Turkey: 9 LAWYERS DETAINED IN URFA

210 members of the opposition party HDP have been in custody for the last 9 days in Urfa a city located in the south-east Turkey. 9 of them are lawyers. They are kept in a sports hall. The names of the lawyers are: Özkan Gören, Bülent Özışık, Velat İzol, Cemo Tüysüz, Gülay Koca, Serdar Gökhan, Mevlüt Güneş, Aslan Veysanoğlu and Sait Dağ. There is only one toilet in the sports hall for the use of the detainees. They can take the shower at the same place. No serious health control is made by the doctors. L’Observatoire international des avocats en danger (OIAD) s’inquiète de la situation de Monsieur Eric IGA IGA, avocat au Gabon, victime d’une intrusion à son domicile, probablement en représailles pour son activité légitime d’avocat.

D’après les informations dont dispose l’OIAD, publiées par plusieurs médias et par l’Institut des droits de l’Homme des Avocats européens (IDHAE), des individus non-identifiés, se présentant comme des membres des forces de défense et de sécurité, se seraient introduit chez Monsieur Eric Iga Iga dans la soirée du jeudi 8 décembre 2016 et auraient procédé à une fouille de son domicile.

Alerté par la présence d’un véhicule inconnu stationné devant chez lui, Monsieur Iga Iga aurait eu le temps de fuir l’arrivée de ces individus. Ses proches et ses collaborateurs sont ensuite restés sans nouvelle de lui pendant plusieurs jours jusqu’au mardi 13 décembre lorsque Monsieur Iga Iga a pu faire savoir qu’il avait pu trouver refuge dans l’enceinte d’une Ambassade étrangère à Libreville.

Tout laisse penser que l’irruption de ces hommes au domicile de Monsieur Iga Iga serait liée à sa qualité d’avocat et au fait qu’il fasse partie de l’équipe de défense de l’opposant politique et ancien candidat à la présidentielle Jean Ping, pour lequel il a notamment assuré le suivi des recours judiciaires devant la Cour constitutionnelle après la présidentielle contestée d’août dernier.

Monsieur Iga Iga demeure dans une situation extrêmement dangereuse tant que toute la lumière n’aura pas été faite sur l’identité de ces hommes et leurs motivations et que les autorités n’auront pas mis un terme aux agissements de ces individus. La menace que cette intrusion illégale à son domicile fait peser sur Monsieur Iga Iga et ses proches sont de nature à l’empêcher d’accomplir ses obligations professionnelles, notamment à l’égard de son client Monsieur Jean Ping.

Yesterday, the director of our association, our friend, our comrade Barkın Timtik has been arrested by the investigating judicial authority in charge. We do not have a mind of making a juridical debate on this ‘unlawful’ arrest. In these days, in which there is a lack of law and justice, not only the Media but also the Jurisdiction has became the spokesman of the government, the lies and the manipulations have prevailed against the truth and the merit, we blame debating on law, and consider this as a humiliating thing. So, we redact our previous statement; the Director of our Association, our friend and comrade Barkın Timtik has been captured collaboratively by the prosecutors and the judges who are afraid even their own shadows and, know nothing except obeying the fascism. Of course, we are not sad but angry. Because we know that this process is not a kind of insanity, on the contrary it is fascism being escalated systematically and consciously.
In a fascist system there is no security for oppressed peoples.
In a fascist system there is no sanity, happiness or smiling face for oppressed peoples.
Fascism means continuously watching your back, it is fear and eeriness.
The only promise of fascism for peoples is to make them cut each other’s throat and massacring, imprisoning, torturing unimaginably at any moment.
And we would like to underline once again that fascism will not go away if we wait, stand still and keep silent. Fascism’s best friend has always been fear and silence. And its antidote is resisting wherever we are, without giving up honour, hope and humanity.
As Ulrike Meinhof said years ago, “either you are part of the problem or part of the solution”. Even it is difficult, it is that simple and there is no other choice!

Beijing human rights lawyer Jiang Tianyong, last heard from on 21 November, is said to be in held in police custody for allegedly “leaking state secrets”. His whereabouts remain unknown and, without access to a lawyer, he is at risk of torture or other ill-treatment.

Turkey: LAWYERS ARE BEING DETAINED, TORTURED, ARRESTED!

We are experiencing a period in which the political power is increasing its oppression of the whole society in general, and democratic political organizations, press, civil society organizations specifically, as it reformulates its already existing regime of oppression through the so called State of Emergency after the July 15 Coup Attempt. We- as lawyers and the Law Organizations we represent, experience the effects of this regime based on oppression, detention and imprisonment more and more with each passing day. The executive orders legislated by the president are hindering us from performing our profession in police stations, courthouses and prisons. Through these executive orders our organizations have been shut down and the number of detained and arrested lawyers is increasing.
Our professional association, the Bar Association is turning a blind eye to these attacks that we suffer because of our profession. Instead of standing against these attacks, there has been neither a single statement of protest against these acts nor a single statement in our support from the Bar Association. We are protesting this attitude which supports the State of Emergency regime, a regime that is based on force and oppression.
As of today the lawyers Özkan Gören, Bülent Özışık, Velat İzol, Cemo Tüysüz, Gülay Koca, Serdar Gökhan, Mevlüt Güneş, Aslan Veysanoğlu and Sait Dağ, which are members of Bar Association of Urfa have been detained since 8 days for performing their professions. Chairmen and chairwomen of the Mesopotamia Lawyer’s Association, Seher Acay, Ziya Bagi, Feyzi Adsız and Mahmut Bingül of Mardin Bar Association and Özden Saldıran of Antalya Bar Association are arrested after 25 days of detention. Emirhan Uysal, a member of Şırnak Bar Association and Co-chair of Human Rights Association Şırnak Branch is released as of 19.12.2016. Deniz Sürgüt, a lawyer of İstanbul Bar Association has been arrested since more than a year. Tugay Bek, a member of Adana Lawyers Association, who was released from custody with judicial control decision on 19.12.2016 and Barkın Timtik, a member of İstanbul Bar Association who has been arrested on the same day have (Mr. Timtik is also a chairman of Contemporary Lawyers Association) suffered from maltreatment and torture while being under custody. We remind that any maltreatment and torture against our fellow lawyers have not been committed just against them, but also on all of us and our profession through them, and we start an effective legal process to hinder these crimes from going unpunished.
We as lawyers for freedom repeat once again that we will neither recognize nor obey the State of Emergency regime based on force and oppression. We will stand by our fellow lawyers when they are detained, tortured and arrested and struggle against the law-violating regime of oppression, and we shall win!

Saudi Arabia: Immediately and Unconditionally Release Waleed Abu al-Khair | Letter

Lawyers’ Rights Watch Canada (LRWC) is a committee of lawyers and others who promote international human rights and the rule of law through advocacy, education and research. LRWC campaigns for lawyers and other human rights defenders in jeopardy because of their human rights advocacy. LRWC is a non-governmental organization in Special Consultative Status with the Economic and Social Council of the United Nations (UN).

Waleed Abu al-Khair has been selected as a recipient of the Law Society of Upper Canada 2016  Human Rights Award in recognition of his,

extraordinary contributions to the advancement of human rights and promotion of democracy and the rule of law in Saudi Arabia over the course of his career as an advocate, made at high personal cost, [which] demonstrate the highest ideals of the legal profession.

The Law Society of Upper Canada, in a letter from Paul B. Schabas, Treasurer of the Law Society of Upper Canada, [1] has invited Waleed Abu al-Khair to attend in person to accept the award at the award ceremony on 22 February 2017 in Toronto, Ontario, Canada.

LRWC asks the Kingdom of Saudi Arabia (Saudi Arabia) to comply with its international law obligations and to:

  1. Immediately and unconditionally release Waleed Abu al-Khair;
  2. Remove the travel ban prohibiting Waleed Abu al-Khair from leaving Saudi Arabia for 15 years after his release and vacate the SAR 200,000 fine; and,
  3. Ensure all other measures necessary to allow and enable Waleed Abu al-Khair to attend in person to accept the Law Society of Upper Canada 2016 Human Rights Award at the ceremony on 22 February 2017 in Toronto, Ontario, Canada.

Release of Waleed Abu al-Khair

Waleed Abu al-Khair was arrested on 14 April 2014 and subsequently sentenced to 15 years in prison, a travel ban of 15 years following completion of the prison sentence and a fine of SAR 200,000.  He had been charged under the Penal Law for Crimes of Terrorism and its Financing with a variety of vague and over-broad offenses based on and aimed at, sanctioning his peaceful advocacy for recognition of human and democratic rights.  The charges were either too vague to allow avoidance or defense or did not relate to criminal activity.  Examples of the former were, ‘seeking to discredit state legitimacy’ and ‘preparing, storing and sending what would prejudice public order’ – of the latter, ‘running an unauthorized association and being its chairman speaking on its behalf and issuing statements and communicating through it.’

Leading members of the international human rights community have concluded his imprisonment lacks any legal justification, is arbitrary and constitutes a violation of all applicable international law provisions binding on Saudi Arabia.  This conclusion was confirmed by the 2015 Opinion of the UN Working Group on Arbitrary Detention.
