Assassinat de notre confrère Kenyan Maître Willie Kimani (fr/en)

La CIB qui regroupe les barreaux de 44 pays francophones marque son indignation à l’annonce de l’assassinat de Maître Willie Kimani dont on a retrouvé le corps sans vie, les poignets ligotés, dans un sac flottant sur la rivière Ol Donyo Sabuk dans la banlieue de Nairobi.

Me Willie Kimani, travaillait sur des dossiers de violences policières et tout porte à croire qu’il a été enlevé avec son client et qu’il a été torturé et séquestré par des policiers.

Ce crime odieux commis par ceux qui sont en charge du maintien de l’ordre, contre un avocat dans l’exercice de la défense est une atteinte insupportable à l’état de droit.

La CIB adresse ses condoléances au barreau du Kenya et à la famille de Me Willie Kimani.

La CIB est aux côtés du barreau du Kenya. Elle demande que toutes dispositions soient prises pour que les auteurs de cet assassinat soient recherchés, poursuivis et jugés, pour que cessent les violences policières et que les avocats et magistrats soient protégés.

 

The CIB which gathers the Bars from 44 francophone Countries wishes to express its indignation at the  Willie Kimani’s assassination. The Body of the lawyer was tied up and was recovered in a bag floating on the Ol Donyo Sabuk river in the Nairobi suburb.

The abhorrent crime committed by the police in charge of the security and the public order against  a lawyer in the exercise of its functions is an intolerable blows to the rule of law.

The CIB expresses its condolences to the Kenya’s bar and to the Willie Kimani’s family.

The CIC is standing beside the Kenya’s Bar and calls for all necessary measures shall be taken to ensure that the perpetrators of that assassination be identified, prosecuted and judged. The CIB calls for an end to the police violence and for the protection of the lawyers and judges.

The founding members of the International Observatory for Lawyers in Danger met in Madrid on Thursday 21 April 2016

At the invitation of Ms Victoria Ortega Benito, who has been President of the Consejo General de la Abogacía Española since 28 January 2016, the Conseil national des barreaux, represented by Richard Sédillot, Vice-President of the European and International Affairs Committee, the Paris Bar, represented by Dominique Attias, Vice-President, and the Consiglio Nazionale Forenze, represented by Francesco Caia, Advisor and Coordinator of the Human Rights Committee, met in Madrid to sign the statutes of the International Observatory for Lawyers in Danger.

In an international context which is particularly difficult in terms of Defence and which has been marked by the arrest and detention of many lawyers, notably Turkish and Chinese lawyers, signing the Statutes of the International Observatory for Lawyers in Danger constitutes a strong act engagement on the part of bar associations to defend lawyers around the world.

The Observatory is open to all bars and lawyers’ associations and intends to provide support to lawyers who come under threat because they exercise their profession. Through monitoring and organising missions to provide moral, legal or material support, the Observatory’s ambition is to provide assistance to lawyers whose life, freedom, or right to practise comes under threat because the most basic principles of the rule of law are not being respected.

The Conseil national des barreaux expresses serious concerns about the situation of lawyers in Egypt

The Conseil national des barreaux denounces the alarming human rights situation in Egypt, where many human rights defenders, including numerous lawyers, are facing severe repression from the authorities. The Conseil national des barreaux deplores the measures of detention used against these lawyers, from bans on leaving the country to detentions and security searches at airports which border on harassment – as the lawyer Ragia Omran was victim to at the start of this month – to being held in custody. The Conseil national des barreaux would like to express criticism and outrage at the deaths of many lawyers who were under the control of security forces.

In February 2015, the lawyer Mahienour el-Massry was sentenced to 2 years imprisonment for “aggression” against police officers during a peaceful protest in March 2013. She was placed in remand custody on 11 May 2015 and her sentence was reduced on appeal to 1 year and 3 months on 31 May 2015. In 2014, she had won the Ludovic Triarieux International Human Rights Award and is still in custody to this day.

The lawyer Malek Adly is a renowned human rights militant and director of the Lawyers Network of the Egyptian Center for Economic and Social Rights (ECESR), whose goal is to spread the culture of human rights. It is one of the founders of the Front of Defense for Egyptian Protestors, a group made up of 34 human rights defense organisations and many lawyers and which documents the illegal practices carried out by police forces against peaceful protests.

Adoption d’une Résolution de l’Observatoire International des Avocats en Danger lors du Congrès Mondial contre la Peine de mort à Oslo, le 23 juin 2016

Le Conseil national des barreaux, le Barreau de Paris, le Consejo General de la Abogacia Espanola et le Consiglio Nazionale de Forenze – membres fondateurs de l’Observatoire international des avocats en danger – ont présenté à Oslo, par la voix de Richard Sédillot, Vice-Président de la Commission des Affaires européennes et internationales du Conseil national des barreaux, une Résolution au soutien des avocats menacés en raison de leur engagement contre la peine de mort. La résolution a été largement saluée par les participants du Congrès lors de la séance plénière de clôture.

Cette résolution marque l’engagement résolu des avocats et barreaux représentés au sein de l’Observatoire en faveur de l’abolition universelle de la peine de mort. Elle rappelle que la profession d’avocat a un rôle de premier plan à jouer dans ce combat et souligne que cet engagement peut parfois entrainer d’importants risques pour les avocats, à l’image de Narguesse Mohammadi, avocate en Iran, condamnée à 10 ans de prison pour son engagement pour l’abolition.

Kenya: Kenyan police to be charged with murder of human rights lawyer

Kenyan authorities have said they wil charge three police officers with murder after a noted lawyer was found dead. Human rights groups believe the police wanted to silence the victim over a court case.

The bodies of lawyer Willie Kimani and motorcycle taxi driver Joseph Muiruri were discovered in a river on Friday, prompting Kenyan authorities to announce that three police officers had been arrested and would soon be charged over the murders.

The policemen are suspected of murdering the two men – along with a third, still missing man, Josephat Mwenda – in order to keep them silent in the wake of a court case that shed light on police abuse. Mwenda claimed he was shot by a police officer without provocation back in April 2015 and subsequently arrested on trumped-up charges.

Mwenda said he had received death threats after reporting the policeman. Kimani was representing Mwenda in court.
