

Après la situation des avocats en Iran, en Turquie, aux Philippines, au Pays basque et au Honduras, la journée de l’avocat en danger sera cette année dédiée à la situation des avocats en Chine. Profession risquée notamment pour les avocats des droits de l’Homme « en l’absence d’un système judiciaire indépendant, les quelque 300 000 avocats en Chine font l’objet d’un suivi étroit par les autorités dans leur travail » assure le site « dayoftheendangeredlawyer.eu ». Il rappelle notamment qu’en 2016, de nouvelles mesures administratives pour les cabinets d’avocats publiées par le ministère de la Justice affirment « que les cabinets d’avocats doivent soutenir la direction du Parti communiste chinois et la primauté du droit socialiste ». Le système d’inspection annuel chinois est également très controversé. En effet, le bureau de la magistrature examine minutieusement chaque dossier, afin d‘autoriser ou non les avocats à exercer. Les dossiers dits « politiquement sensibles », concernent bien évidemment les affaires liées aux droits de l’Homme et/ou à l’État de droit. « Dans leur pratique quotidienne, les avocats sont également victimes de harcèlement et d’intimidation par les agents de la sécurité publique, une branche spéciale de la police et par les tribunaux » souligne l’organisme.

India: Open Letter To Chief Justice Of India On The Arrest Of Activists Of The Telangana Democratic Front

In continuation with our previous two petitions dated 22nd February 2016 and 26th February 2016, we wish to draw you attention to the consistent erosion of rule of law and constitutional freedoms in Chhattisgarh in the wake of continuing attacks on civil rights defenders by the state police and administration in close collusion with the vigilante groups like the Samajik Ekta Manch and AGNI. In the most recent case of attack, on 25th December, 2016 a 7 member fact finding team was arrested by the Telangana police at Dummaguddem village of Bhadrachalam district at 6 pm and handed over to the Sukma Police (Chhattisgarh State).

The fact finding team consisted of members of the Telangana Democratic Front (TDF). TDF was formed recently to fight for the rights of the people of Telangana state. The members of the fact finding team are Chikkudu Prabhakar (Advocate), Bhalla Ravindranath (Advocate, High Court, AP), Durga Prasad (Journalist), Duddu Prabhakar (President, KNPS, AP), Rajendra Prasad (Student leader, Telangana Vidyarthi Vedika), Nazeer (Student leader, Telangana Vidyarthi Vedika) and Ramananda Laskhme (Student organizer), all seven are persons of public repute and have been committed to the cause of democratic rights for decades.The team was on its way to investigate complaints of human rights violations suffered by adivasis of Chhattisgarh at the hands of security forces. The immediate context of the fact finding related to the murder of a 13 year old tribal boy Somaru Pottam. On December 16, Bijapur police had announced that a team of security forces had killed an ‘unidentified and armed Maoist in uniform’ in Metapal in a gun battle. The residents of Metapal, however, later recognized him as Somaru Pottam, following which Pottam’s parents petitioned the High Court.

The Sukma police has alleged that the team members were in possession of demonetized currency and had come to aid the Maoists by exchanging the old currency on their behalf. The team was charged under sections 8(1), (2) and (3) of the Chhattisgarh State Public Security Act, on charges of support to Maoists and for possession of banned literature. On 3rd January the Dantewada district court rejected the bail application in the case.

Pakistan: Lawyers told to boycott courts against arrest of colleague in child maid case

The outgoing secretary of the District Bar Association Islamabad on Monday gave a call to boycott courts against the arrest of a lawyer in connection with the child maid torture case.

A notice issued by the association secretary, Zafar Khokhar, whose term is expiring by the weekend, asked the lawyers not to appear before any court on January 10 against the arrest of Raja Zahoor Advocate, the lawyer of Tayyaba’s parents.

Mr Zahoor played a key role in making a compromise between the parents of Tayyaba, 10, and the additional district and sessions judge (ADSJ), who is accused of torturing her.

Though Mr Zahoor was the lawyer of Tayyaba’s parents, he argued the case to secure the bail of the spouse of the ADSJ. The lawyer submitted the compromise deed signed between the ADSJ, the parents and an aunt of the girl to another ADSJ, Raja Asif Mehmood.
