Egypt: Ongoing arbitrary detention and judicial harassment of human rights lawyer Malek Adly

Description of the situation:

The Observatory has been informed by reliable sources about the ongoing arbitrary detention and judicial harassment of Mr. Malek Adly, a human rights lawyer working for the Egyptian Centre for Economic and Social Rights (ECESR) and co-funder of the Front of Defence for Egyptian Protesters (FDEP).

According to the information received, on July 31, 2016, the Prosecutor decided to extend Mr. Malek Adly’s detention, ongoing since May 5, 2016, for other 15 days pending further investigation on several charges, including of “joining a group to obstruct the law”, “spreading false news”, “plotting to overthrow the government and alter the Egyptian Constitution”, “hindering the official duties of government institutions”, “promoting publications that disrupt national unity”, “inciting the anti-government protests that took place on April 25” and “using violence and force against national security agency officers”. Mr. Malek Adly has been detained without formal charges and in solitary confinement in Mazraah Prison in Torah for 90 days [1].

Mr. Malek Adly was arrested by the Egyptian Security Forces in Maadi, Cairo based on an arrest warrant issued on April 23, 2016. The arrest warrant related to a call to protest on April 25, 2016, condemning the recent government decision to transfer the sovereignty of two Red Sea islands to Saudi Arabia (Tiran and Sanafir) and against President Al Sissi’s policies, human rights abuses and crimes committed by the Egyptian security forces. On April 11, 2016, Mr. Malek Adly had also filed a lawsuit against such Government’s decision on the islands.

Turkey: Londra’da Tahir Elçi İnsan Hakları Vakfı kuruldu


28 Kasım 2015’te öldürülen Diyarbakır Baro Başkanı Tahir Elçiadına, Londra’da Tahir Elçi İnsan Hakları Vakfı kuruldu.

28 Kasım’da Sur’da Dört Ayaklı Minare’nin çatışmalarda zarar görmesi nedeniyle basın açıklaması yaptığı sırada çıkan çatışmada öldürülen Diyarbakır Baro Başkanı Tahir Elçi adına Londra’da vakıf kuruldu. Türkiye’deki hak ihlallerini Avrupa İnsan Hakları Mahkemesi’ne beraber taşıdığı avukat arkadaşı Anthony Gwılym Fısher, avukat ve gazeteci Orhan Kemal Cengiz ve Tahir Elçi’nin eşi Türkan Elçi tarafından Tahir Elçi İnsan Hakları Vakfı kuruldu. Türkan Elçi, sosyal medya hesabı Twitter’da, “Ayrım yapmaksızın, haksızlığa uğramış insanların yanında olabilmek, acılarını duyurabilmek ümidiyle Tahir Elçi Vakfı’nı kurduk” diye yazdı.

Egypt: El-Massry, 6 other detainees continue open-ended hunger strike

Detained award-winning lawyer Mahienour El-Massry along with six other detainees have announced that they will continue their open-ended hunger strike in Qanater women’s prison, demanding implementation of the court’s ruling that allows for visitations, the detainees said in a statement.

The statement continued that the prison’s administration has not evinced the hunger strike in a report despite the deteriorating health of Basma Refaat, one of the strikers who was prohibited from seeing her children, adding: “Is that negligence from the administration or orders from national security?”

The statement concluded by saying that the strike is ongoing until the prison administration implements the strikers’ main demand.

The detainees announced their hunger strike on 28 July in a statement  in solidarity with Refaat who started her hunger-strike one week before the other detainees joined her.

El-Massry was sentenced to one year and three months in prison in 2015 over charges of breaking into Al-Raml police station and assaulting police officers in Alexandria in 2013.

In 2014, El-Massry won the Ludovic Trarieux award, an award that is given annually to a lawyer who contributes to defending human rights.

China: Assault on human rights lawyers and activists escalates with convictions after sham trials (AI)

The Chinese authorities must end their relentless suppression of human rights lawyers and activists, Amnesty International said today, after a prominent lawyer became the latest to be convicted after an unfair trial.

On Thursday, Zhou Shifeng was sentenced to seven years in prison after being found guilty of “subverting state power”, following a trial that lasted less than a day at Tianjin No.2 People’s Court in north east China.

On Wednesday this week, democracy activist Hu Shigen was sentenced to seven-and-a half-years for “subverting state power”, and on Tuesday activist Zhai Yanmin was given a three-year prison sentence, suspended for four years, after being convicted of the same charge.

“This wave of trials against lawyers and activists are a political charade. Their fate was sealed before they stepped into the courtroom and there was no chance that they would ever receive a fair trial,” said Roseann Rife, East Asia Research Director at Amnesty International.

“The Chinese authorities appear intent on silencing anyone who raises legitimate questions about human rights and uses the legal system to seek redress.”

The convictions are the first against individuals caught up in an unprecedented crackdown, which began in July 2015 and saw 248 human rights lawyers and activists targeted.

The three men sentenced this week were held in pre-trial detention for more than a year, denied defence lawyers of their choice and their families were not allowed to attend the trials. Chinese state television also broadcast “confessions” from Zhai Yanmin and Zhou Shifeng ahead of their trials. Amnesty International has documented a pattern of such tactics being used against detained rights lawyers and activists.

China: Un avocat chinois condamné à sept ans de prison pour subversion du pouvoir de l’Etat

Zhou Shifeng, responsable du cabinet d’avocat Fengrui, a été condamné jeudi à une peine de prison de sept ans pour subversion du pouvoir de l’Etat.

Il a aussi été privé de ses droits politiques pour cinq ans, a annoncé le Tribunal populaire intermédiaire No 2 de Tianjin, ville portuaire située près de Beijing.

Zhou Shifeng, âgé de 52 ans, a plaidé coupable et a décidé de ne pas faire appel.

Le même tribunal a annoncé respectivement mardi et mercredi les condamnations de deux autres personnes ayant des liens avec Zhou Shifeng.

Une quarantaine de personnes, dont des avocats et des journalistes chinois et étrangers,ont assisté jeudi au procès. Aucun membre de la famille de Zhou Shifeng n’était présent lors du procès, suite à sa demande.

China: Chinese Human-Rights Lawyer Sentenced to Seven Years in Prison — Xinhua

A Chinese court sentenced the director of a law firm known for embracing politically sensitive cases to seven years in prison for subversion on Wednesday, according to the official Xinhua News Agency.

Zhou Shifeng was a central target in a wide government sweep last July, in which roughly two dozen lawyers and activists were formally arrested and more than 300 others brieflydetained or interrogated. Among those arrested, he is the first lawyer to face trial.

Mr. Zhou pleaded guilty to the subversion charges and said he wouldn’t appeal, Xinhua reported.

Mr. Zhou couldn’t be reached. He was assigned a court-appointed lawyer, whose identity isn’t known, after authorities refused his family’s attempts to hire a lawyer for him, according to a former colleague, Liu Xiaoyuan.

“Seven years is much worse than I thought,” said Mr. Liu, who is also a lawyer. “All the information I’d heard before this suggested as long has he pleaded guilty and accepted the charges, he’d get a light sentence.”

Mr. Zhou’s Beijing-based law firm, Fengrui, has defended some of China’s most politically sensitive figures, including dissident artist Ai Weiwei and members of the banned Falun Gong religious group. The firm also represented Ilham Tohti, an economics professor and ethnic-rights activist from China’s Uighur minority group who was sentenced to life in prison for inciting ethnic hatred and other charges in 2014.

China: Law firm director stands trial for subverting state power

Chinese lawyer gets 7 years in prison for state subversion

Zhou Shifeng, a lawyer formerly managing the Fengrui Law Firm, was convicted of subverting state power and sentenced to seven years in prison on Thursday.

He has also been deprived of his political rights for five years, according to the No. 2 Intermediate People’s Court in Tianjin, a northern port city close to Beijing.

Zhou, 52, pled guilty and said at the court he would not appeal.

The same court announced the sentences for another two men related to Zhou respectively on Tuesday and Wednesday.

More than 40 people, including lawyers and journalists from home and overseas, observed Thursday’s trial. No Zhou’s family members were present as he requested.

A Chinese lawyer is in court in the third of a series of subversion trials demonstrating the ruling Communist Party’s determination to shut down independent human rights activists and government critics.

Zhou Shifeng’s trial got underway Thursday morning in the northern city of Tianjin. Zhou had been director of Beijing’s Fengrui Law Firm that took on numerous sensitive cases and represented people who dared challenge the party.

His trial follows those of two legal activists earlier this week, one of whom was sentenced to 7 ½ years and the other given a suspended sentence, both on charges of subversion.

As with the others, Zhou was detained in July of last year amid a sweeping roundup of activists and lawyers, most of whom were eventually released after questioning.
