Burundi: Situation de quatre avocats burundais menacés de radiation du Barreau

L’Observatoire international des avocats en danger (OIAD) a pris connaissance du fait que quatre confrères, avocats au Burundi, sont actuellement menacés de radiation en raison d’une saisine disciplinaire de  l’Ordre des Avocats du Barreau de Bujumbura par le Parquet général.

Il s’inquiète que cette saisine, sommairement motivée, réclame la radiation des confrères concernés avant même que l’instruction disciplinaire  n’ait eu lieu.

La requête du Parquet contre Armel Nyongere, Vital Nshimirimana, Dieudonné Bashirahishize et Lambert Nigarura se fonde sur l’existence de dossiers pénaux dont le contenu demeure inconnu et qui paraissent concerner la participation à un mouvement insurrectionnel et à une tentative de coup d’Etat.

L’Observatoire redoute que ces poursuites ne soient qu’un prétexte visant à écarter de l’exercice professionnel des avocats engagés dans la défense des droits civiques de leurs concitoyens et dans la lutte contre l’impunité. Plusieurs d’entre ont participé à la présentation de rapports alternatifs, réuni des éléments de preuve ou assuré la représentation de victimes dans le cadre de mécanismes internationaux juridictionnels ou quasi juridictionnels relatifs notamment  à  des disparitions forcées et des allégations de torture, qu’il s’agisse du Comité contre la Torture ou de la Cour de Justice de la Communauté d’Afrique de l’Est.

Vital Nshimirimana est délégué général du Forum pour le Renforcement de la Société Civile au Burundi, Maître Armel Nyongere est Président d’ACAT-Burundi, Maître Lambert Nigarura est coordinateur adjoint de la campagne SOS torture et Maître Dieudonné Bashirahishize est et vice-président de l’East Africa Law Society.

Leurs engagements citoyens ne sauraient constituer un motif pour les priver de la possibilité d’exercer leur profession  au service des justiciables.

Pakistan: ICJ condemns attack on lawyers and others in Quetta

The ICJ has deplored a suicide attack at a hospital in Quetta, which killed dozens of people today.

Many of those killed were lawyers, who had been gathered at a hospital in Quetta following the killing of former president of the Balochistan Bar Association, Bilal Anwar Kasi, in a shooting incident earlier in the day.

“This attack targeted mostly lawyers and intellectuals (many of them from the Pashtun community) who had gathered at the hospital to mourn the loss of one of their own,” said Sam Zarifi, ICJ’s Asia Director.

“As such, it constituted a serious loss for the legal community and increases existing pressure on the independence of the bar.”

The ICJ calls on the Pakistani Government to conduct an immediate, impartial and thorough investigation into the attack and to bring those responsible to justice, including anyone who ordered or was otherwise complicit the crime.

The ICJ also urges the Government to take urgent measures to guarantee the security of lawyers, which should include effective measures of protection against attempts on their lives and lives of their family members.

Turkey: Lawyer Deniz Sürgüt detained

Lawyer Deniz Sürgüt is a former executive of Human Rights Association and a member of Libertarian Lawyers’ Association. On 5th of August 2015 Lawyer Deniz Sürgüt who was caught in the crossfire while on a duty in İdil (a district of Şırnak) on behalf of Liberatarian Lawyers’ Association, was detained. Sürgüt faced psychological and physical torture during his detention. Lawyer Deniz Sürgüt who was in Şırnak city of Kurdistan in order to report on deaths of civillians and violations of law was then arrested and has been serving in Gümüşhane prison. Lawyer Deniz Sürgüt is being accused of “disrupting the unity and integrity of State”. First hearing of Sürgüt will take place on 1st of September 2016 in Midyat province of Mardin.

Pakistan: PBC calls for nationwide strike on Tuesday

Pakistan Bar Council (PBC) Monday strongly condemned the assassination of Bilal Anwar Kasi, President, Baluchistan Bar Association and terrorists attack in Civil Hospital, Quetta.

The PBC has appealed the Lawyers to observe Countrywide strike on Tuesday (August 9) and one week Mourning.

The Lawyers while observing Strike and Mourning will hold protest meetings in their Bar Rooms and wear Black Bands to condemn the tragic incident.

Dr. Muhammad Farogh Naseem, Vice-Chairman and Abdul Fayaz, Chairman, Executive Committee also condemned the terrorists attack.

They demanded of the government to use all resources to maintain law and order situation in Balochistan and provide security and safety to the people.

While expressing solidarity with bereaved families, on behalf of the legal fraternity, they have emphasized the need of evolving foolproof practical strategy and plan for improving the law and order situation.

Pakistan: Attentat meurtrier contre un hôpital au Pakistan

L’explosion a eu lieu au moment où des avocats et journalistes étaient rassemblés à l’hôpital, après l’assassinat d’un avocat en vue.

Un attentat à la bombe a fait au moins 40 morts et une quarantaine de blessés lundi 8 août dans un hôpital de Quetta, capitale de la province instable du Baloutchistan, dans le sud-ouest du Pakistan.

Un bilan provisoire qui risque de grimper encore, selon Saleh Baloch, ministre de la santé de la province, qui a précisé que l’armée s’est déployée dans et autour des hôpitaux de la ville.

Parmi les victimes figurent deux journalistes de télévision, a fait savoir Daud Khilji, responsable administratif à Quetta.

Une région en proie aux violences

L’explosion a eu lieu au moment où des avocats et journalistes étaient rassemblés à l’hôpital, après l’assassinat de Bilal Anwar Kasi, un avocat en vue, président de l’association du barreau de la province. Ni l’assassinat ni l’attentat n’ont été revendiqués jusque-là.

A blast at the accident and emergency department of a hospital in Pakistan’s Quetta, where a group of mourning lawyers were gathered to accompany the body of a murdered colleague, has killed and wounded dozens.

At least 40 people were killed in the suicide blast on Monday, hospital sources and Muhammad Ali, a paramedic in charge of the Edhi rescue operation, confirmed to Al Jazeera.

More than 50 others were wounded, the sources said.

“The blast occurred after a number of lawyers and some journalists had gathered at the hospital following the death of the president of the Balochistan Bar Association in a separate shooting incident early this morning,” said Balochistan Home Minister Sarfraz Bugti.

Many of the dead appeared to be wearing black suits and ties.

China: To American Bar Association With Regard to ABA Human Rights Award to Wang Yu

Over the last week, we all wondered whether the American Bar Association would go ahead with bestowing its inaugural International Human Rights Award to the Chinese human rights lawyer Wang Yu. On August 1 she appeared on camera in China, repenting her courageous work fighting for justice and the rule of law, and repudiating the ABA award because she is a Chinese person and loves her country — as though receiving the award would be a betrayal of China.

It was indeed Wang Yu speaking, but from an undisclosed location, after nearly 13 months in secret detention, to three people whose faces and identities were hidden. We cannot begin to fathom what has happened to her and dozens of other human rights lawyers and activists who have been detained — but luckily now the whole world understands the simple fact that when she’s not free, she’s not free to speak her mind.

One thing we do know is that the Chinese government hates international recognition of the courageous Chinese citizens who seek to uphold justice, and who work to make China a freer and more just place. Hu Jia’s own account illustrates this perfectly:

In 2008, I was sentenced to 3.5 years in prison on charges of “inciting subversion of state power,” because I engaged in activities to promote human rights and liberty before the Olympic Games.

The European Parliament awarded me the Sakharov Prize, and I was also nominated for the Nobel Peace Prize. When I was in prison, the head of the Beijing municipal political police led a group of public security and foreign ministry officials to pay a visit to me in prison — they were putting me under intense pressure, trying to force me to make a public announcement that I rejected both the Sakharov Prize and the nomination for a Nobel Peace Prize.
